Good Afternoon,
Thank you Officer Palmer for addressing our concerns. We appreciate all you and your team does to keep our community safe and beautiful. I’m sure your position is sometimes a thankless
job but so vastly important for the economic vitality
of our city.
My main concerns are twofold.
1) The ability for my guests to enter my restaurant from my parking lot totally unimpeded by merchandise or persons.
2) The unsightly and unsafe storefront of 118 Jackson Ave Thrift Shop.
(See pictures below)
Article III- Property Maintenance Standards Section 34-94 (a)-(d) Purpose so accurately describes the reason I continue to bring these concerns before you.
Sec 34-96 (c) prohibited the use of clothes lines.
Sec 34-98 (7) & (9) directly address the need for clean and clear storefronts and acceptable lighting.
Section 110-654 (d) states awnings and canopies should be a minimum of 8ft above the sidewalk- “provided they do not impede pedestrian flows”
I would ask the umbrella be removed because they can not be placed high enough under the awning to not impede pedestrian flows.
I would ask the Building and Appearance codes be enforced and the use of displaying clothing or other materials on a clothes line/extension cord to be prohibited.
I would ask Building and Appearance codes be enforced to remove the use of improper/ and non-functioning outdoor lighting attached by household power strip and extension cords. Proper
outdoor lighting needs to be approved by Community Appearance Board.
If not already in place, I encourage the city to consider an ordinance that prohibits shop owners from sitting outside of their shops and “hawking” and harassing pedestrians on the way
to another business.
If not already in place, I encourage the city to ask all business renewing their Business Tax Receipts to provide proof of sales tax paid to the Florida Department of Revenue for the
previous year to ensure the state of Florida and the city of Cape Canaveral are receiving their needed funds.
Thank you again for your attention to all of these hard matters. I look forward to a resolution that enhances our beautiful city of Cape Canaveral.

Good Afternoon,
Code Enforcement has conducted a site visit to the property located at 116 Jackson Ave and made contact with the owner of the thrift store. We spoke to the owner regarding the umbrellas
and informed him he needed to keep them raised so they do not obstruct pedestrians, which he complied. We also did not see any other violations of city code during the site visit. Code
Enforcement will continue to monitor the area.
Thank you.

The owner of Ellie Mays Tiki Bar stated the following to me and provided the picture below…
are REALLY struggling to attract any new guests. Would you be willing to walk around the broken down van, and this couple blocking the sidewalk to try out a new restaurant?
I am struggling to understand how this illegal business continues to remain open. If you think I should send my concerns directly to Officer Palmer or Dave Dickey I am happy to do so.

Subject: 116 Ave Thrift Store
Officer Palmer,
Is there anything in our code that would prohibit the use of umbrellas and chairs partially or entirely blocking the entrance walkway in front of the thrift store next to Ellie Mays
Tiki Bar at 116 Jackson Avenue?
I spoke to David about this issue and not sure if this something you are aware of and or have under your review. If not, please disregard and or I appreciate your help to please let
me know a better path to find out the answer.
If you want to call me that works too.
Thank you,
Wes Morrison
