I disagree that the code is unclear, I disagree that either depth or width meets the requirement of the code. Traditional means nothing, the code does. From this message you are telling
me the city has measurements, which is exactly what I have been waiting to see, for a month. You are not looking at the code, you are looking at the answer the city needs to let this
split happen. You are not looking at the fact the city including you told P and Z and council it meets the code and you can’t show it. I am looking to get answers Tuesday. Do you have
a written position from the “consultant” or the attorney? What question(s) where they asked?

Pat,
I’ll provide my understanding as best I can:
My understanding is that Mr. Allen explained that the traditional way to measure an oddly shaped lot is to apply the length and width measurements to the applicable sides of the lot.
If there is a failure to meet the length and/or width requirement (as can be with irregular lots), then you look to lot area requirement to verify compliance.
In this case, one dimension meets width requirement and one dimension meets length requirement. But that is just two sides. So, because they don’t ALL FOUR meet requirements, you see
if the lot meets the area requirement.
We are questioning this traditional methodology. There is some language in the code that is unclear.
The important takeaway is that we believe the code needs to be clearer about how to do this. It is a worthwhile exercise.

So I can be equally prepared for our meeting, please provide the result of the in-depth review and the specific areas of the code that has been deemed inadequate and what the inadequate
points are. Also provide the comments/concerns from the attorney and consultant. I will expect to see the city evaluation of the split application against the code requirements.

Again, I want to say thank you for raising important questions about the proposed DiChristopher lot split. Your questions triggered an in-depth review and analysis of City Code related
to corner lots.
During this week, Staff has spoken to the City Attorney and Mike Allen, Allen Engineering, who collectively have a great deal of experience in land development and subdivision, and
the general consensus is the current definitions in the Code do not adequately address how to determine corner lot compliance with zoning dimensional requirements.
For this reason, Staff will be bringing an item to the P&Z Board, and ultimately the Council, to address this Code matter. In the meantime, I will be recommending that the DiChristopher
application be postponed for the time being. We will also conduct research into how this has been addressed in the past for similarly situated developed lots as well as best practices
from other cities..
With respect to your email about what questions went to the consulting engineer, they were conveyed via a phone conversation earlier this week. As I recall, I asked about how the lot
depth and width definition in the City Code applied to the proposed lots and whether the proposed lots met minimum City zoning requirements.

I understand the rear yard setback is 25 feet, not 8 feet in R-1.
As I recall, it is a line connecting the 25 foot point on the north and west property lines to help determine how a structure could/would be laid out on the property.
