Citizens will limit their comments to three (3) minutes. The Board will not take any action under the "Public Participation" section of the agenda. CITY OF CAPE CANAVERAL COMMUNITY REDEVELOPMENT AGENCY (CRA) BOARD OCTOBER 18, 2022 SPECIAL MEETING • ITEM # 1 Subject: Discussion: Draft procedures for adding two additional Community Redevelopment Agency (CRA) Board Members. Department: Community and Economic Development Summary: At its June 21, 2022 Regular Meeting, the CRA Board (Board) held a discussion regarding the addition of two residents to the Board. According to the draft Minutes of the Meeting, a consensus was reached to request Staff develop a draft procedure for adding two additional CRA Board Members. According to Florida Statute 163.356, a CRA Board may be between five and nine members, and can be comprised of local government officials and/or other individuals appointed by the Governing Board (i.e. Council). If allowed via Interlocal Agreement, one or more members may be representatives of a taxing authority, to include members of that taxing authority's governing body. Furthermore, members must reside or be engaged in business, which means owning a business, practicing a profession, or performing a service for compensation, or serving as an officer or director of a corporation or other business entity so engaged, within the CRA. To this end, Staff has researched the topic to identify best practices regarding the matter. There are a number of approaches taken. These include: • City of Fort Pierce — has a CRA Board consisting of five City Council Members. There is also a nine member Advisory Board, with each Board Member appointing one Advisory member, and the CRA Board as a whole appointing an additional four members. Advisory Members must be residents of the City, own a business or be a financial executive of a business within the CRA. • City of Winter Garden — has a CRA Board consisting of the City Council and an Orange County Commission member. There is also a nine member Advisory Board and a representative from Orange County made up of City and CRA residents or business owners appointed by the City Commission. • City of Cocoa — has a CRA Board consisting of five City Council Members and two additional members who reside or are engaged in business in the corporate limits of the City. The two additional members are selected by the Council through application. • City of Cocoa Beach — has a CRA Board consisting of five City Council Members. • City of Satellite Beach — has a CRA Board consisting of five City Council Members. • Merritt Island Redevelopment Agency — has a CRA Board consisting of seven members. Members are appointed by the County Commission and must reside or be engaged in business within the CRA. • City of Titusville — has a CRA Board consisting of the City Council and two additional members who reside or engage in business in the corporate limits of the City. The two additional members are selected by the Council through application. Based on the reviewed information, the communities mentioned above do not have additional selection criteria above that which is required by Florida Statute. Surveyed communities do require City of Cape Canaveral CRA Board Special Meeting • October 18, 2022 Agenda Item # 1_ Page 2 of 2 applicants to complete a board application, which is reviewed by the governing body as part of the decision -making process. The City Code establishes the following criteria for volunteering on ANY City board: • Complete a board or committee application as prescribed by the City Council; • Consent to a standard criminal background check, at the discretion of the City Council; • Be a resident and registered voter, or business owner, as defined by this section unless the City Council by unanimous vote waives this requirement upon a determination that a vacancy on a board or committee must be filled by a person with specialized skills and training and a resident and registered voter, or a business owner, with such skills and training cannot be reasonably found to fill the vacancy. If said requirement is waived, the vacancy shall only be filled by a person who is a resident of the city or who owns a business or real property within the city; • Have never been convicted or found guilty, regardless of adjudication, of a felony in any jurisdiction, unless their civil rights have been restored. Any plea of nolo contendere shall be considered a conviction for purposes of this paragraph; and • Complete interviews with the board or committee on which the person is seeking appointment and with the City Council. Possible additional criteria that the Council may consider for membership on the CRA Board include: 1. Reside within the CRA area; or 2. Own or are an executive of a business within the CRA area; and 3. Demonstrate a working knowledge of business development and/or housing initiatives. This item was placed on the Agenda for the September 21, 2022 CRA Board Regular Meeting, but due to time constraints, the CRA Board reached consensus to bring this item back for discussion at this Meeting. ROLL CALL: Board Members Present: Chairperson Wes Morrison, Vice -Chair Mickie Kellum, Kim Davis, Angela Raymond and Don Willis. PUBLIC PARTICIPATION: None. NEW BUSINESS: 1. Approve Minutes for Cape Canaveral CRA Board Regular Meeting of June 21, 2022: A motion was made by Board Member Willis, seconded by Board Member Davis, to approve the CRA minutes. The motion carried 5-0. 2. Approve FY 2022/23 City of Cape Canaveral Community Redevelopment Agency (CRA) Board Meeting Schedule and Financial Reporting Requirements: CRA Registered Agent Morley confirmed this is a routine, annual Item. Discussion ensued regarding desire to add a meeting in October to discuss the Affordable Housing letter to the Cape Canaveral CRA from Brevard County Board of Commissioners Chairperson Christine Zonka, updating the CRA Plan, and how to use the $50K allocated for the sign grant program. A motion was made by Vice -Chair Kellum, seconded by Board Member Willis, for the CRA Board to meet at 4:00 p.m., October 18, 2022. Discussion ensued regarding the need to discuss components of the CRA Budget prior to adopting the CRA Budget and before October 1, 2022, there not being enough time to discuss the issues mentioned, availability for an extra CRA Meeting, discussion of expanding the suite of CRA loans and grant programs, scheduling the meeting for October 18, 2022 prior to the Regular City Council Meeting. The motion carried 5-0. A motion was made by Board Member Raymond, seconded by Board Member Willis, to approve the CRA Board Meeting Schedule and Financial Reporting Requirements, as written. The motion carried 5-0. City of Cape Canaveral, Florida CRA Regular Board Meeting September 21, 2022 Minutes • Page 2 of 2 3. Resolution No. CRA-10; adopting a budget for the City of Cape Canaveral Community Redevelopment Agency (CRA) for FY 2022/23; providing for the repeal of prior inconsistent resolutions, severability and an effective date: Discussion ensued and included support for and against removing the Civic Hub Project, how removing the Civic Hub will not save money in the CRA Budget, praise for stormwater projects and efforts of Staff to alleviate flooding problems. CRA Registered Agent Morley explained the purpose of purchasing the property to begin the Civic Hub Project, which is much larger than the vacant lot, and could be used for a few acres of exfiltration. Discussion ensued and included putting off the Civic Hub Project until next year or just do the design, the importance of the Center Street with regard to stormwater, and desire for citizen input regarding use and design of the Civic Hub Project. Assistant City Attorney Eick read the title into the record. Discussion continued regarding the process of approving the CRA Budget prior to the City Budget. A motion was made by Board Member Raymond, seconded by Board Member Davis, to approve Resolution No. CRA-10. The motion carried 3-2, with Chairperson Morrison and Vice -Chair Kellum voting against. 4. Discussion: Brevard County Board of County Commissioners Ratified Letter from Chairperson Kristine Zonka: CRA Registered Agent Morley explained the Item and requested the Board provide comment regarding the draft letter in response to Brevard County. Discussion ensued and included the County's plan regarding use of American Rescue Plan Act funds, an affordable housing project in the City of Cocoa, the need for clarification from the County, and the deadline of October 18, 2022 to respond back. The Board reached unanimous consensus to approve CRA Registered Agent Morley's Draft Response letter as written. 5. Discussion: Draft procedures for adding two additional Community Redevelopment Agency (CRA) Board Members: Vice -Chair Kellum explained the Item. The Board reached consensus to bring the Item back in October for additional discussion. ADJOURNMENT: There being no further business, Chairperson Morrison adjourned the meeting at 6:00 p.m. Wes Morrison, Chairperson Mia Goforth, CRA Clerk/Recording Secretary CITY OF CAPE CANAVERAL COMMUNITY REDEVELOPMENT AGENCY (CRA) BOARD OCTOBER 18, 2022 SPECIAL MEETING • ITEM # 3 Subject: Discussion regarding the update of the 2012 Community Redevelopment Plan. Department: CRA Board Summary: The City of Cape Canaveral Community Redevelopment Agency (CRA) was established on August 21, 2012 with the adoption of Resolution No. 2012-16. The CRA was created pursuant to Part III, Chapter 163, and Florida Statutes and is considered a dependent Special District under Chapter 189 F.S. As part of the creation of the CRA, The City of Cape Canaveral Community Redevelopment Plan (CRP) was prepared which includes goals for redevelopment in the area and also lists strategies, programs and projects to implement the identified goals. The CRP was adopted in 2012 and was based on data and community input at that time. As stated in the CRP "Redevelopment is an ongoing, iterative process that can take decades to achieve. It is the City's intent to regularly revisit this document, perhaps as part of the CRA's annual reporting process, in order to celebrate the City's achievements and refocus priorities for the coming years." It goes on to state: "This initial CRP is focused on the short term in order to prioritize activities and to guide the CRA in its initial actions." (see pg. 11) Much has changed in the City since the CRP's adoption in 2012. A drive along Astronaut Boulevard will bear this out. Furthermore, in the intervening 10 years, there has been new policy direction from the Council. For example, the City's adoption of the Resilient Cape Canaveral Report in 2019 and the Resilient Cape Canaveral Action Plan in 2021 have certainly provided new direction on City priorities and spending. This item is to provide an opportunity for the CRA Board to discuss the need to update the CRP so that it is in alignment with current Council policy and to ensure that it reflects today's community priorities and aspirations.
