So neither one of those have an impact on Ocean Woods. Would the City recommend to the Adjustment Board to not allow any Variances request for the Ocean Woods north and south buffer
zones?

Good afternoon Karen. Todd asked that I prepare a summary of the recent variances that OWHOA may have received notice about. These include:
* DiChristopher Lot Split – Property is located at the intersection of Ridgewood Avenue and E. Central Avenue - The current owner (Mike DiChristopher) purchased the property in July
of 2018 via General Warranty Deed, which listed the two parcels (21.01 and 21.02). When Mr. DiChristopher approached the City regarding the development on the parcels, Staff determined
that the parcels had not been subdivided consistent with City subdivision requirements. Sec. 98-66 of City Code requires that when a parent tract is divided into exactly two or more
parcels, an owner must submit an application for a lot split. According to City records, this did not occur. Staff surmised that a previous owner had created the two parcels by recording
a survey with the Brevard County Clerk of Court. Therefore, Mr. DiChristopher is requesting formal approval of a Lot Split to lawfully create two parcels located at the eastern terminus
of East Central Boulevard, where it connects with Ridgewood Avenue (Parcels #24-37-14-51-9-21.01 and 24-37-14-51-9-21.02). The property is .39 acres and is zoned R-1. Parcel 1 (northern
parcel) would be .21 acres, while Parcel 2 (southern parcel) would be .18 acres.
The Planning and Zoning Board recommended approval of the request at its August 2, 2022 Meeting. The request will be considered by the City Council at its October 18, 2022 Meeting.
* Dean Variance Request – 302 Surf Drive - The owner of 303 E. Central Boulevard is requesting a variance of 3.1 feet from the required 10-foot side yard setback; resulting in a 6.9-foot
setback on the western property line. The variance is to allow the construction of an addition to the existing single-family home.
At its September 22, 2022 Meeting, the City Board of Adjustment denied the request. Should the owner wish to appeal this decision, it will be presented to the City Council for its consideration.

I wanted to touch base with you regarding any Variances that may come up regarding Ocean Woods HOA north and south buffer zones. I have seen a few Variance notices of hearings lately
and wanted to reach out to see if we will ever need to be concerned about a Variance in either of these buffer zones by any neighboring communities? We want to be proactive and mindful
of these zones in respect to the City, our neighbors, and our community.
Please advise us on your thoughts on this matter.
