If that is not possible forward the suspicious mail to phishalert@cityofcapecanaveral.org <mailto:phishalert@cityofcapecanaveral.org> ________________________________ David, When preparing the resolution, please be reminded that Councilwoman Davis asked that Option #3 be available to vote on at the next upcoming meeting. I specifically see no reason why Option #3, where the Lot Split of 1984 and my Lot split request today, could not be available to vote on, and at the same time grant a variance to the 15% as part of the resolution. I maintain that the 15% does not apply to a Lot split, but it only applies to the development of a subdivision, which by definition according to the City's code and Florida Statute is one lot split into 3 or more lots. The ordinance is poorly written on this subject and you're applying it like the tail wagging the dog. The city had plenty of time to amend the code because of what Mr. Pindziak did, and equally as other property owners did, four decades ago. With all due respect, I am now being subjected to inconsistencies within the code that many other property owners were not, specifically 151 E. Central Blvd. At the meeting I stated that there were at least 15 lots that were illegally subdivided and built on without complying with the City's Ordinance for subdividing. The Council and staff, after discussion in tonight's meeting, must now recognize that if any of those residences were to burn down or be damaged by a storm event, that these homes would not be able to obtain a permit to re-build because as the staff explained, there was no evidence that these lots were ever recognized as legally subdivided in the first place. This is a very important subject that must now be shared with those property owners if such an event ever occurred. David, I believe that it was a mistake for the Council to not adopt the ordinance you wrote almost two years ago that would have grandfathered me my two lots as Split in 1984 (prior to your 2010 Lot Split application process), would also have recognized all the 15 other lots as legally split, and subsequently would have denied Mr. Pindziak and further subdividing from that date forward. By not adopting that ordinance, now allows Mr. Pindziak to subdivide what he still owns because he does meet all the criteria to split those original platted lots. Again, I am just asking to be treated fairly as all the other 15 parcel owners, and specifically like the lot split at 151 E. Central Blvd., and to be recognized as two buildable lots as depicted on the Property Appraiser's public records for 38 years.
