It was discussed that the September 20, 2018 hearing be continued to October 18, 2018, with the city to give additional notice regarding same, for further consideration by the Code Enforcement Board prior to issuance of an order inclusive of findings of fact relating to the alleged violation(s). Respondent was present and provided sworn testimony and evidence. Respondents made no objection to continuing the hearing to a future date. The Code Enforcement Board, having reviewed the entire file as provided and being otherwise fully advised in the premises, enters this Order. Page 2 2017-137 Our office has received several complaints regarding conditions at your property. A site visit revealed interior and exterior property maintenance violations as well as electrical hazards. It was also discovered people are living in the west most commercial unit downstairs. On May 17, 2018 a site visit revealed a palm frond covered upstairs door overhang, tiki bar and gazebo structure have been built without permits or a licensed contractor. You have also paved the east side of the property without obtaining a permit as well. Description of Violation(s) at property: Section 34-38. - Owner's maintenance of premises. The owner or person in control of any private property shall at all times maintain the premises free of litter. However, this section shall not prohibit the storage of litter in authorized private receptacles for collection. Section 34-96. - Standards established. (a) Continued good appearance depends on the extent and quality of maintenance. Maintenance and upkeep are required for all the land improvements within the city. Lawns and planting require considerably more periodic attention than do buildings, nonetheless both require maintenance in order to retain a good appearance. (b) The owner of every single-family or multiple -family dwelling, commercial or industrial property or his appointed agent and any occupant, operator, tenant or anyone otherwise using the property in any form or manner shall be responsible for maintaining the exterior in a clean, sanitary and safe condition. All parts thereof shall be maintained in good repair and shall be capable of performing the function for which such structure or part of any feature thereof was designed or intended to be used. (d) Exterior property areas of all premises shall be kept free of all nuisances, litter, rubbish, debris, objects, material or conditions which may create a health or fire hazard. Exterior property areas shall be free of unsanitary conditions which constitute a blighting or deteriorating influence on the neighborhood. Lawns, landscaping, driveways and fences shall be maintained so as not to constitute a blighting or deteriorating effect in the neighborhood. Section 34-97. - Duties and responsibilities for maintenance. (a) The owner of every single-family or multiple -family dwelling, commercial or industrial property, his appointed agent and the occupant, operator, tenant or anyone otherwise using the property in any fonn or manner shall maintain the premises free of hazards which include but are not limited to: (1) Brush, weeds, broken glass, stumps, roots, obnoxious growths, accumulations of filth, garbage, trash, refuse, debris and inoperative machinery. Section 34-121. - Intent. The presence of weeds, brush and rank vegetation (excluding: shade trees, ornamental shrubs, fruit trees, domesticated berry bushes and vines, cover crops, domesticated grains and plantings and cultivated wild flowers) on all properties in city are a menace to the public safety, health and welfare as they: (1) Cause a fire hazard; (2) Furnish cover for prowlers; (4) Furnish a potential harborage or breeding place for disease -carrying insects, arthropods, animals and poisonous snakes; and (5)May adversely affect and impair the economic welfare of adjacent property. Section 34-122. - Public nuisances prohibited. (a) All grass areas and yards on improved property shall be properly maintained in a neat and attractive manner and kept free of dead plants, refuse, debris and shall be maintained further in a manner such that grass, weeds and other rank vegetation shall not exceed six inches in height. Section 82-12. - Unsafe buildings or systems. All buildings, structures, electrical, gas, mechanical or plumbing systems which are unsafe, unsanitary, or do not provide adequate egress, or which constitute a fire hazard, or are otherwise dangerous to human life, or which in relation to existing use, constitute a hazard to safety or health, are considered unsafe buildings or service systems. All such unsafe buildings, structures or service systems are hereby declared illegal and shall be abated by repair and rehabilitation or by demolition in accordance with the provisions of the Standard Unsafe Building Abatement Code or other provisions of the City of Cape Canaveral Codes. Section 82-371. - Posting and specifications of numbers. Numbers indicating the official numbers for each principal building or each front entrance to such building shall be posed in a manner as to be clearly visible and distinguishable from the street on which the property is located. In the C-1 low density commercial district, the following uses and structures are prohibited: (1) All uses not specifically or provisionally permitted in this division. (2) Any use which fails to meet performance standards specifications as provided in section 110- 466. Section 110-551. - Location of recreational vehicles, camping equipment, boats and boat trailers. (2) Regulations. The following regulations shall apply to boats, utility trailers, recreational vehicles or special purpose vehicles: (d.) All vehicles herein permitted shall have affixed thereto a currently valid license tag registered to the vehicle, shall be parked or stored with wheels and tires mounted, and shall be maintained in a movable condition. Section 110-555. - Paving of vehicular use areas. All commercial and industrial areas used for the display or parking of any and all types of vehicles, boats or heavy construction equipment and all land upon which vehicles traverse the property as a function of the primary use, including but not limited to drives, parking, service and display areas, shall be paved. Section 110-171. - Establishments serving alcoholic beverages. (4) One parking space shall be provided for each three seats or seating places. All seats or seating places, whether located within a restaurant area or a bar/lounge area, will be included in the calculation of the required number of parking spaces. Package retail sales establishments shall provide parking as determined by the building official, who shall use the ratios established in article IX of this chapter. Section 82-221. - International Property Maintenance Code adopted. ( I.P.M.C. ) The International Property Maintenance Code, 1998 edition, as published by the International Code Council, is hereby adopted by reference and incorporated herein as if fully set out. Unsafe equipment includes any boiler, heating equipment, elevator, moving stairway, electrical wiring or device, flammable liquid containers or other equipment on the premises or within the structure which is in such disrepair or condition that such equipment is a hazard to life, health, property or safety of the public or occupants of the premises or structure. I.P.M.C. 302.2 Protective treatment. All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches and trim, shall be maintained in good condition. Exterior wood surfaces, other than decay resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints as well as those between the building envelope and the perimeter of windows, doors, and skylights shall be maintained weather resistant and water tight. I.P.M.C. 303.7 Roofs and drainage. The roof and flashing shall be sound, tight and not have defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and downspouts shall be maintained and in good repair and free from obstructions. Roof water shall not be discharged in a manner that creates a public nuisance. I.P.M.C. 303.14 Window, skylight and door frames. Every window, skylight, door frame shall be kept in sound condition, good repair and weather tight. I.P.M.C. 303.16 Doors All exterior doors, door assemblies and hardware shall be maintained in good condition. Locks at all entrances to dwelling units, rooming units and guestrooms shall tightly secure the door. I.P.M.C. 304.3 Interior surfaces. All interior surfaces, including windows and doors, shall be maintained in good, clean and sanitary condition. The owner or person in control of any private property shall at all times maintain the premises free of litter. However, this section shall not prohibit the storage of litter in authorized private receptacles for collection. Section 34-96. - Standards established. (a) Continued good appearance depends on the extent and quality of maintenance. Maintenance and upkeep are required for all the land improvements within the city. Lawns and planting require considerably more periodic attention than do buildings, nonetheless both require maintenance in order to retain a good appearance. (b) The owner of every single-family or multiple -family dwelling, commercial or industrial property or his appointed agent and any occupant, operator, tenant or anyone otherwise using the property in any form or manner shall be responsible for maintaining the exterior in a clean, sanitary and safe condition. All parts thereof shall be maintained in good repair and shall be capable of performing the function for which such structure or part of any feature thereof was designed or intended to be used. (d) Exterior property areas of all premises shall be kept free of all nuisances, litter, rubbish, debris, objects, material or conditions which may create a health or fire hazard. The presence of weeds, brush and rank vegetation (excluding: shade trees, ornamental shrubs, fruit trees, domesticated berry bushes and vines, cover crops, domesticated grains and plantings and cultivated wild flowers) on all properties in city are a menace to the public safety, health and welfare as they: (1) Cause a fire hazard; (2) Furnish cover for prowlers; (4) Furnish a potential harborage or breeding place for disease -carrying insects, arthropods, animals and poisonous snakes; and (5)May adversely affect and impair the economic welfare of adjacent property. Section 34-122. - Public nuisances prohibited. (a) All grass areas and yards on improved property shall be properly maintained in a neat and attractive manner and kept free of dead plants, refuse, debris and shall be maintained further in a manner such that grass, weeds and other rank vegetation shall not exceed six inches in height. Section 82-12. - Unsafe buildings or systems. (2) Any use which fails to meet performance standards specifications as provided in section 110- 466. Section 110-551. - Location of recreational vehicles, camping equipment, boats and boat trailers. (2) Regulations. The following regulations shall apply to boats, utility trailers, recreational vehicles or special purpose vehicles: (d.) All vehicles herein permitted shall have affixed thereto a currently valid license tag registered to the vehicle, shall be parked or stored with wheels and tires mounted, and shall be maintained in a movable condition. Section 110-555. - Paving of vehicular use areas. All commercial and industrial areas used for the display or parking of any and all types of vehicles, boats or heavy construction equipment and all land upon which vehicles traverse the property as a function of the primary use, including but not limited to drives, parking, service and display areas, shall be paved. Section 110-171. - Establishments serving alcoholic beverages. (4) One parking space shall be provided for each three seats or seating places. All seats or seating places, whether located within a restaurant area or a bar/lounge area, will be included in the calculation of the required number of parking spaces. Package retail sales establishments shall provide parking as determined by the building official, who shall use the ratios established in article IX of this chapter. Unsafe equipment includes any boiler, heating equipment, elevator, moving stairway, electrical wiring or device, flammable liquid containers or other equipment on the premises or within the structure which is in such disrepair or condition that such equipment is a hazard to life, health, property or safety of the public or occupants of the premises or structure. I.P.M.C. 302.2 Protective treatment. All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches and trim, shall be maintained in good condition. Exterior wood surfaces, other than decay resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints as well as those between the building envelope and the perimeter of windows, doors, and skylights shall be maintained weather resistant and water tight. I.P.M.C. 303.7 Roofs and drainage. The roof and flashing shall be sound, tight and not have defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and downspouts shall be maintained and in good repair and free from obstructions. Roof water shall not be discharged in a manner that creates a public nuisance.
