MINUTES
CALL TO ORDER: The Chair called the Meeting to Order at 5:00 p.m. Vice -Chair Kellum led the
Pledge of Allegiance.
ROLL CALL:

NEW BUSINESS:
1. Approve Minutes for Cape Canaveral CRA Board Regular Meeting of November 16, 2021:
A motion was made by Board Member Raymond, seconded by Board Member Willis, to
approve the CRA minutes. The motion carried 5-0.
2. Approve the FY 2021/22 CRA Board Meeting Schedule, as amended: Discussion ensued
regarding the CRA Board's ability to amend its own Meeting Schedule, and the Brevard County
Commission's current Schedule which conflicts with the City's Budget Hearing dates approved by
Council. A motion was made by Board Member Willis, seconded by Board Member Davis, to
adopt the calendar as presented. The motion carried 5-0.
3. Discussion on adding Two Residents to the CRA Board. (Submitted by Vice -Chair
Kellum): Vice -Chair Kellum explained the Item. Discussion ensued and included pros and cons of
the initiative, citizen engagement, participation on volunteer advisory boards, partisanship,
accountability, and desire to keep the number of CRA Board Members, as -is. CRA Board Attorney
Garganese confirmed that, although Board Members are not required to take State Ethics Training,
they are generally subject to the rules, and the City could adopt certain ethical standards which
require training. CRA Director Dickey discussed challenges of maintaining full City Board
membership and obtaining quorums at meetings. Discussion continued regarding the City

Council's original intent of allowing two additional members for appointment to the CRA Board,
statutory driven requirements for appointed members to the CRA Board, support for fully
developed criteria and process before moving forward with the idea, and support for waiting to
move forward until after the Election. A consensus was reached by three CRA Board Members in
favor of Staff developing a draft procedure for adding two additional CRA Board Members for
consideration at the September 21, 2022 CRA Board Meeting.
4. Discussion to review, update and fund the financial incentives developed in 2018.
(Submitted by Vice -Chair Kellum): Vice -Chair Kellum explained the Item and stated the desire to
help residents and business owners. Discussion ensued and included hiring staff for the
Community Redevelopment Agency (CRA) or paying current City Staff out of the CRA to
implement plans. CRA Attorney Garganese discussed the City of Cocoa's allocation of time and
salary for staff members working under their CRAs. Discussion continued regarding CRA functions
such as owning and leasing land, the Comprehensive Plan, Five-year CRA Plan review, growth of
CRA funds now and in the future, desire for more CRA Board Meetings, using CRA funds for
business and resident incentives including the Small Business Sign Assistance Program, facade
improvements, landscaping, painting and commercial improvement grants, reasons CRA funds
should go toward actual project costs at this time, the Brevard County Commission's past
perspective on choosing winners and losers with regard to incentive programs, and revising the
2012 CRA Plan. CRA Director Dickey discussed elimination of commercial corridor blight being
the most cost beneficial use of CRA funds versus reliance on Code Enforcement. Board Member
Raymond indicated support for Item 5.
5. CRA Incentive Grants Information and Advertising Budget. (Submitted by Vice -Chair
Kellum): Chairperson Morrison indicated that due to the hour, the City Council Meeting needs to
start.
ADJOURNMENT: There being no further business, Chairperson Morrison adjourned the meeting

Subject: Approve FY 2022/23 City of Cape Canaveral Community Redevelopment Agency (CRA)
Board Meeting Schedule and Financial Reporting Requirements.
Department: Community and Economic Development
Summary: The City of Cape Canaveral CRA is required to comply with the following dates each
year:
1. Approve Annual CRA Budget (due October 1' of each year).
2. File Annual Report (due March 31' of each year).
3. File Annual CRA Financial Audit (due March 31' of each year).
Additionally, the CRA Board will need to meet as necessary for other CRA items. To reasonably
accomplish these goals, Staff recommends the CRA Board adopt and reserve the following meeting
schedule for the upcoming FY 2022/23:
• The third Tuesday of November (November 15 th at 5:00 p.m.);
• The third Tuesday of March (March 21st at 5:00 p.m.);
• The third Tuesday of June (June 20 th at 5:00 p.m.); and
• The third Tuesday of September (September 19th at 5:00 p.m.).
In the case where a meeting date is scheduled and there is no business for the CRA Board to
consider, no meeting will be held, and a Cancellation Notice will be distributed.

Redevelopment Agency (CRA) for FY 2022/23; providing for the repeal of prior inconsistent

Summary: The CRA was established August 21, 2012 with the adoption of Resolution No. 2012-16.
The CRA was created pursuant to Part III, Chapter 163, and Florida Statutes and is considered a
dependent Special District under Chapter 189 F.S. As a Special District, the CRA Board is required
to adopt a budget for each fiscal year by resolution.
The CRA Budget has been revised based on additional information received from the Brevard
County Property Appraiser.
The City's Annual Budget includes the CRA Budget, which details the revenues and anticipated
expenditures of the Special District. The projected revenue for the CRA for FY 2022/23 is $2,532,594
which includes line items of $1,141,153 of ad valorem revenue from both the City and Brevard
County and a $250,000 transfer from the General Fund.
Notable expenses include $1,315,000 in capital outlay which includes $912,000 for capital initiatives,
$80,000 for mobility/sidewalk construction, and $50,000 for grant programs. In addition, $867,720
is earmarked for debt service.
Resolution No. CRA-10 (Attached) has been prepared to adopt the proposed CRA FY 2022/23
Budget, which will take effect October 1, 2022 to run through September 30, 2023.

A RESOLUTION OF THE CITY OF CAPE CANAVERAL COMMUNITY
REDEVELOPMENT AGENCY; ADOPTING A BUDGET FOR THE
CAPE CANAVERAL COMMUNITY REDEVELOPMENT AGENCY
FOR FISCAL YEAR 2022/23; PROVIDING FOR THE REPEAL OF
PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Cape Canaveral, Florida adopted Resolution No.
2012-16, creating the City of Cape Canaveral Community Redevelopment Agency ("CRA"),
pursuant to Part III, Chapter 163, Florida Statutes; and
WHEREAS, the CRA is a dependent special district under Chapter 189, Florida Statutes,
known as the Uniform Special District Accountability Act of 1989 ("Act"); and
WHEREAS, the Act requires all special districts, including dependent special districts such
as the CRA, to adopt a budget for each fiscal year by resolution; and
WHEREAS, the CRA desires to comply with the requirements of the Act and takes this
action in order to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD MEMBERS OF THE CAPE
CANAVERAL COMMUNITY REDEVELOPMENT AGENCY, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are deemed true and correct and are hereby fully
incorporated herein by this reference and are deemed a material part of this Resolution.
Section 2. Adoption of Budget.The Board Members of the City of Cape Canaveral
Community Redevelopment Agency do hereby approve and adopt a budget attached hereto as
Exhibit "A" for Fiscal Year 2022/23; beginning October 1, 2022 and ending September 30, 2023.
Section 3. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of
resolutions in conflict herewith are hereby repealed to the extent of the conflict.
Section 4. Severability. If any section, subsection, sentence, clause, phrase or portion of this
resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent provision and such holding
shall not affect the validity of the remaining portion hereto.

Cape Canaveral Community Redevelopment Agency
The Community Redevelopment Plan was developed in FY12-13. The Projects in the Plan are funded with TIF revenues deposited in the Trust Fund to encourage
development/redevelopment; financial incentives to developers; businesses; and financing of capital improvement projects.
In the summer of 2015, the City completed the regional Lift Station Project which included easement and waterline extension work located within the CRA partially funded
by the Wastewater Fund. The CRA Board approved the repayment of $470,000 to the Wastewater Fund at its September 2015 meeting. The first payment was made January
31st, 2016 and subsequent installments are due each year thereafter on January 31st until the loan is paid in full. The annual interest rate is set at 2%
In July of 2017, the City acquired another Capital Note to finance the redevelopment of Canaveral City Park and the Cape Canaveral Cultural Arts Preservation En
(CAPE) Center. This $6.2 million Revenue Note with an interest rate of 2.05% for ten years will be repaid by the CRA. In October 2021, the City acquired a Capital No
finance the redevelopment of the Civic Hub. This 1.2 million revenue note was issued at an interest rate of 1.61% for ten years and will be repaid by the CRA.

Subject: Discussion: Brevard County Board of County Commissioners Ratified Letter from Chair
Kristine Zonka.
Department: Community and Economic Development
Summary: In a ratified letter dated August 18, 2022, Brevard County Chair Kristine Zonka requests
the City Community Redevelopment Agency (CRA) take affirmative actions regarding the provision
of affordable housing (Attachment 1).
Chair Zonka points out that The Shimberg Center for Housing Studies reports that one out of five
individuals making less than 60% of the area median income cannot find affordable housing. And,
that this amounts to a deficit of 8,936 housing units in Brevard County.
Specifically, it is requested that the CRA invest resources into affordable housing and that the City's
CRA Plan be amended to reflect this issue as a priority. The letter states that the City should forward
requested Plan amendments to the County in the next 60 days.
Staff has prepared a response (Attachment 2), which is being presented to the CRA Board for its
review. Should the Board have any comments or proposed revisions, please be prepared to provide
those to Staff.

The Board of County Commissioners is concerned with and prioritizing the affordable housing
crisis plaguing our county. Community Redevelopment Agencies were created under F.S. 163 Part III
for the purpose of addressing "slum and blighted areas." F.S. 163.360 provides "for the development
of affordable housing in the area." Unfortunately, according to your plans and expenditures, it appears
this has not been the focus.
The Shimberg Center for Housing Studies determined that more than one out of five
individuals making less than 60% of the area median income cannot find affordable housing. This
amounts to a deficit of 8,396 housing units in Brevard County.
The intent behind your creation is clear in that community redevelopment agencies should
provide an actual and tangible benefit to the community. While Florida Statute allows for other lawful
expenditures, this Board strongly urges you to invest our resources into affordable housing.
We would encourage you to consider this community crisis and make this funding part of your
scope. We look forward to evaluating the changes to your plan within the next 60 days.

SUBJECT: Affordable Housing
Dear Chair Zonka:
The Cape Canaveral Community Redevelopment Agency (CRA) is in receipt of your letter dated
August 18, 2022 regarding affordable housing. The CRA concurs with the importance placed upon
this critical infrastructure, and the priority of providing safe, decent housing for all its residents.
The City's adopted CRA Plan and associated annual expenditures indicate a clear record of its
focus on redevelopment activity consistent with F.S. Chapter 163, and the 2019 Interlocal with
Brevard County.
Note that the City's CRA Plan is clear that the CRA must "Provide for the development of affordable
housing in the area" (see page 12). To this end, the CRA Plan establishes a number of Strategies,
Programs and Projects that address affordable housing, to include:
• The creation of a loan pool with local banks to provide low -interest loans for projects that
have funding requirements beyond the capacity of existing programs.
• Waivers of up -front costs and/or relaxing site requirements for new development.
Examples include waiver of parking requirements, and permit/impact/utility connection
fees. The Plan also calls for the City to work with Brevard County to determine those
circumstances where County impact fees can be reduced.
• Assist with funding rehabilitation and repurposing of existing structures through grants
and loans.
• Assist with funding of site preparation such as demolition of obsolete structures to
increase its marketability.
• Assembly of smaller, nonconforming properties to be aggregated into larger parcel to
accommodate new residential development.
Furthermore, the City's Comprehensive Plan, states that the City shall "Assure that existing and
future residents of the City of Cape Canaveral have access to safe and sanitary housing at an
affordable price" (see page 39). It goes on to state that "The City shall identify and implement
measures which facilitate the provision of additional decent, safe, and sanitary affordable housing
in the community to address the unmet housing needs of the lower -income segment of the
population..." (see page 39).
However, as you indicate in your letter, priorities change and organizations must be responsive.
To this end, Agency Staff is surveying other communities, to determine best practices with respect
to the provision of affordable housing. If the County is aware of any programs/practices, or has
itself implemented an exemplary program(s), please forward this information.
Agency Staff participated in a webinar sponsored by the Florida Redevelopment Agency on

Subject: Discussion: Draft procedures for adding two additional Community Redevelopment
Agency (CRA) Board Members.

Summary: At its June 21, 2022 Regular Meeting, the CRA Board (Board) held a discussion regarding
the addition of two residents to the Board. According to the draft Minutes of the Meeting, a
consensus was reached by three of the Board Members to request Staff to develop a draft
procedure for adding two additional CRA Board Members.
According to Florida Statute 163.356, a CRA Board may be between five and nine members, and
can be comprised of local government officials and/or other individuals appointed by the
Governing Board (i.e. Council). If allowed via Interlocal Agreement, one or more members may be
representatives of a taxing authority, to include members of that taxing authority's governing body.
Furthermore, members must reside or be engaged in business, which means owning a business,
practicing a profession, or performing a service for compensation, or serving as an officer or director
of a corporation or other business entity so engaged, within the CRA.
To this end, Staff has researched the topic to identify best practices regarding the matter. There are
a number of approaches taken. These include:
• City of Fort Pierce — has a CRA Board consisting of five City Council Members. There is also
a nine member Advisory Board, with each Board Member appointing one Advisory
member, and the CRA Board as a whole appointing an additional four members. Advisory
Members must be residents of the City, own a business or be a financial executive of a
business within the CRA.
• City of Winter Garden — has a CRA Board consisting of the City Council and an Orange
County Commission member. There is also a nine member Advisory Board and a
representative from Orange County made up of City and CRA residents or business owners
appointed by the City Commission.
• City of Cocoa — has a CRA Board consisting of five City Council Members and two additional
members who reside or are engaged in business in the corporate limits of the City. The two
additional members are selected by the Council through application.
• City of Cocoa Beach — has a CRA Board consisting of five City Council Members.
• City of Satellite Beach — has a CRA Board consisting of five City Council Members.
• Merritt Island Redevelopment Agency — has a CRA Board consisting of seven members.
Members are appointed by the County Commission and must reside or be engaged in
business within the CRA.
• City of Titusville — has a CRA Board consisting of the City Council and two additional
members who reside or engage in business in the corporate limits of the City. The two
additional members are selected by the Council through application.
Based on the reviewed information, the communities mentioned above do not have additional
selection criteria above that which is required by Florida Statute. Surveyed communities do require

applicants to complete a board application, which is reviewed by the governing body as part of the
decision -making process.
The City Code establishes the following criteria for volunteering on ANY City board:
• Complete a board or committee application as prescribed by the City Council;
• Consent to a standard criminal background check, at the discretion of the City Council;
• Be a resident and registered voter, or business owner, as defined by this section unless the
City Council by unanimous vote waives this requirement upon a determination that a
vacancy on a board or committee must be filled by a person with specialized skills and
training and a resident and registered voter, or a business owner, with such skills and
training cannot be reasonably found to fill the vacancy. If said requirement is waived, the
vacancy shall only be filled by a person who is a resident of the city or who owns a business
or real property within the city;
• Have never been convicted or found guilty, regardless of adjudication, of a felony in any
jurisdiction, unless their civil rights have been restored. Any plea of nolo contendere shall
be considered a conviction for purposes of this paragraph; and
• Complete interviews with the board or committee on which the person is seeking
appointment and with the City Council.
Possible additional criteria that the Council may consider for membership on the CRA Board include:
1. Reside within the CRA area; or
2. Own or are an executive of a business within the CRA area; and
3. Demonstrate a working knowledge of business development and/or housing initiatives.
