HomeMy WebLinkAboutCase #23-366 Field NotesTHE CITY OF CAPE CANAVERAL Date: 5/10/2024 Code Officer Field Notes CASE NO. 2023-366 Address: 116 Jackson Ave Cape Canaveral, FL. 32920 Owner: Randall Shane Reynolds Date: Comments: 8/6/22 There was a fire in the rear first floor storage room that completely damaged the room and put a hole in the roof. Due to the fire damage the room and the second floor directly above, which contains two dwelling units, have been deemed unsafe for human occupancy and posted as such by the Building Official Mike German. 5/18/23 The code enforcement manager received a complaint from Peg Schaller that the fire damaged room still has not been repaired and people are living in the second floor units. The complaint was forwarded to me to investigate. A site visit revealed the fire damaged room has not been addressed and the unsafe conditions remain. A check of the second floor units did reveal an individual in the unit but they denied living there. I contacted the owner and explained that no one can be upstairs until the frie damage has been repaired and inspected. We also discussed what the status of the repairs is. He said his tenant is not paying rent so he is looking for someone to help him. 5/24/23 -9/24/23 Staff has continued to receive complaints that individuals are living in the second floor units as well as the closet below the staircase. Each time I conduct a site visit no one was present except for one time. That one time the individual refused to acknowledge me so I contacted the property owner to have them removed. 11/1/23 I was informed that Peg Schaller complained about the fire damage still not being addressed and individuals continuing to go upstairs. A Notice of Violation was generated and sent certified mail and the property was posted. I was contacted by the property owner who said he found the posting. We discussed what needs to be done to come into compliance. He understood and said he may have found someone to help him. 11/13/23 Due to the life safety issues continued complaints that the violations are not being addressed I sent a notice of hearing and posted the property. The property owner contacted me and I explained our concerns and that he needs to have a plan in place to present to the magistrate, what steps he is going to take and an expected completion time. 12/7/23 A magistrate hearing was held and the property owner was ordered to fix the life safety issues with the staircase and open garage by December 22 and the remaining fire damage by March 1, 2024. 12/25/23 I spoke with Shane about compliance and he said he was having difficulty getting a contractor to demolish the staircase and build a wall over the garage door in the time frame allotted. We discussed erecting a fence and locking the gate to prevent access to the staircase. He said he could pull the garage door down to prevent access and hide the clutter from the outside. 1/9/24 I conducted a site visit and observed a six foot fence erected with a locked gate preventing access to the staircase area. I also observed the garage door closed to prevent access as well as to hide the clutter inside from view. 1/11/24 I was informed that there is concern from City Administration that the violations have not been corrected in accordance with the magistrate orders. I spoke with Shane and informed him THE CITY OF CAPE CANAVERAL Date: 5/10/2024 Code Officer Field Notes CASE NO. 2023-366 Address: 116 Jackson Ave Cape Canaveral, FL. 32920 Owner: Randall Shane Reynolds of these concerns and asked if he could meet with myself and City Administration, which he agreed to. 1/23/24 A compliance hearing was conducted to see if the property was in compliance with the magistrate orders, It was determined that the garage and storage room under the stairs were boarded up and in compliance. The staircase, it was determined, needed more to be done to satisfy the city’s concerns. The property owner was given until January 28 to comply with the new orders. 1/29/24 A site inspection found the staircase has been enclosed with an 8 foot wall and the Department Director Dave Dickey as well as the City Manager Todd Morely have agreed the wall is sufficient. 3/11/24 A site inspection revealed no work has been performed to repair the fire damaged room or roof. No permits have been applied for at this time. 3/14/24 A Notice of Massey Hearing was sent to the property owner. 4/23/24 A Massey Hearing was conducted and the Special Magistrate placed a lien on the property.
