Code Enforcement Staff has observed the stay, and has specifically not moved forward with its enforcement at 120 Jackson Avenue (Ellie Mae’s). In fact, the Notice of Violation (NOV), originally sent to the property owner, was revised to remove the minimum parking violation in accordance with the City Council stay. There is one violation from the original NOV that remains, which is related to the minimum number of water closets (toilets) that are required by the Florida Building Code for the Ellie Mae location. Due to the occupancy of the building, which is established by the Cape Canaveral Fire Department, there needs to be XX toilets for men and XX toilets for women patrons. Today, there currently exists XX for the men, and XX for the women. This is a shortfall of XX. The second violation that is included in the revised NOV, which is a new violation not included in the original NOV, is related to the modification to the existing stormwater runoff system without a City permit. Based on Staff’s investigation, it appears that a stormwater retention area on the property has been abandoned for purposes of placing additional off-street parking on the site. Regarding the status of the complaints filed by Ms. Schuler, these have been annotated and timely addressed with the property owner and/or other tenant in the building by Code Enforcement and/or the Brevard County Sheriff’s Office. I wanted it to be short and to the point. Council Woman Kellum, As you are aware City Council put a stay on all violations of the minimum parking regulation. Code Enforcement Staff has observed the stay, and has specifically not moved forward with its enforcement at 120 Jackson Avenue (Ellie Mae’s). In fact, the Notice of Violation (NOV), originally sent to the property owner, was revised to remove the minimum parking violation in accordance with the City Council stay. There is one violation from the original NOV that remains, which is related to the minimum number of water closets (toilets) that are required by the Florida Building Code for the Ellie Mae location. Due to the occupancy of the building, which is established by the Cape Canaveral Fire Department, there needs to be XX toilets for men and XX toilets for women patrons. Today, there currently exists XX for the men, and XX for the women.  This is a shortfall of XX. The second violation that is included in the revised NOV, which is a new violation not included in the original NOV, is related to the modification to the existing stormwater runoff system without a City permit. Based on Staff’s investigation, it appears that a stormwater retention area on the property has been abandoned for purposes of placing additional off-street parking on the site.   Regarding the status of the complaints filed by Ms. Schuler, these have been annotated and timely addressed with the property owner and/or other tenant in the building by Code Enforcement and/or the Brevard County Sheriff’s Office. By way of this email, I will ask Officer Robinson to provide you with a list of each complaint received from Ms. Schuler, and its current disposition.   I hope you find this email responsive to your request. I wanted it to be short and to the point.   Council Woman Kellum,   As you are aware City Council put a stay on all violations of the minimum parking regulation. Code Enforcement revised the Notice of Violation originally sent to the property owner to remove the minimum parking violation in accordance with City Council ruling. The violations that still exist and which were included in the Revised Notice of Violation are, minimum water closets that are covered in the Florida Building Code and the disrupting existing stormwater runoff patterns without a permit.   Peg Schaller has filled numerous complaints that have all been annotated and addressed with the property owner by Code Enforcement along with the Sherriff’s Office.
