The lot split plan and proposed variances are for the sole purpose of seeking approval to construct one detached, single-family home on each of the proposed two lots. The subject vacant property is owned by Michael and Colette DiChristopher, zoned R-1 Low Density Residential, approximately 0.39 acres, more or less, identified as Brevard County Tax Parcels 24-37-14-51-9-21.01 and 24-37-14-51-9-21.02, and legally described as Lot 21, Block 9, Cape Canaveral Beach Gardens Unit No. 2 according to the map or plat thereof, as recorded in Plat Book 17, Pages 81 and 82 of the public records of Brevard County, Florida, less the west 25.00 feet thereof. Said land is located on the north side of the eastern terminus of E. Central Boulevard where it meets Ridgewood Avenue (no addresses assigned). The proposed variances are generally described as: (1) a 13-ft. variance from the 75-ft. minimum width requirements for lots in the R- 1 district as established by Sec. 98-107(a); (2) a variance to Sec. 98-107(b)(3), which requires that corner lots be a minimum of 15 percent larger than the adjacent lot; and (3) the application of Sec. 98-107(d) — double and reverse lots should be avoided. The proposed lot split plan, application and agenda item may be inspected at the City Clerk's Office at 100 Polk Avenue, Cape Canaveral, FL 32920 during regular working hours after July 12, 2023. All public hearings will be held at the Cape Canaveral City Hall, Council Chambers Room, 100 Polk Avenue, Cape Canaveral, FL 32920. The Planning and Zoning Board will conduct a hearing and make a recommendation to the City Council. Subsequent to the Planning and Zoning Board's recommendation, notice is also hereby given that a public hearing will be held by the City Council on Tuesday, uga.c:k\; I "T (AT at 6:00 P.M. for purposes of rendering a final decision on the proposed lot split plan and related variances. Interested parties are invited to attend the hearings and be heard. Any comments regarding the request can be made in person at the meeting(s), or submitted in writing to the City of Cape Canaveral, C/O Community and Economic Development Department, 100 Polk Avenue, P.O. Box 326, Cape Canaveral, FL 32920-0326. The Planning and Zoning Board and City Council reserve the right to continue or postpone hearings to a date certain without re -advertising. Any written comments that are received by the City on the subject matter stated herein at least 24 hours prior to the public hearings will be made available to the boards for their consideration. Pursuant to Section 286.0105, Florida Statutes, the City hereby advises the public that: If a person decides to appeal any decision made by the Planning and Zoning Board with respect to any matter considered at the public hearing(s), that person will need a record of the proceedings, and for such purpose that person may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. This notice does not constitute consent by the City for the introduction or admission into evidence of otherwise inadmissible or irrelevant evidence, nor does it authorize challenges or appeals not otherwise allowed by law.
