I am in receipt of the appraisal for property located at 116 Jefferson Avenue in Cape Canaveral. The existing townhome at the property is considered a legal, nonconforming structure
as it is zoned C-1, which zoning does not allow for residential uses.
I understand this is causing a problem with underwriting for a new VA loan. It is important to note the City is in the process of administratively rezoning this parcel to R-2, which
will result in the property becoming legally conforming. This is important because if the structure were destroyed, it could be legally rebuilt. This rezoning process is scheduled to
be complete in February of 2021.
Also, the City Code includes a provision (Sec. 110-200) for the continuation of nonconforming residential buildings through the issuance of a Special Permit by the City Council. In this
case, should the structure be damaged or destroyed, the City Council could authorize its continued use under this Code section.
The point being is that there are several paths available for this property to be rebuilt should it be destroyed; one of which will be finalized in several months.
