Temporary Fencing/Jackson Ave.
Dave,
I spoke to Vincent today and he informed me he is waiting for the contractor to seal and stripe the parking lot along with installing parking stops. Once this is completed he will remove
the fence and will be placing no parking/no trespassing signs on his property. He also stated he would place cones, blocking off his parking area, until it has opened for business.
Thank you.
Sincerely,
Brian Palmer

Hi Wendy. Code enforcement staff is waiting to hear back from the representative of the property owner regarding their immediate plans with the property – which will inform the timing
of the fence removal. I will be out of the office tomorrow and Friday. Can I call you Monday so we can discuss? Dave

Good afternoon,
I'm inquiring about the temporary fence on A1A and Jackson Ave again. Some paving and painting were done shortly after our last correspondence. When will the fence be removed?
It seems to me, there is no construction work that requires that the construction fences be left in place.
Thank you for your time.

Mr. Dickey,
Thank you for your response. Thank you for having the fence moved for pedestrians. I just have a couple comments aside from the shared parking.
I've seen a lot of painting being done to buildings/businesses since I moved to Cape Canaveral 6 years ago. I really cannot recall an ugly construction fence up-----unless there was
actually construction or demolition happening. Also it seems to me, it will be hard to pave with that fence in place.
I think the city has a responsibility to have an end date for removal of that eye sore. If it is for painting and paving, the contractor's should be ready to go and it should be removed
within the next couple of weeks.
Appearances matter.
Thank you all for your time.

Good morning Ms. Ellsworth. Thank you for your email from yesterday regarding the temporary fence on Jackson Avenue.
I want to respond (shown in red) to several questions/comments you raise:
1. Why is the temporary fence needed and allowed now? How long will it be allowed to stay? According to the property representative, the fence has been erected in advance of certain
improvements to the property, to include repaving of the parking lot as well as painting the exterior of the building. City Staff instructed the representative the fence was to be relocated
to the property line and to specifically place the fence inside of the public traffic pole located at Jackson Avenue and N. Atlantic Avenue. In addition, the temporary fence may remain
as long as the afore-mentioned work is actively progressing.
2. Why the patrons of a thriving, tax lucrative business can’t continue to park in that empty lot as they have been doing since this business opened? The area that has recently been
fenced is located at 7802 N. Atlantic Avenue, which is a separate property from the Ellie Mae’s location (120 Jackson Ave.). Whether or not the tenants of Ellie Mae’s had permission
to use the parking on the 7802 N. Atlantic Avenue property is not known, however, it is within the rights of the owner of 7802 N. Atlantic Avenue to prohibit unauthorized parking on
the property. However, the two property/business owners have the ability to enter into a shared parking agreement to allow cross access to the respective parking areas. City Staff has
spoken with the proprietor of Ellie Mae’s so she is aware that this is a private property issue and does not directly involve the City.
I hope you find this responsive to your questions. Please let me know if you have any further questions. Dave
