What can be done immediately to ensure public safety? The property owner was contacted in regards to the fire damage and was informed that portion of the property was unfit for human occupancy. An NOV would not have been issued because fires are normally repaired through insurance companies that can take time to render payments to begin repairs. CE has also recently, after receiving complaints from Peg, reached out to the property owner who informed us he was in the process of getting financial support to start repairs. CE is also generating an NOV that will be sent to the property owner due to inactivity in conducting those repairs. 2) Why Code Enforcement repeatedly and inaccurately stated that compliance had been obtained in the field when it was not? What can the City do moving forward to ensure all complaints are addressed fairly and equitably? Need more information on what is not being addressed however, CE addresses all complaints in the same manner. - CE receives complaint - Conduct site visit to observe violation - Attempt to make contact with property owner to remedy any violations. - If CE is unable to make contact with the property owner a Courtesy letter is created and sent to the property owner. - If the violations continue on the property without any indication the property owner is addressing them an NOV is sent to the property owner. 3) Is there a Code Violation for not securing the condemned garages, or is it because they are not viewed from the ROW, is no action is required by code? Because it’s clearly visible from a neighboring business, is that a violation? A neighboring business would not be a ROW and I am not aware of any garages that have been condemned. If the garages are in a dilapidated condition then CE will address it. Portions of the building have been marked as unfit for human occupancy. CE has repeatedly been out to the property to replace the caution tape. The city is not authorized to board up and secure private property, that is the responsibility of the property owner. 4) I have communicated with Brian or Chris multiple times regarding my concerns and was informed that ALL code violations at the building would be addressed through code enforcement with a site visit. Why is it that Ellie Mae’s is the only recipient of NOVs (and without a single courtesy letter)? Whereas, my reported concerns were not addressed, not the broken stairs, not the boarded up windows, not the falling apart Tiki awning over their upstairs apartment door, not the unsecured doors and garages full of debris. None. No other NOV or Courtesy Letters have been recorded by your staff. All complaints that have been filed regarding this property have been addressed: * The adjacent property at 7802 Atlantic Ave resurfacing, restriping, and laying on new asphalt over an area that was previously dirt without a permit or the need for a water mitigation to prevent additional strain on our storm water system. Their new asphalt is not level and water runs onto our property during heavy rains. The asphalt also has encroached over the property lines and is covering our blue handicap striping. They have a new parking space that once a car is parked in, the front or rear bumper of the car encroaches on our handicap parking space. The property owner was contacted and informed he needed to obtain a permit for the parking area. 8/9/2023 a permit was issued and on 08/9/2023 a final inspection was conducted, passed and the permit was finaled. * The trailer across the street(behind Circle K) is still in a partial demolition state and is not only a huge eye sore but a haven for rodents. Staff contacted the property owner and informed him he needed to remove the dilapidated trailer and it required a permit to do so. 6/14/2023 a demo permit was issued, the permit is still valid and expires on 12/11/2023. * The garage attached to 118 Jackson Ave has not been cleaned or secured. Staff conducted a site visit and observed trash and debris in the rear of the property. Staff also observed the garage door was open however was not viewable from the ROW. Staff made contact with the property owner who stated he would have the area cleaned. Staff conducted a site visit the following week and observed the area in question had been cleaned. Staff also placed more caution tape around the stairs entrance to warn individuals not to enter. * The upstairs address at 120 AB have been condemned for safety due to a hole in the ceiling and no power, but there is nothing blocking access to it, so people are coming and going from up there all hours of the night. CE Staff has regularly visited the site along with BCSO and placed caution tape blocking the entrance. BCSO has also removed individuals. If these issue have re-occurred or are in violation again CE will address with an NOV. 5) Why did code enforcement staff merely talked to owners (no written documentation or NOV ) at 151 Jackson Ave (Dilapidated Trailer), 7802 N Atlantic Ave ( Paving over Dirt), and of course Shane Reynolds, for more than 15 mos when each of these owners violations created either a safety, environmental, or economic hazard to our city? Why would my putting gravel down, be so much more egregious that it immediately initiated a NOV, with a 30 day call for action, or face a $250 per day fine? (Again- No courtesy letter was sent) Dave, not only were my valid requests for help completely disregarded, I was met with what appears to be swift retaliation on the part of your Code Enforcement Officers. An NOV was sent to the property owner and a copy to the owner of Ellie Mea’s because CE originally contacted the property owner, as we do on all complaints, and informed him of the violations occurring at Ellie Mea’s. The property owner requested we send him an NOV for the violations at Ellie Mea’s. The filling in of the retention swale was addressed through the NOV due to the property already having an NOV in regards to Ellie Mae’s. I just want to circle back on some concerns I had back in August when you came out to see the property. 1) The adjacent property at 7802 Atlantic Ave resurfacing, restriping, and laying on new asphalt over an area that was previously dirt without a permit or the need for a water mitigation to prevent additional strain on our storm water system. Their new asphalt is not level and water runs onto our property during heavy rains. The asphalt also has encroached over the property lines and is covering our blue handicap striping. They have a new parking space that once a car is parked in, the front or rear bumper of the car encroaches on our handicap parking space. 112,116,118, 120 Jackson Ave had pulled and completed an asphalt permit that was very costly and extensive with the direct supervision of the city’s engineer to ensure proper swales and water retention areas to minimize impact on the city’s storm water system. 2) The trailer across the street(behind Circle K) is still in a partial demolition state and is not only a huge eye sore but a haven for rodents 3) The garage attached to 118 Jackson Ave has not been cleaned or secured 4) The upstairs address at 120 AB have been condemned for safety due to a hole in the ceiling and no power, but there is nothing blocking access to it, so people are coming and going from up there all hours of the night. 5) Just a question as the resurfacing company brought this up to me, Is a permit required to restripe existing and/or new parking spaces? Just to follow up from our visit, my understanding is you are going to research the following:    1) After your visit upstairs and witnessing the obvious safety hazards, why was there not a NOV or courtesy letter sent to the the owner for correction? What can be done immediately to ensure public safety? The property owner was contacted in regards to the fire damage and was informed that portion of the property was unfit for human occupancy. An NOV would not have been issued because fires are normally repaired through insurance companies that can take time to render payments to begin repairs. CE has also recently, after receiving complaints from Peg, reached out to the property owner who informed us he was in the process of getting financial support to start repairs. CE is also generating an NOV that will be sent to the property owner due to inactivity in conducting those repairs.   2) Why Code Enforcement repeatedly and inaccurately stated that compliance had been obtained in the field when it was not?  What can the City do moving forward to ensure all complaints are addressed fairly and equitably? Need more information on what is not being addressed however, CE addresses all complaints in the same manner. - CE receives complaint - Conduct site visit to observe violation - Attempt to make contact with property owner to remedy any violations. - If CE is unable to make contact with the property owner a Courtesy letter is created and sent to the    property owner. - If the violations continue on the property without any indication the property owner is addressing   them an NOV is sent to the property owner.   3) Is there a Code Violation for not securing the condemned garages, or is it because they are not viewed from the ROW, is no action is required by code? Because it’s clearly visible from a neighboring business, is that a violation? A neighboring business would not be a ROW and I am not aware of any garages that have been condemned. If the garages are in a dilapidated condition then CE will address it. Portions of the building have been marked as unfit for human occupancy. CE has repeatedly been out to the property to replace the caution tape. The city is not authorized to board up and secure private property, that is the responsibility of the property owner.   4) I have communicated with Brian or Chris multiple times regarding my concerns and was informed that ALL code violations at the building would be addressed through code enforcement with a site visit.  Why is it that Ellie Mae’s is the only recipient of NOVs (and without a single courtesy letter)? Whereas, my reported concerns were not addressed, not the broken stairs, not the boarded up windows, not the falling apart Tiki awning over their upstairs apartment door, not the unsecured doors and garages full of debris. None. Staff contacted the property owner and informed him he needed to remove the dilapidated trailer and it required a permit to do so. 6/14/2023 a demo permit was issued, the permit is still valid and expires on 12/11/2023.   The garage attached to 118 Jackson Ave has not been cleaned or secured. Staff conducted a site visit and observed trash and debris in the rear of the property. Staff also observed the garage door was open however was not viewable from the ROW. Staff made contact with the property owner who stated he would have the area cleaned. Staff conducted a site visit the following week and observed the area in question had been cleaned. Staff also placed more caution tape around the stairs entrance to warn individuals not to enter.   The upstairs address at 120 AB have been condemned for safety due to a hole in the ceiling and no power, but there is nothing blocking access to it, so people are coming and going from up there all hours of the night. CE Staff has regularly visited the site along with BCSO and placed caution tape blocking the entrance. BCSO has also removed individuals. If these issue have re-occurred or are in violation again CE will address with an NOV.   5) Why did code enforcement staff merely talked to owners (no written documentation or NOV ) at 151 Jackson Ave (Dilapidated Trailer), 7802 N Atlantic Ave ( Paving over Dirt), and of course Shane Reynolds, for more than 15 mos when each of these owners violations created either a safety, environmental, or economic hazard to our city? Why would my putting gravel down, be so much more egregious that it immediately initiated a NOV, with a 30 day call for action, or face a $250 per day fine? (Again- No courtesy letter was sent) Dave, not only were my valid requests for help completely disregarded, I was met with what appears to be swift retaliation on the part of your Code Enforcement Officers. An NOV was sent to the property owner and a copy to the owner of Ellie Mea’s because CE originally contacted the property owner, as we do on all complaints, and informed him of the violations occurring at Ellie Mea’s. The property owner requested we send him an NOV for the violations at Ellie Mea’s. Code Enforcement will investigate the condition of the garage. 4) The upstairs address at 120 AB have been condemned for safety due to a hole in the ceiling and no power, but there is nothing blocking access to it, so people are coming and going from up there all hours of the night. A complaint was filed regarding the individuals living in the upstairs units and Officer Robinson has addressed the matter with those individuals.
