PLAE10 • C001 0N! • EANOICAre AJWTE4E0T0 AD N0. eo.04 DATE: 01-05-00 rArROA00121.0. nsvc)JNY:.amc June 18, 2001 To: Board Members City of Cape Canaveral Community Appearance Board As residents of Ocean Oaks Condominiums, we are concerned about Royal Mansion's proposal to build a maintenance storage building on the northwest comer of their property at 8600 Ridgewood Avenue. This proposed site would be within 25 feet of our balconies, and based upon our prior experience with the management of Royal Mansions, we believe it would create many problems. The proposed site for this maintenance building would be adjacent to an existing trash container building. For the past 5 years, Ocean Oaks residents have had to look at broken awnings, discarded air conditioning units, refrigerators, lumber, and bags of trash that have been placed behind and around the trash container building for weeks, and sometimes even months. We have noticed rodents near this trash storage facility when the above mentioned garbage has been left around this building. We are concerned that the proposed maintenance storage building would create another place for Royal Mansions to "hide" their trash behind out of sight of their tenants, but in total view of Ocean Oaks residents. The most recent eyesore on the proposed building site was a commercial storage container (please see attachments # 1 and #2) that was placed there in November, 2000. The management of Royal Mansions told Ocean Oaks residents that this container would be there only temporarily, and that it probably would be removed by January, 2001. After several months went by and the container had not been removed, several residents tried to contact the manager. He was non -cooperative and condescending and told one resident that he would remove the storage container when he "was ready to". The container was not removed until April 23, 2001, after several "courtesy notices" and finally a Notice of Violation was sent by the Code Enforcement Officer of the City of Cape Canaveral. (Please see attachment #3). Meanwhile, Royal Mansions has on the south side of their property a large area (approximately 200' x 200') that could easily accommodate the proposed maintenance building as well as trash facilities. If the maintenance building was built on the southeast corner of their property, it would be located approximately 150 feet away from the nearest condominium ( Canaveral Sands ), and an elevated beach access walkway between Canaveral Sands and Royal Mansions would cut off most of the view of the proposed maintenance building from the residents of that condominium. In conclusion, we want you , the Board Members, to understand that Ocean Oaks is our home and that we take pride in our property. Florida 32920 Attention: Code Enforcement Department To Whom It May Concern Re: Royal Mansions For the past five years, we who live in the six south west corner and adjacent condominiums have had to look at expired airconditioncrs, refrigerators, awnings. lumber stored behind the Royal Mansion's storage units. During peak times excess garbage bags that fill the back of a half ton truck are also - piled up, usually on the weekends. The attached pictures give some idea however to the naked eye. everything is much larger. Three years ago we personally asked Mr. Silkcy. the owner of Royal Mansions, if the oleander plantings along the south side could be extended to the back of the storage buildings. He was not willing to do that however gave us his permission to as it was on his side of the property line. The bushes were put in at our personal expense and they have been somewhat effective, some of the time. In November the container filled with Christmas decorations was dropped directly below us, and while the decorations brought a "Beautification Award" to the Royal Mansions, it has been a terrible eyesore to us and we counted the days for its removal. Approximately three weeks ago we approached Mr. Silkey regarding the container and the old unuseable lumber ctc. His reply was, when he secured a space elsewhere. We are now into February and it still remains. Surely there are by-laws in Cape Canaveral to protect neighbours from unsightly obstructions and garbage. This is our home at Ocean Oaks. we have been patient over the years, however the impact of how Royal Mansions totally disregard the feelings and well being of their neighbours to the north is difficult to understand. This letter is a follow-up to the telephone conversation between my wife, Arlene Underwood, and yourself on March 16, 2001. My wife called you with a very legitimate question as to when you would be moving the storage trailer located at the north-west corner of your property. The trailer has been an eyesore since it was placed there in November. and can clearly be seen from inside our living/dining room as well as from our balcony. Instead of responding to my wife in a reasonable manner. you became condescending and told her that you'd be moving the trailer when you were ready to. Well, that's not good enough. We feel that we have been good neighbors to Royal Mansions and don't create any eyesores for your guests, nor do we call the local police when your guests have loud parties, shoot off fireworks in the parking area. or screech their tires and, in general, create a nuisance. I think that you need to realize that Ocean Oaks Condominiums is our home, and that every resident here takes pride in their property and the surrounding area. We do not intend to sit by and let an uncaring neighbor do things that are going to take away from the value of our property. I guess we have no choice at this time but to take this matter to the City of Cape Canaveral to have it resolved, but I feel that it would be to your advantage to try to resolve future problems with your neighbors in an amicable way rather than create animosity as you have in this situation. Our problem is an unsightly storage container brought in with Christmas decorations last year. While the Royal Mansions won the Beautification Award, we homeowners have had to endure this eyesore from November 2000 to the present day, March 19, 2001. Mr. Silky of Royal Mansions assured us the container was going to be removed as soon as an off site storage space was available - we are still waiting. Surely there must be a bylaw in place to prevent unsightly industrial storage containers being placed adjacent to residential condominiums. The attached photographs are self explanatory. When I receive an opening for a rental unit to store items in the container, 1 will then move it. I spoke with your wife 3 or 4 times on this subject. Let's discuss being an uncaring neighbor! 1. Painted the back side of pole lights black to keep the light from shining into your units. 2. For years allowing trucks to enter the North side of the parking lot and grass area to trim your trees. 3. Allowing trees to be cut in Royal Mansions Resort area so that Ocean Oaks owners could get a clearer view of the Ocean. 4. Replaced a section of fencing that was destroyed by your tree trimming crew. 5. Let Ocean Oaks cars park in our area when they were painting your parking area. Being a good neighbor. ...let's discuss the time I asked your Board to allow my guests, no more than 10 at a given time, to use your pool during a two day period 10AM to 4PM. We are most appreciative of the fact that you painted the lights that were shining into our bedrooms. 2. The trees that are located on the North Side of the parking lot belong to Royal Mansions' property (palm trees.) 3. The cutting of the trees so that our residents on the South Side could have a better view of the ocean was appreciated. 4. I am not aware of the broken fence that Royal Mansions replaced. Thank you for bringing that information to our attention. 5, Our parking area is concrete which does not require painting as maintenance. In an attempt to be neighborly, we continue to allow your guests or members as well as their friends to use our pool and facilities. The Board of Directors of 1996 did not refuse your guests access to our pool at Ocean Oaks. Our condo owners expressed their concerns that they did not wish to have other guests using their facilities. In order to accommodate our owners' wishes, we met their demands. As far as your concern about the visibility of the container, please call Steve Testa at 321-868- 2663 and he will be happy to let you tour my home to verify that it is visible from my dining room and living room. In closing, Mr. Silkey, I would like to cooperate with you on behalf of the twenty families located on the South Side of Ocean Oaks. Our wish is the same as yours, to be neighborly.
