NOTICE OF PUBLIC HEARING
CITY OF CAPE CANAVERAL
The City Council of the City of Cape Can-
averal, Florida will hold a Public Hearing
for the purpose of discussing Ordinance
Nos. 37-2021 and 39-2021 in the Cape
Canaveral City- Hall -Council Chambers,
100 Polk Avenue, Cape Canaveral, Flori-
da at 6:00 p.m., Tuesday, October 19,
2021. The Ordinances may be inspected
in their entirety in the City Clerk's Office
during business hours (8:30 a.m. to 5:00
p.m., Monday -Friday). Interested parties
may appear at the meeting and be
heard with respect to the proposed Or-
dinances.
ORDINANCE N0.37-2021
An Ordinance of the City of Cape Canav-
eral, Florida; amending the definition of
a City Park set forth in Section 54.1 of
the City Code, providing for the repeal
of prior inconsistent ordinances and res-
olutions, incorporation into the code,
severability and an effective date.
ORDINANCE NO. 34.2021
An Ordinance of the City of Cape Canav-
eral, Florida; adopted in furtherance of
the requirement set forth in Section
2.12(5), Cape Canaveral Charter; author-
izing the issuance of not exceeding
$1,200,000 Capital Improvement Reve-
nue Note, Series 2021, of the City to fi-
nance the cost of the purchase of the
Promenade and related capital improve-
ments and Cost of Issuance; providing
for the Series 2021 Note to be secured
by the City's Public Service Tax, Half -Cent
Sales Tax. Guaranteed Entitlement Com-
munications Services Tax and certain
Franchise Fees; authorizing the City's fi-
nancing team to proceed to develop
necessary documents; providing for the
repeal of prior inconsistent ordinances
and resolutions or parts of prior inconsis-
tent ordinances and resolutions in con-
flict herewith, severability and an effec-
tive date.
The City Council reserves the right to
continue or postpone hearings to a date
certain without re -advertising. Pursuant
to Section 286.0105, Florida Statutes, the
City hereby advises the public that: If a
person decides to appeal any decision
made by the City Council with respect to
any matter considered at this meeting,
that person will need a record of the
proceedings, and for such purpose that
person may need to ensure that a verba-
tim record of the proceedings is made,
which record includes the testimony and
evidence upon which the appeal is to be
based. This notice does not constitute
consent by the City for the introduction
or admission into evidence of otherwise
inadmissible or irrelevant evidence, nor
does it authorize challenges or appeals
not otherwise allowed by law. In accord-
ance with the Americans with Disabili-
ties Act: all interested parties may at-
tend this Public Meeting. The facility is
accessible to the physically handicapped.
