ORDINANCE NO. 19-87
AN ORDINANCE AMENDING CHAPTER 721,
"OCCUPATIONAL LICENSES" , OF THE CODE OF
ORDINANCES OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA, BY
REPEALING THE CHAPTER IN ITS ENTIRETY;
ADOPTING A NEW CHAPTER; ESTABLISHING A
NEW FEE SCHEDULE; REPEALING ALL PORTIONS
OF THE CODE IN CONFLICT HEREWITH;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the City Council of the City of Cape
Canaveral, Brevard County, Florida, as follows:
SECTION 1. Chapter 721, "Occupational Licenses" , of the Code
of Ordinances is hereby repealed in its entirety and replaced with
the following:
CHAPTER 721
OCCUPATIONAL LICENSES
Sec. 721. 01 Definitions. As used in this chapter
the terms that follow shall have the following meanings
respectively ascribed to them unless the context re-
quires otherwise:
Business Profession and Occupation do not include
the customary religious, charitable, or educational
activities of nonprofit religious, nonprofit charit-
able, and nonprofit educational institutions in this
State, which institutions are more particularly defined
and limited as follows:
A. Religious Institutions shall mean churches and
ecclesiastical or denominational organizations or estab-
lished physical places for worship in this State at
which nonprofit religious services and activities are
regularly conducted and carried on, and shall also mean
church cemeteries.
B. Educational Institutions shall mean State tax-
supported or parochial, church and non-profit schools,
colleges, or universities conducting regular classes
and courses of study required for accreditation by or
membership in the Southern Association of Colleges and
Secondary Schools, the Department of Education or the
Florida Council of Independent Schools. Nonprofit
libraries, art galleries, and museums open to the
public are defined as educational institutions and
eligible for exemption.
C. Charitable Institutions shall mean only non-
profit corporations operating physical facilities in
this State at which are provided charitable services, a
reasonable percentage of which shall be without cost to
those unable to pay.
Contractor shall mean any person accepting or offer-
ing to accept orders of contracts for doing any work on
or in any building or structure requiring the use of
building materials or accepting or offering to accept
orders or contracts to do any paving or curbing on side-
walks or streets, public or private property, requiring

the use of appropriate material or any composition; or
accepting or offering to accept orders or contracts to
excavate earth, rock or material for foundations or any
other purpose; or accepting or offering to accept
orders or contracts to construct any sewer of approp-
riate material or other material; or accepting or offer-
ing to accept orders or contracts for building, remodel-
ing, repairing, wrecking, razing or demolishing any
structure; or for moving any building, or for the
installation, maintenance or repair of neon signs, air
conditioning apparatus or equipment; whether such work
is done or offered to be done by day labor; general
contract or subcontract. Every person engaging in the
business of accepting or offering to accept orders for
contracts for doing any work on or in any building or
premises involving erecting, installing, altering,
repairing, servicing, or maintaining electric wiring,
devices or appliances permanently connected to such
wiring, or the erecting, repairing, or maintaining of
lines, shall be deemed to be an electrical contractor.
Every person engaged in the business of plumber or
steamfitter shall be deemed to be a contractor. Every
person engaged in the business of erecting a building
or buildings for the purpose of selling or renting the
same, and making no contract with a duly licensed con-
tractor for the erection of said buildings or building,
whether or not such person contracts with one or more
duly licensed contractors for one or more portions but
does not contract with any one person for all the work
of erecting any one of said buildings, shall be deemed
to be a contractor if he shall build more than one
house in any one year.
Employee shall mean any person who engages in any
business, profession or occupation under any appoint-
ment, agency, contract of hire, or apprenticeship ex-
press or implied, oral or written.
Inventory shall mean and include those chattels
consisting of items commonly referred to as goods,
wares and merchandise (as well as inventory) which are
held for sale, rental, or lease to others in the
ordinary course of business.
Merchandise shall mean any goods, wares or
commodities bought or sold in the usual course of
trade, wholesale or retail, including necessities,
provisions, and articles for immediate consumption.
Merchant shall mean any person engaged in the
business of selling merchandise at retail or wholesale,
including merchandise agencies, merchandise brokers,
dealers, distributors, jobbers, buying clubs, and all
others whose business includes the sale of merchandise
except a manufacturer or processor who creates or fabri-
cates an entirely new or different product or articles
of inventory, and those businesses which pay an ad-
ditional occupational license tax based upon the number
of employees or floor space in a particular classifi-
cation. Vendors of food or flour, bottling works, pro-
cessors of bakery and dairy products, stone works,
planers or shapers of lumber and other persons who do
not create a new or entirely new or different article
shall be deemed merchants for the purpose of this
chapter.
Merchant Retail shall mean any merchant who sells to
the consumer for any purpose other than resale.

Merchant Wholesale shall mean any merchant who sells
to another for the purpose of resale. Sales to govern-
mental entities shall be considered wholesale sales.
Number of Employees shall mean in those instances in
this chapter wherein the license tax is based upon
"number of employees" it shall mean the average daily
number of employees during the past year. A new
business shall be based on number of employees on
opening day. All principals in the business shall be
deemed as employees and be included in the calculation.
Person shall mean any individual, firm, partnership,
joint adventure, syndicate or other group or
combination acting as a unit, association, corporation,
estate, trust, business trust, trustee, executor,
administrator, receiver or other fiduciary and shall
include the plural as well as the singular.

or possession, transfer, exchange or barter, whether

Sec. 721. 03 Occupational License Tax Levy. An occu-
pational license tax is hereby levied for the privilege
of engaging in or managing any business, profession, or
occupation within the City. Such occupational license
tax is levied on:
A. Any person who maintains a permanent business
location or branch office within the City for the
privilege of engaging in or managing any business in
the City.
B. Any person who maintains a permanent business
location or branch office within the City for the
privilege of engaging in or managing any profession or
occupation within the City.
C. Any person who does not qualify under the pro-
visions of subsection (A) or subsection (B) and who
transacts any business or engages in any occupation or
profession in interstate commerce, if such license tax
is not prohibited by Section 8 of Article I of the
United States Constitution. #1
Sec. 721. 05 License Required; Payment of Tax
Prerequisite to Issuance. Each person who shall engage
in, transact or manage, or be the agent for, any
business, or who shall perform or offer to perform
services or sell goods, advertise goods for sale, or
perform services or solicit or advertise the perfor-
mance of services for any of the businesses, pro-
fessions or occupations mentioned in this chapter,
shall first procure a license from the City, and shall
upon procuring the license, and before the issuance of
the same, pay the amount of license tax required there-
for as hereinafter provided. [Ord. No. 19-87, §1, 21 Jul 87] #2
Sec. 721. 07 Construction of Chapter Provisions.
Each provision in this chapter contained and each
license tax by this chapter imposed is intended to be
separate and independent and is intended to be con-
strued distributively. #2
Sec. 721. 09 Employment of Personnel to Enforce
Chapter Provisions . The City Manager shall be and is
hereby empowered to employ such clerical and other help
as shall be necessary to fully enforce the provisions
of this chapter. #2

Sec. 721. 11 Unlawful to engage in business, etc.
without license or make false statements in license
application. It shall be unlawful for any person to
exercise any of the privileges or to carry on or engage
in or conduct any of the businesses, occupations or
professions herein specifically enumerated without
paying the occupational license tax or taxes required
by this chapter in the manner herein provided or to
fail to make any reports to the City Finance Director
as required, or to violate any other provision of this
chapter. #2
Sec. 721. 13 Penalty for making false statement in
License Application. Any person found making a state-
ment showing value of inventory in an amount less than
the true amount thereof in his application for a
license, or knowingly making a false statement as to
any other condition or factor upon which the license
fee is or shall be based, the effect of which would be
to reduce the amount of such fee, shall in addition to
all other penalties now provided by law, pay to the
Director of Finance, upon demand therefor, the ad-
ditional amount of license fee found to be due, plus a
penalty of twenty-five ( 25 ) percent of such additional
amount with interest on the additional fee of one per-
cent per month or major fraction thereof after the date
when the original license fee was due and payable to
the Director of Finance, and any license theretofore
issued to any such person shall be subject to revo-
cation, if so determined by the council. #2
Sec. 721. 15 Form, signing of licenses; report of
information to City Finance Director.
A. The Director of Finance shall prescribe the form
of all licenses and applications therefor, and, except
as otherwise provided by ordinance, all licenses shall
be signed by the Director of Finance and shall be in-
valid for all purposes unless so signed. Each person
required to pay an occupational license tax shall
report under oath to the City Finance Director all in-
formation necessary for a proper determination of the
occupational license tax due for each classification to
which he is subject, including the number of employees,
size or average inventory of stock on hand. The City
Finance Director is authorized to prepare interrogator-
ies to furnish forms for filing of the reports to
obtain the information necessary to determine the
proper occupational license tax due. The City Finance
Director is further authorized to make such invest-
igation and inspection of each place of business and
the records pertaining thereto as is necessary to
verify any reports or to determine the proper occu-
pational license tax or taxes due under this chapter.
B. Any person who is both a wholesale and retail
merchant as defined in this chapter is hereby required
to make separate reports for the wholesale business and
for the retail business and to obtain licenses
accordingly; however, any retail merchant who desires
to do a wholesale business also may elect to do such
wholesale business under his retail license, by paying
a license tax based on both the retail and wholesale
business at the retail rate.

Sec. 721. 17 License Year; when license tax due and
payable; term of license; proration of fees. The
license year for all occupational, business or other
licenses shall begin October 1 of each year and shall
expire on September 30 of the succeeding year. All
such licenses shall be sold by the Finance Director
beginning September 1 of each year and shall be due and
payable on October 1 of each year. No license shall be
issued for more than one year. For each license ob-
tained by any new business, occupation or agent after
April 1 of the following year, one-half of the license
for one year shall be paid, unless otherwise herein-
after provided. #2
Sec. 721. 19 When license taxes deemed delinquent;
penalty for delinquency. Each license not renewed by
October 1 shall be considered delinquent and subject to
a delinquency penalty of ten (10) percent of the total
tax due for the month of October, plus an additional
delinquency penalty of five ( 5 ) percent of the tax due
for each month of delinquency thereafter until paid;
however, the total penalty shall not exceed twenty five
(25 ) percent of the total tax due. Nothing in this
section, however, shall be construed to prevent the
imposition of a fine, or imprisonment, or both, upon
conviction for violation of any provision of this
chapter. #1
Sec. 721. 21 Licenses requiring council approval;
submission of application. All applicants for licenses
requiring approval of the council shall submit appli-
cations not less than two (2 ) weeks prior to regular
meeting of the council to allow sufficient time for
investigation, etc. , of the applicant. #2
Sec. 721. 23 Issuance of license to corporations,
partnerships, etc. Any license may be issued to any
corporation, association, or partnership, or to two (2)
or more persons engaged in any joint enterprise, the
same as to a single person and for the same fee, except
where otherwise specially provided. #2
Sec. 721. 25 Duty of corporations to comply with
chapter provisions. It shall be the duty of all
officers and agents of any corporation to see that such
corporation complies with the provisions of the
chapter, and all officers or agents of any corporation
required by this chapter to be licensed who shall do
business without having paid the license tax imposed
and procured such license shall be subject to the
penalties imposed by this chapter. #2
Sec. 721. 27 Separate license required for each
place of business. A separate license shall be
obtained for each place of business conducted,
operated, maintained, or carried on by every person
engaged in any occupation, trade or enterprise, for
which a license is required by the ordinances of the
City. #1
Sec. 721. 29 Multiple Licenses. Except as otherwise
stated herein, in the event any person engaged in a
business, occupation, or profession at one location or
place of business is required in the operation of said
business, etc. , under the terms of this chapter to have
more than one license, and to pay more than one license
tax; the licensee shall pay in full all license fees so
required. #2

Sec. 721. 31 Preservation, display of license. All
licenses granted by the City shall be carefully pre-
served and shall be displayed in a conspicious place in
the place of business authorized to be conducted by the
license. #1
Sec. 721. 33 Transfer of license; fees; refunds.
A. All licenses issued by the City shall be trans-
ferred with the approval of the Director of Finance
with the businesses for which they were taken out,
except as otherwise provided for by law, when there is
a bona fide sale and transfer of the property used and
employed in the business as stock in trade, and not
otherwise; provided, that the seller of the business
shall present the license to the Department of Finance
with the endorsement on the reverse side of the license
issued, assigning all right, title and interest to the
purchaser, and the purchaser shall produce a properly
executed bill of sale showing the transfer of stock
from the person licensed to the purchaser. Licenses
may be transferred from one location to another;
provided, that the license is presented to the
Department of Finance for approval of such transfer.
B. Upon the transfer of ownership of any such
licenses, there shall be a fee of three dollars ( $3.00) .
For a transfer of location by the same ownership, there
shall be a fee of three dollars ($3.00 ) . Fees pre-
scribed by this chapter shall in no case be refunded.
C. No occupation license to general or subcontractor
may be assigned or transferred from one person to
another. #1
Sec. 721. 35 Advertisement deemed conclusive
evidence of engaging in business, etc. The advertise-
ment of any business, profession or occupation, by
sign, newspaper, magazine or otherwise, shall be con-
clusive evidence of the engaging in and carrying on in
the City of t-h.e business, profession or occupation so
advertised. #1
Sec. 721. 37 Established place of business required.
No license shall be issued for any business where the
business is;-conducted from vehicle or temporary
structure. ' )
Sec. 721. 38 Exemption from payment of license tax;
state law to govern. Any person entitled to exemption
under the laws of the State shall be exempt from the
payment of a license tax to the City; however, in no
case shall a person be exempt from a payment of the
occupational license tax in excess of fifty dollars
($50. 00) . The laws of the State shall govern such ex-
emptions. Applicants for exemption shall make affi-
davit that total exemption, for all municipal licenses,
does not exceed fifty dollars ($50.00 ) . Veterans must
be at least ten (10 ) percent disabled to qualify for
exemption. Nothing in this chapter shall be construed
as interfering with regulating or taxing any person in
business against whom the right of taxation has already
been preempted by the State, nor as giving to any
person the right to obstruct the streets, sidewalk or
other public places in the City. #1

Sec. 721. 39 Insurance Requirements. Whenever
indicated elsewhere in this Chapter, applicants may be
required to present the City with a certificate showing
insurance coverage for general tort liability in an
amount of not less than $100, 000.00 to any one person,
$300,000.00 for any one accident and $25,000.00
property damage, prior to the issuance of a license. #2
Sec. 721. 40 Special Provisions for Contractors and
Subcontractors.
A. All contractors and subcontractors shall be
required to furnish a surety bond in the amount of
$1, 000 payable to the City of Cape Canaveral prior to
the issuance of an occupational license.
B. No license shall be issued to any contractor,
general or otherwise, unless the applicant therefor
shall first present to the City a certificate showing
said applicant to be insured for general tort liability
in the amount of not less than $100,000. 00 to any one
person, $300,000.00 for any one accident and $25,000.00
property damage. #2
Sec. 721. 41 Application of chapter provisions to
farmers. Nothing in this chapter shall be construed to
require any farmer to procure a license to sell vege-
tables or fruits within the City, if such vegetables or
fruits are the produce of his own farm, located within
the State. #1
Sec. 721.43 License fee for businesses, etc. , not
otherwise designated. Every business, occupation,
profession or exhibition, engaged in by any person, not
herein specifically designated, shall pay a license fee
of thirty-one dollars and twenty-five cents ($31. 25 ) . trl
Sec. 721. 45 Records of issued licenses; contents.
The Director of Finance shall keep an accurate and
thorough record of all licenses issued, showing the
nature of the license, its date, expiration and to whom
issued. #1
Sec. 721.47 Records to be kept by all persons
engaging in business for which license is required. It
shall be the duty of every person engaging or con-
tinuing in the City any business or exercising any
privilege subject to a license tax to keep and preserve
suitable records of the average annual inventory of
stock on hand, records sufficient to show the number of
employees, and a record of all goods and merchandise
purchased or received for resale. It shall be the duty
of every person to keep and preserve, for a period of
two (2 ) years, all invoices of goods and merchandise
purchased or received for resale and the employment
records of all employees and to furnish such records to
the City Finance Director for inspection upon request. #2
Sec. 721.49 Each day of failure to comply with
chapter provisions deemed separate violation. Each day
of selling or disposal of merchandise or engaging in
business or occupation without complying with this
chapter shall constitute a separate and distinct
violation of such chapter. #2
Sec. 721. 51 Authority of council to change, revoke,
etc. chapter provisions and enact other ordinances.
The adoption of this chapter and schedule of licenses
shall not abridge the right of the council to change,

alter, increase, decrease or revoke any of the licenses
provided for herein at any time; or to pass other
ordinances providing for excise or license taxes or
other license assessments whether pertaining to any of
the subject contained or provided for in this chapter
or not, and the same shall not affect any of the
matters or provisions of is chapter, unless
specifically so stated. #2

with this chapter shall constitute a separate and
distinct violation of such ordinance.
B. Any person violating any of the provisions of
this chapter shall be punished as provided in §801.02.

Chapter 721 of the City Code of Ordinances, we are asking you
to reconsider the amendment made to this ordinance concerning
the mobile catering trucks.
We are a mobile food service preforming a catering service
to construction sites at their request. A few of the contractors
we are, or have in the past, serving on their construcion sites
are Martec, Hoog Electric, K & W Concrete, Capetown Builders,
Jim Murphy, Charles Davidson, Clifton Construction, Croson and.
John Murphy.
We ask you to reconsider this Code 721 as we feel we are
not in the least infringing on any business in the City of Cape

evidence of engaging in business , etc . The advertise-
ment of any business , profession or occupation , by
sign, newspaper, magazine or otherwise , shall be con-
clusive evidence of the engaging in and carrying on in
the City of the business , profession or occupation so

Sec. 721. 37 Established place of business required.
No license shall be issued for any business where the
business is conducted from vehicle or temporary

Sec . 721. 38 Exemption from payment of license tax;
state law to govern. Any person entitled to exemption
under the laws of the State shall be exempt from the
payment of a license tax to the City; however , in no
case shall a person be exempt from a payment of the
occupational license tax in excess of fifty dollars
( $ 50 . 00 ) . The laws of the State shall govern such ex-
emptions . Applicants for exemption shall make affi-
davit that total exemption, for all municipal licenses,
does not exceed fifty dollars ( $ 50 . 00 ) . Veterans must
be at least ten ( 10 ) percent disabled to qualify for
exemption. Nothing in this chapter shall be construed
as interfering with regulating or taxing any person in
business against whom the right of taxation has already
been preempted by the State , nor as giving to any
person the right to obstruct the streets , sidewalk or

Sec . 721 . 39 Insurance Requirements . Whenever
indicated elsewhere in this Chapter , applicants may be
required to present the City with a certificate showing

Sec . 721 . 35 Advertisement deemed conclusive
evidence of engaging in business , etc . The advertise-
ment of any business , profession or occupation , by
sign, newspaper, magazine or otherwise, shall be con-
clusive evidence of the engaging in and carrying on in
the City of the business , profession or occupation so

Sec. 721. 37 Established place of business required.
No license shall be issued for any business where the
business is conducted from vehicle or temporary

Sec. 721. 38 Exemption from payment of license tax;
state law to govern. Any person entitled to exemption
under the laws of the State shall be exempt from the
payment of a license tax to the City; however , in no
case shall a person be exempt from a payment of the
occupational license tax in excess of fifty dollars
( $ 50 . 00 ) . The laws of the State shall govern such ex-
emptions . Applicants for exemption shall make affi-
davit that total exemption, for all municipal licenses,
does not exceed fifty dollars ( $50 . 00 ) . Veterans must
be at least ten ( 10 ) percent disabled to qualify for
exemption. Nothing in this chapter shall be construed
as interfering with regulating or taxing any person in
business against whom the right of taxation has already
been preempted by the State , nor as giving to any
person the right to obstruct the streets , sidewalk or

Sec . 721 . 39 Insurance Requirements . Whenever
indicated elsewhere in this Chapter , applicants may be
required to present the City with a certificate showing
insurance coverage for general tort liability in an
amount of not less than $100, 000 . 00 to any one person,
$300 , 000 . 00 for any one accident and $ 25 , 000 . 00
property damage, prior to the issuance of a license.

CHAPTER 721
Sec. 721. 01 Definitions . As used in this chapter the
terms that follow shall have the following meanings respect-
ively ascribed to them unless the context requires other-
wise:
Business Profession and Occupation do not include the
customary religious, charitable, or educational activit-
ies of nonprofit religious , nonprofit charitable, and
nonprofit educational institutions in this State, which
institutions are more particularly defined and limited
as follows:
(A) Religious Institutions shall mean churches and
ecclesiastical or denominational organizations or
established physical places for worship in this
State at which nonprofit religious services and
activities are regularly conducted and carried on,
and shall also mean church cemeteries.
(B) Educational Institutions shall mean State tax-
supported or parochial, church and non-profit
schools, colleges, or universities conducting
regular classes and courses of study required for
accreditation by or membership in the Southern
Association of Colleges and Secondary Schools, the
Department of Education or the Florida Council of
Independent Schools . Nonprofit libraries, art
galleries, and museums open to the public are
defined as educational institutions and eligible
for exemption.
(C) Charitable Institutions shall mean only non-profit
corporations operating physical facilities in this
State at which are provided charitable services, a
reasonable percentage of which shall be without
cost to those unable to pay.
Contractor shall mean any person accepting or offering
to accept orders of contracts for doing any work on or
in any building or structure requiring the use of build-
ing materials or accepting or offering to accept orders
or contracts to do any paving or curbing on sidewalks
or streets , public or private property, requiring the
use of appropriate material or any composition; or ac-
cepting or offering to accept orders or contracts to
excavate earth, rock or material for foundations or any
other purpose; or accepting or offering to accept or-
ders or contracts to construct any sewer of appropriate
material or other material ; or accepting or offering to
accept orders or contracts for building, remodeling,
repairing, wrecking, razing or demolishing any struct-
ure; or for moving any building, or for the instal-
lation, maintenance or repair of neon signs, air con-
ditioning apparatus or equipment; whether such work is
done or offered to be done by day labor; general
contract or subcontract. Every person engaging in the
business of accepting or offering to accept orders for
contracts for doing any work on or in any building or
premises involving erecting, installing, altering,
repairing, servicing, or maintaining electric wiring,
devices or appliances permanently connected to such
wiring, or the erecting, repairing, or maintaining of
lines, shall be deemed to be an electrical contractor.
Every person engaged in the business of plumber or
steamfitter shall be deemed to be a contractor. Every
person engaged in the business of erecting a building
or buildings for the purpose of selling or renting the
same, and making no contract with a duly licensed
contractor for the erection of said buildings or build-
ing, whether or not such person contracts with one or
more duly licensed contractors for one or more portions
but does not contract with any one person for all the
work of erecting any one of said buildings, shall be
deemed to be a contractor if he shall build more than
one house in any one year.
Employee shall mean any person who engages in any
business, profession or occupation under any appoint-
ment, agency, contract of hire, or apprenticeship
express or implied, oral or written.
Merchandise shall mean any goods, wares or commodities
bought or sold in the usual course of trade, wholesale
or retail, including necessities, provisions, and
articles for immediate consumption.
Merchant shall mean any person engaged in the business
of of selling merchandise at retail or wholesale, includ-
ing merchandise agencies, merchandise brokers, dealers,
distributors,•jobbers, buying clubs, and all others
whose business includes the sale of merchandise except
a manufacturer or processor who creates or fabricates
an entirely new or different product or articles of
inventory, and those businesses which pay an additional
occupational license tax based upon the number of
employees or floor space in a particular classification.
Vendors of food or flour, bottling works, processors of
bakery and dairy products, stone works, planers or
shapers of lumber and other persons who do not create a
new or entirely new or different article shall be
deemed merchants for the purpose of this chapter.
Merchant Retail shall mean any merchant who sells to
the consumer for any purpose other than resale.
Merchant Wholesale shall mean any merchant who sells to
another for the purpose of resale. Sales to govern-
mental entities shall be considered wholesale sales.
Person shall mean any individual, firm, partnership,
joint adventure, syndicate or other group or combin-
ation acting as a unit, association, corporation,
estate, trust, business trust, trustee, executor, admin-
istrator, receiver or other fiduciary and shall include
the plural as well as the singular.
Sec. 721.03 Occupational License Tax Levy. An oc-
cupational license tax is hereby levied for the privilege of
engaging in or managing any business, profession, or oc-
cupation within the City. Such occupational license tax is
levied on:
(A) Any person who maintains a permanent business
location or branch office within the City for the
privilege of engaging in or managing any business
in the City.

(B) Any person who maintains a permanent business
location or branch office within the City for the
privilege of engaging in or managing any pro-
fession or occupation within the City.
(C) Any person who does not ualify under the ro-
visions of subsection (A) or subsection (B) and
who transacts any busi ess or engages in any
occupation or profession in interstate commerce,
if such license tax is not prohibited by Section 8
of Article I of the United States Constitution.
Sec. 721.05 License Required; Payment of Tax
Prerequisite to Issuance. Each person who shall engage in,
transact or manage, or be the agent for, any business, or
who shall perform or offer to perform services or sell
goods, advertise goods for sale, or perform services or
solicit or advertise the performance of services for any of
the businesses, professions or occupations mentioned in this
chapter, shall first procure a license from the City, and
shall upon procuring the license, and before the issuance of
the same, pay the amount of license tax required therefor as
hereinafter provided.
Sec. 721.07 Construction of Chapter Provisions. Each
provision in this chapter contained and each license tax by
this chapter imposed is intended to be separate and independ-
ent and is intended to be construed distributively.
Sec. 721.09 Employment of Personnel to Enforce Chapter
Provisions. The City Manager shall be and is hereby em-
powered to employ such clerical and other help as shall be
necessary to fully enforce the provisions of this chapter.
Sec. 721.11 Unlawful to engage in business, etc.
without license or make false statements in license
application. It shall be unlawful for any person to ex-
ercise any of the privileges or to carry on or engage in or
conduct any of the businesses, occupations or professions
herein specifically enumerated without paying the occu-
pational license tax or taxes required by this chapter in
the manner herein provided or to fail to make any reports to
the City Finance Director as required, or to violate any
other provision of this chapter.
Sec. 721.13 Penalty for making false statement in
License Application. Any person found making a statement
showing value of inventory in an amount less than the true
amount thereof in his application for a license, or knowing-
ly making a false statement as to any other condition or
factor upon which the license fee is or shall be based, the
effect of which would be to reduce the amount of such fee,
shall in addition to all otherpenalties now provided by
law, pay to the Director of Finance, upon demand therefor,
the additional amount of license fee found to be due, plus a
penalty of twenty-five (25) percent of such additional
amount with interest on the additional fee of one percent
per month or major fraction thereof after the date when the
original license fee was due and payable to the Director of
Finance, and any license theretofore issued to any such
person shall be subject to revocation, if so determined by
the council.

Sec. 721. 15 Form, signing of licenses; report of
information to City Finance Director.
(A) The Director of Finance shall prescribe the form
of all licenses and applications therefor, and,
except as otherwise provided by ordinance, all
licenses shall be signed by the Director of
Finance and shall be invalid for all purposes
unless so signed. Each person required to pay an
occupational license tax shall report under oath
to the City Finance Director all information
necessary for a proper determination of the
occupational license tax due for each class-
ification to which he is subject, including the
number of employees, size or average inventory of
stock on hand. The City Finance Director is
authorized to prepare interrogatories and to
furnish forms for filing of the reports to obtain
the information necessary to determine the proper
occupational license tax due. The City Finance
Director is further authorized to make such
investigation and inspection of each place of
business and the records pertaining thereto as is
necessary to verify any reports or to determine
the proper occupational license tax or taxes due
under this chapter.
(B) Any person who is both a wholesale and retail
merchant as defined in this chapter is hereby
required to make separate reports for the
wholesale business and for the retail business and
to obtain licenses accordingly; however, any
retail merchant who desires to do a wholesale
business also may elect to do such wholesale
business under his retail license, by paying a
license tax based on both the retail and wholesale
business at the retail rate.
Sec. 721. 17 License Year ; when license tax due and
payable; term of license; proration of fees . The license
year for all occupational, business or other licenses shall
begin October 1 of each year and shall expire on September
30 of the succeeding year . All such licenses shall be sold
by the Finance Director beginning September 1 of each year
and shall be due and payable on October 1 of each year. No
license shall be issued for more than one year . For each
license obtained by any new business, occupation or agent
after April 1 of the following year, one-half of the license
for one year shall be paid, unless otherwise hereinafter
provided.
Sec. 721. 19 When license taxes deemed delinquent;
penalty for delinquency. Each license not renewed by
October 1 shall be considered delinquent and subject to a
delinquency penalty of ten (10 ) percent of the total tax due
for the month of October, plus an additional delinquency
penalty of five ( 5 ) percent of the tax due for each month of
delinquency thereafter until paid; however, the total pen-
alty shall not exceed twenty five ( 25 ) percent of the total
tax due. Nothing in this section, however, shall be con-
strued to prevent the imposition of a fine, or imprisonment,
or both, upon conviction for violation of any provision of
this chapter.

Sec. 721. 21 Licenses requiring council approval;
submission of application. All applicants for licenses
requiring approval of the council shall submit applications
not less than two ( 2 ) weeks prior to regular meeting of the
council to allow sufficient time for investigation, etc. , of
the applicant.
Sec. 721. 23 Issuance of license to corporations,
partnerships, etc. Any license may be issued to any
corporation, association, or partnership, or to two ( 2 ) or
more persons engaged in any joint enterprise, the same as to
a single person and for the same fee, except where otherwise
specially provided.
Sec. 721. 25 Duty of corporations to comply with chapter
provisions. It shall be the duty of all officers and agents
of any corporation to see that such corporation complies
with the provisions of the chapter, and all officers or
agents of any corporation required by this chapter to be
licensed who shall do business without having paid the
license tax imposed and procured such license shall be
subject to the penalties imposed by this chapter.
Sec. 721. 27 Separate license required for each place of
business. A separate license shall be obtained for each
place of business conducted, operated, maintained, or
carried on by every person engaged in any occupation, trade
or enterprise, for which a license is required by the
ordinances of the City.
Sec. 721. 29 Multiple Licenses. Except as otherwise
stated herein, in the event any person engaged in a
business , occupation, or profession at one location or place
of business is required in the operation of said business,
etc. , under the terms of this chapter to have more than one
license, and to pay more than one license tax; the licensee
shall pay in full all license fees so required.
Sec. 721. 31 Preservation, display of license. All
licenses granted by the City shall be carefully preserved
and shall be displayed in a conspicious place in the place
of business authorized to be conducted by the license.
Sec. 721. 33 Transfer of license; fees; refunds .
(A) All licenses issued by the City shall be transferred
with the approval of the Director of Finance with the
businesses for which they were taken out, except as
otherwise provided for by law, when there is a bona fide
sale and transfer of the property used and employed in the
business as stock in trade, and not otherwise; provided,
that the seller of the business shall present the license to
the Department of Finance with the endorsement on the
reverse side of the license issued, assigning all right,
title and interest to the purchaser, and the purchaser shall
produce a properly executed bill of sale showing the
transfer of stock from the person licensed to the purchaser.
Licenses may be transferred from one location to another;
provided, that the license is presented to the Department of
Finance for approval of such transfer.
(B) Upon the transfer of ownership of any such licenses,
there shall be a fee of three dollars ( $3.00 ) . For a
transfer of location by the same ownership, there shall be a
fee of three dollars ( $3 . 00 ) . Fees prescribed by this
chapter shall in no case be refunded.

Sec. 721. 35 Advertisement deemed conclusive evidence
of engaging in business , etc. The advertisement of any
business, profession or occupation, by sign, newspaper,
magazine or otherwise, shall be conclusive evidence of the
engaging in and carrying on in the City of the business,
profession or occupation so advertised.
Sec. 721. 37 Established place of business required.
No license shall be issued for any business where the
business is conducted solely from vehicle or temporary
structure.
Sec. 721. 39 Exemption from payment of license tax;
state law to govern. Any person entitled to exemption under
the laws of the State shall be exempt from the payment of a
license tax to the City; however , in no case shall a person
be exempt from a payment of the occupational license tax in
excess of fifty dollars ($50 .00 ) . The laws of the State
shall govern such exemptions. Applicants for exemption
shall make affidavit that total exemption, for all municipal
licenses, does not exceed fifty dollars ($50. 00 ) . Veterans
must be at least ten (10 ) percent disabled to qualify for
exemption. Nothing in this chapter shall be construed as

Sec. 721.41 Application of chapter provisions to
farmers . Nothing in this chapter shall be construed to
require any farmer to procure a license to sell vegetables
or fruits within the City, ie such vegetables or fruits are
the produce of his own farm, located within the State.
Sec. 721. 43 License fee for businesses , etc. , not

fession or exhibition,
engaged in by any person,
not herein specifically designated, shall pay a license fee
of twenty-five dollars. 31.25
Sec. 721. 45 Records of issued licenses; contents. The
Director of Finance shall keep an accurate and thorough
record of all licenses issued, showing the nature of the
license, its date, expiration and to whom issued.
Sec. 721. 47 Records to be kept by all persons engaging
in business for which license is required. It shall be the
duty of every person engaging or continuing in the City any
business or exercising any privilege subject to a license
tax to keep and preserve suitable records of the average
annual inventory of stock on hand, records sufficient to
show the number of employees, and a record of all goods and
merchandise purchased or received for resale. It shall be
the duty of every person to keep and preserve, for a period
of two ( 2 ) years, all invoices of goods and merchandise pur-
chased or received for resale and the employment records of
all employees and to furnish such records to the City
Finance Director for inspection upon request.
Sec. 721. 49 Each day of failure to comply with chapter
provisions deemed separate violation. Each day of selling
or disposal of merchandise or engaging in business or occu-
pation without complying with this chapter shall constitute
a separate and distinct violation of such chapter.

Sec. 721. 51 Authority of council to change, revoke,
etc. chapter provisions and enact other ordinances . The
adoption of this chapter and schedule of licenses shall not
abridge the right of the council to change, alter, increase,
decrease or revoke any of the licenses provided for herein
at any time; or to pass other ordinances providing for ex-
cise or license taxes or other license assessments whether
pertaining to any of the subject contained or provided for
in this chapter or not, and the same shall not affect any of
the matters or provisions of this chapter, unless specific-
ally so stated.

AMENDMENTS TO HEALTH STUDIO LAW
effective October 1, 1983
The Florida Legislature, in the 1983 regular session, passed amendments to
Section 501.012, Florida Statutes, (Health Studio Law) which will affect EVERY
HEALTH STUDIO IN FLORIDA which sells future services.
For your information, we enclose a copy of that law, as amended.
I. Who is affected, and how:
If you are a "health studio" as defined by law ( i .e. , if you sell either a
PROGRAM OF PHYSICAL EXERCISE or the use of FACILITIES FOR PHYSICAL EXERCISE)
and take money for such programs or services IN ADVANCE - whether it be for
a week, month, or year (or longer) - you are subject to the law.
A "health studio" as defined by law includes many businesses other than "spas".
It may include a business which sells contracts for:
martial arts instruction,
racquet ball facilities,
golf or tennis facilities,
gym facilities or
exercise classes.
The test is whether the sale of such services includes PHYSICAL EXERCISE as an
integral part of the program or facilities provided.
The law requires that a health studio provide a written contract which
specifically includes (at a minimum):

A. A penalty-free cancellation period of THREE DAYS, exclusive of
weekends or holidays.
B. A provision that, if you move more than FIVE MILES or CLOSE THE
FACILITY, the buyer will receive a pro rata refund.
C. A provision that if the buyer is so PHYISCALLY DISABLED as to
not be able to avail himself/herself to a substantial part of
the services purchased, the buyer will receive a pro rata
refund. A medical or osteopathic physician's certificate is
required.
D. A provision that the contract is for not more than 36 MONTHS,
subject to the buyer's option to renew.
Note: An "option to renew" may not be for a nominal consideration
and, if options are given, the renewal price must bear a reasonable
relation to the original price. It is expected that this standard
will be spelled out in ADMINISTRATIVE RULES to be adopted by the
Department.
II. Bonding:
A. The law requires that an original SURETY BOND in the sum of
$25,000 be furnished to the Department by EVERY HEALTH STUDIO
which:
1. Is selling PRE-OPENING contracts or which
2. Has been in business for LESS THAN THREE YEARS.
The bond must be maintained with the Department for the pre-opening
period plus three years from the date of beginning actual opera-
tion. Surety bonds may be obtained through your general lines
insurance agent.
B. In lieu of a surety bond, certain alternatives which must provide
protection equivalent to that of the surety bond, may be available,
subject to approval of the Department.
1. Letter of Credit - This is a letter from a bank which
guarantees that up to $25,000 is available to the Department
should there be a valid claim for a refund which is not paid
by you. You may consult your bank for details.
2. Security in Some Other Form - This may be a promissory
note payable to the Department, without interest, which is
secured by a mortgage on acceptable real or personal property.

a. The security instrument for real property must be a
mortgage which is drawn, executed and recorded, at
your expense, in the public records of the county
where the land lies.
b. The security instrument for personal property is a
chattel mortgage which is drawn, executed and recorded,
at your expense, in the office of the Florida Secretary
of State (UCC Division).
In either case, a certification of both the fair market
value and the equity of the owner must be made. The
certification may be made as a part of the security
instrument or, if required by the Department, by an
independent property appraiser.
3. In case a "parent" owner opens a health studio in a new
location, the "parent" may, subject to approval by the
Department, guarantee the obligations of the new health
studio if:
a. The "parent" has been in business for more than three
years and
b. The financial condition ( i .e. net worth) of the "parent"
provides solid assurance that the consumer will be
protected.
This security is in the form of a guaranty agreement entered
into between the State, the "parent" and the new health
studio and, if required by the Department, a third party
guarantor(s) . It may require the personal guaranty of an
owner or other individual .
Evidence of the financial condition of the parties will be
made by financial statements which are certified by the
president of the corporation, a partner of a partnership or
an individual , as the case may be.
III. Small Health Studios:
Provision in the new law is made for very •small operations (those having, at
any given time, less than a total of $5,000 in current contracts) to request
reduction of the penalty of the bond from $25,000 to not less than $10,000.
Approval of such reduction is in the discretion of the Department.

IV. Updating Financial Statements:
The law provides that, during the time a bond or other acceptable security is
required, the health studio must provide an annual update of it's financial
statements.
In case of a "parent" or third party guarantor, updates of their financial
statements will also be required.
V. "Lifetime" Memberships:
The 1983 amendments specifically prohibit "lifetime" or "perpetual " memberships.
Please also refer to Paragraph I(d) above, concerning options to renew.
VI. Responsibility for Criminal Violations:
Under the new law, not only is the health studio subject to criminal prosecution
for violation of the Section 501.012, Florida Statutes, but any owner, manager
or ( in case of corporate ownership) substantial stockholder may be charged.
VII. Temporary Closings:
A health studio may close for repair and/or renovation and not be considered
to have gone "out of business" only in the following circumstances:
A. If a health studio is sold to a new owner, it may be closed
for not more than fourteen (14) consecutive days.
B. If a health studio is closed for repairs during an existing
ownership, it may be closed for not more than seven (7)
consecutive days at one time and for not more than two (2)
periods of seven (7) days in one year.

501.012 Contracts for health studio services.
(1) The Legislature finds and declares that there
exist in connection with a substantial number of con-
tracts for health studio services certain practices and
business and financing methods which have worked
undue financial hardship upon some of the citizens of
our state and that existing legal remedies are inade-
quate to correct existing problems in the industry.
The Legislature finds and declares that the health
studio industry has a significant impact upon the
economy and well-being of the people of the state
and that the provisions of this section regulating
health studio contracts are necessary for the public
welfare.
(2) For purposes of this section, the following
terms shall have the following meanings, unless the
context requires otherwise:
(a) "Health studio" means and includes any per-
son, firm, corporation, organization, club, or associa-
tion engaged in the sale of instruction,training,or as-
sistance in a program of physical exercise,which may
include the use of a sauna, whirlpool bath,
weight-lifting room, massage, steam room, or other
exercising machine or device. The term also includes
any person, firm, corporation,organization,or associ-
ation engaged in the sale of the right or privilege to
use exercise equipment or facilities, such as a sauna,
whirlpool bath, weight lifting room, massage, steam
room, or other exercising machine or device. "Health
studio" does not include bona fide nonprofit organi-
zations which have been granted tax-exempt status
by the internal Revenue Service, including, but not
limited to, the Young Men's Christian Association,
Young Women's Christian Association,or other simi-
lar organizations, whose functions as health studios
are only incidental to their overall functions and pur-
poses.
(b) "Health studio services" means and includes
services, privileges, or rights offered for sale or pro-
vided by a health studio.
(3) Every contract for the sale of future health studio services
which are paid for in advance or which the buyer agrees to pay for in
future installment payments shall be in writing and shall contain the
following-°4ontractual provisions to the contrary notwithstanding:
(a) A provision for the penalty-free cancellation of the contract
within 3 days, exclusive of holidays and weekends, of its making, upon
the mailing or delivery of written notice to the health studio, and
refund upon such notice of all moneys paid under the contract, except
that the health studio may retain an amount computed by dividing the
number of complete days in the contract term or, if appropriate, the
number of occasions health studio services are to be rendered into the
total contract price and multiplying the result by the number of complete
days that have passed since the making of the contract or, if
appropriate, by the number of occasions that health studio services have
been rendered.

(b) A provision for the cancellation of the contract if the health
studio goes out of business and fails to provide facilities within 5
miles of, or moves its facilities more than 5 miles from, the location
designated in such contract, upon written notice by the buyer, with
refund upon such notice of funds paid or accepted in payment of the
contract in an amount computed by dividing the contract price by the
number of weeks in the contract term and multiplying the result by the
number of weeks remaining in the contractterm. The health studio shall
not be deemed to have gone out of business and failed to provide
facilities when temporarily closed for repair and renovation of the
premises: upon sale, for not more than 14 consecutive days; and during
ownership, for not more than 7 consecutive days and not more than two
periods of 7 consecutive days in any calendar year.
(c) A provision for the cancellation of the contract if the buyer
dies or becomes physically unable to avail himself of a substantial
portion of the services he used from the commencement of the contract
until the time of disability tetelly and permanently disabled during the
membership term feiiewing the date of seaeh eentraet, with refund of funds
paid or accepted in payment of the contract in an amount computed by
dividing the contract price by the number of weeks in the contract term
and multiplying the result by the number of weeks remaining in the
contract term. The contract may require a buyer or the buyer's estate
seeking relief under this subsection to provide reasenabie proof of tetal
and penman-ent disability or death. Physical disability, sufficient to
warrant cancellation of the contract by the buyer, shall be established
if the buyer furnishes to the health studio a certification of such
disability by a physician licensed under chapter 458 or chapter 459.
(d) A provision that the contract shall not be for a period in excess
of 36 months, but may be renewable at the end of each 36-month period of
time.
(4) Upon entering into a contract for health stu-
dio services, the buyer shall be provided with a writ-
ten contract, which shall include the name, address,
and primary place of business of the health studio.
Prior to entering into any such contract, the health
studio shall also provide the buyer with a current
copy of any rules and regulations applicable to the
buyer's use of the health studio.
(5) The provisions of this section shall not apply
to any contracts for health studio services entered
into before the effective date of this act, or to the
subsequent renewals of said contracts.
(6) Every health studio which sells contracts for health studio
services shall, during any period prior to opening and for a period of 3
years after commencement of business:
(a) Maintain a bond issued by a surety company admitted to do
business in this state. The principal sum of the bond shall be 525,000,
and the bond, when required, shall be obtained before an occupational
license may be issued under chapter 205. The bond shall be in favor of
the state for the benefit of any person injured as a result of a
violation of this section. The aggregate liability of the surety to all
persons for all breaches of the conditions of the bonds provided herein
shall in no event exceed the amount of the bond. The original surety
bond required by this section shall be filed with the Department of
Agriculture and Consumer Services.
(b) In lieu of maintaining the bond required in paragraph (a), the
health studio may furnish to the Department of Agriculture and Consumer
Services a copy of its financial statement, certified by its president or
principal to be true and correct; letter of credit from any foreign or
domestic bank; guaranty; or other documentation establishing sufficient
financial responsibility in at least the amount of the bond required
under paragraph (a) as will enable the health studio to satisfy the
possible claims against the bond allowed by paragraph (a) . In the event
the health studio is controlled by, under common control with, or
controls other corporations, and such other corporations agree in writing
to satisfy the claims against a bond allowed by paragraph (a), then the
financial responsibility of such other corporations shall be considered
in determining compliance with this section. The department shall decide
whether the information furnished in lieu of bond by the health studio is
in compliance with the requirements of this subsection.

(c) During the period of maintenance of the bond or the furnishing of
documentation establishing sufficient financial responsibility for a
waiver of the bond, the health studio annually shall file, as
appropriate, with the Department of Agriculture and Consumer Services
evidence that the bond remains in force or a copy of its financial
statement, certified by its president or principal to be true and
correct.
(d) If the health studio furnishes the Department of Agriculture and
Consumer Services with evidence, satisfactory to the department, that the
aggregate dollar amount of all current outstanding contracts of the
health studio is less than $5,000, the department may, in its discretion,
reduce the principal amount of the surety bond or other sufficient
financial responsibility required in paragraphs (a) and (b) to a sum not
less than $10,000, provided that, at any time such contracts shall exceed
$5,000, the health studio shall so notify the department and the health
studio shall thereupon provide the bond or other documentation as
required in paragraphs (a) and (b) .
(e) For purposes of this section, a health studio shall be considered
a new health studio and subject to the requirement of a bond or .other
financial security each time the health studio changes ownership, or, in
case of corporate ownership, each time the stock ownership is so changed
as to effectively put the health studio under new management and control.
(7) The Department of Agriculture and Consumer Services shall
promulgate such rules as may be necessary to carry out the provisions of
this section.
(8) Any health studio or any owner or manager thereof, or in the case
of corporate ownership, any substantial stockholder of such corporation,
violating the provisions of this section is guilty of a misdemeanor of
the first degree, punishable as provided in s. 775.082,. a. 775.083, or s.
775.084.
(9) The Department of Agriculture and Consum-
er Services may institute proceedings in the appro-
priate circuit court for injunctive relief to enforce this
act.
(10) No health studio shall, orally or in writing, make any
representation that a health studio contract for future services is for a
"lifetime" or is a "perpetual" membership or use any words or combination
of words which may tend to give a prospective buyer the impression that a
contract or membership entitles the buyer to services or the use of
facilities for an indefinite term. Nothing herein shall prevent a health
studio from utilizing a 3-year contract, renewable at the option of the
buyer.
(11)(a)f The amendments to this section by chapter 78-419, Laws of
Florida, shall not apply to any contracts for health studio services
entered into before July 1, 1978, or to subsequent renewals of such
contracts.
(b) f36j The amendments to this section by chapter 80-49, Laws of
Florida, shall not apply to a health studio which has operated at the
same location under the same ownership since July 1, 1977.
Section 2. This act shall take effect October 1, 1983.

amended by inserting the following category, TAXI in Section 721. 11
of the City Code as provided hereafter.

§ 721.01 OCC. LICENSES § 721.03
CHAPTER 721
OCCUPATIONAL LICENSES
Sec. 721.01 Short Title. This chapter shall
be known as the "City of Cape Canaveral Occupa-
tional License Tax." [Ord. No. 11-72, § 1,
Sec. 721.02 Definitions. The definitions of
the terms and phrases as set forth in Section 205.22,
Florida Statutes, as amended by Chapter 72-306,
Laws of Florida, 1972, are hereby incorporated
into this chapter by reference and such terms
and phrases when used in this chapter shall have
the meaning designated to them accordingly.

Sec. 721.03 Tax Levied. The City of Cape
Canaveral, Florida, does hereby levy and impose
an occupational license tax for the privilege
of engaging in or managing any business, profes-
sion or occupation within its jurisdiction. Such
occupational license tax is levied on:
(A) Any person who maintains a permanent
business location or branch office within the
City of Cape Canaveral for the privilege of
engaging in or managing any business within
its jurisdiction; and
(B) Any person who maintains a permanent
business location or branch office within the
City of Cape Canaveral for the privilege of
engaging in or managing any profession or
occupation within its jurisdiction; and
(C) Any person who does not qualify under the
provisions of (A) and (B) above and who transacts
within the City of Cape Canaveral any business

of a transfer fee of three ($3.00) dollars.

Sec. 721.08 Evidence of Doing Business. The
advertisement of any business, profession or
occupation, by sign, newspaper, magazine, or
otherwise, shall be conclusive evidence of the
engaging in and carrying on in the City of Cape
Canaveral, Florida, of the business, profession,
or occupation so advertised. [Ord. No. 11-72,
§9, 5 Sept. 1972]
Sec. 721.09 Application. All applicants for
licenses requiring apporval by the City Council
shall submit application to the City Treasurer
not less than two weeks prior to regula meeting
of the Council, at which time the application is
to be considered. Reasonable time shall be
allowed following filling of application for propr
investigation prior to issuance of license, but
application shall not be subjected to unnecessary
hardship in obtaining license. [Ord. No. 11-72,

Sec. 721.10
(A) License Year. All occupational licenses
shall be sold by the City Treasurer beginning
September 1 of each year and shall be due and
payable on October 1 of each year and shall
expire on September 30 of the succeeding year.
Licenses issues to any new business, profession
or occupation after March 1 of each year shall
be one-half of the license fee for one year,
unless otherwise hereinafter specifically
provided.
(B) Renewal. Those licenses not renewed by
October 1 shall be considered delinquent and
subject to a delinquency penalty of ten per cent

(10%) for the month of October, plus an
additional five per cent (5%) penalty for
each month of delinquency thereafter until
paid; provided that the total delinquent
penalty shall not exceed twenty-five per cent
(25%) of the occupational license fee for
the delinquent establishment.
(C) Penalties. Any person engaging in
or managing any business, occupation or
profession without first obtaining a City
of Cape Canaveral occupational license, shall
pay a penalty of twenty-five per cent (25%)
of the license determined to be due, in
addition to any other penalty provided by
law or ordinance.

Sec. 721.11 Schedule of Rates. The amount
of occupational license tax levied and imposed
upon every person who shall engage in or
manage any business, profession, privilege
or occupation hereinafter mentioned, within
the City of Cape Canaveral, is hereby
fixed, determined and imposed at the following
rates or amounts:

Sec. 721.04 Form, Signing. The City Treasurer
shall prescribe the form of all licenses and
applications therefor, except as otherwise
provided by ordinance, all licenses shall be
by the City Treasurer and shall be invalid for

Sec. 721.05 Separate Licenses. A separate
license shall be obtained for each place of
business conducted, operated, maintained or
carried on by every person engaged in any
occupation, calling, trade, or enterprise, for
which a license is required by the ordinance

Sec. 721.06 Transfer by Sale. All occupational
licenses may be transferred to a new owner when
there is a bona fide sale of the business, upon
payment of a transfer fee of three ($3.00)
dollars and presentation of evidence of the sale

request and presentation of the original license,
any license may be transfered from one location

No license shall be issued to any contractor,
general or otherwise, unless the applicant there-
for shall first present to the City a certificate
showing said applicant to be insured for general
tort liability in the amount of not less than
$10,000 to any person, $20,000 for any one
accident, and $5,000 property damage. Any
cancellations of insurance shall automatically
act as a revocation of said occupation license.
No license shall be issued to any contractor,
general or otherwise, unless the applicant
therefor shall first present a current Certifi-
cate of Competency issued by Brevard County
showing said applicant to be a qualified
contractor in good standing regarding the class
in which he is applying for license.

No occupational license as general contractor,

assigned or transferred from one person to

(A) Any person entitled to exemption under
the laws of the State of Florida shall be exempt
from the payment of a license tax to the City
of Cape Canaveral; however, in no case shall a
person be exempt from a payment of the occupa-
tional license tax which is in excess of Fifty
dollars ($50) . The laws of the State of Florida
shall govern such exemptions. Applicant for
exemption shall make affidavit that total

part of the occupational license required here-
under, if such license requirement pertains to
a charitable or civic organization, sponsored
event or program, but only upon written applica-
tion two (2) weeks prior to any regular meeting
of the City Council.

Sec. 721.13 Monthly Report. The City Treasurer
shall report to the Florida Department of Revenue
monthly on such forms as prescribed and provided
by the Department the amount of tax received

Sec. 721.14 County Tax Collector May Collect
Tax. If the governing body of Brevard County,
Florida, has levied an occupational license tax
or subsequently levies such a tax, the Tax
Collector of Brevard County, Florida, may issue
the Cape Canaveral licenses and collect the tax
thereon for the City of Cape Canaveral, Florida.

§ 721.15 OCC. LICENSES § 721.19
Sec. 721.15 Businesses not Specifically
Designated. Every business, occupation, profession,
or exhibition, substantial, fixed, or temporarily
engaged in by any person, firm or corporation,
whether in a building, or tent, or upon the
street, vacant lot, or anywhere within the City
and not herein specifically designated, shall
pay a license fee of twenty-five ($25) dollars.

Sec. 721.16 Enforcement. The City Manager
of the City of Cape Canaveral be and is hereby
empowered to employ such clerical and other help
as shall be necessary to fully enforce the provi-
sions of this chapter and to direct the Police
Department to assist in the enforcement thereof.

Sec. 721. 17 Record of Licenses Issued. The
City Treasurer shall keep a complete and perfect
record of all licenses issued, showing the nature
of the license, its date, expiration and to whom

Sec. 721.18 Display of Licenses. All licenses
granted by the City shall be carefully preserved
and displayed in a conspicuous place in the places
of business authorized to be conducted by said
licenses, except that persons not having a
permanent place of business in the City shall
carry such license or copy thereof on their
person while doing business within the City.

(A) Each day of sale or disposal of merchandise
or engaging in business or occupation without
complying with this chapter shall constitute a

Sec. 721.02. DEFINITIONS. The definitions of the terms
and phrases as set forth in Section 203. 22, Florida Statutes, as amended
by Chapter 72-306, Laws of Florida, 1972, are hereby incorporated into

this Chapter by reference and such terms and phrases when used in this
Chapter shall have the meaning designated to them accordingly. [Ord. No.

Sec.721.03. TAX LEVIED. The City of Cape Canaveral,
Florida, does hereby levy and impose an occupational license tax for the
privilege of engaging in or managing any business, profession or occupation
within its jurisdiction. Such occupational license tax is levied on:
(A) Any person who maintains a permanent business
location or branch office within the City of Cape Canaveral for
the privilege of engaging in or managing any business within
its jurisdiction; and
(B) Any person who maintains a permanent business
location or branch office within the City of Cape Canaveral for
the privilege of engaging in or managing any profession or
occupation within its jurisdiction; and
(C) Any person who does not qualify under the provisions
of (A) and (B) above and who transacts within the City of Cape
Canaveral any business or engages in any occupation or
profession in interstate commerce where such license tax is not
prohibited by Section 8 of Article I of the United States
Constitution.
Such occupational license shall be issued to each person
upon payment of the occupational license tax provided in this Ordinance and
upon full compliance with all requirements or conditions specified under the

Sec. 721.04. FORM, SIGNING. The City Treasurer shall
prescribe the form of all licenses and applications therefor, except as other-
wise provided by ordinance, all licenses shall be signed by the City
Treasurer and shall be invalid for all purposes unless so signed. [Ord. No.

Sec. 721.05. SEPARATE LICENSES. A separate license
shall be obtained for each place of business conducted, operated, maintained

or carried on by every person engaged in any occupation, calling, trade
or enterprise, for which a license is required by the ordinance of the City.

Sec. 721.06. TRANSFER BY SALE. All occupational
licenses may be transferred to a new owner when there is a bona fide sale
of the business, upon payment of a transfer fee of three ($3. 00) dollars and
presentation of evidence of the sale and the original license. [Ord. No. 11-72, §7,

Sec. 721.07. TRANSFER, LOCATION. Upon written
request and presentation of the original license, any license may be trans-
ferred from one location to another'location within the City, upon payment
of a transfer fee of three ($3. 00) dollars. [Ord. No. 11-72, §8, 5 Sept. 1972]
Sec. 721.08. EVIDENCE OF DOING BUSINESS. The
advertisement of any business, profession or occupation, by sign, news-
paper, magazine, or otherwise, shall be conclusive evidence of the
engaging in and carrying on in the City of Cape Canaveral, Florida, of the
business, profession, or occupation so advertised. [Ord. No. 11-72, §9, 5 Sept. 1972]
Sec, 721.09. APPLICATION. All applicants for licenses
requiring approval by the City Council shall submit application to the City
Treasurer not less than two weeks prior to regular meeting of the Council,
at which time the application is to be considered. Reasonable time shall be
allowed following filing of application for proper investigation prior to
issuance of license, but applicant shall not be subjected to unnecessary
hardship in obtaining license. [Ord. No. 11-72, §10, 5 Sept. 1972]
Sec. 721.10. (a) License Year. All occupational licenses
shall be sold by the City Treasurer beginning September 1st of each year
and shall be due and payable on October 1st of each year and shall expire
on September 30th of the succeeding year. Licenses issued to any new
business, profession or occupation after March 1st of each year shall be
one-half of the license fee for one year, unless otherwise hereinafter
specifically provided.
(b) Renewal. Those licenses not renewed by
October 1st shall be considered delinquent and subject to a delinquency

penalty of ten per cent (10%) for the month of October, plus an additional
five per cent (5%) penalty for each month of delinquency thereafter until
paid; provided that the total delinquency penalty shall not exceed twenty-
five per cent (25%) of the occupational license fee for the delinquent
establishment.
(c) Penalties. Any person engaging in or
managing any business, occupation or profession without first obtaining a
City of Cape Canaveral occupational license, shall pay a penalty of twenty-
five per cent (25%) of the license determined to be due, in addition to any
other penalty provided by law or ordinance.

Sec. 721.11. SCHEDULE OF RATES. The amount of
occupational license tax levied and imposed upon every person who shall
engage in or manage any business, profession, privilege or occupation
hereinafter mentioned, within the City of Cape Canaveral, is hereby
fixed, determined and imposed at the following rates or amounts:

of taking out a license as required by this ordinance

No license shall be issued to any contractor, general or
otherwise, unless the applicant therefor shall first
present to the City a certificate showing said applicant to
be insured for general tort liability in the amount of not
less than $10, 000. 00 to any person, $20, 000. 00 for any
one accident, and $5, 000. 00 property damage. Any
cancellations of insurance shall automatically act as a
revocation of said occupation license. No license shall
be issued to any Contractor, general or otherwise unless
the applicant therefor shall first present a current
Certificate of Competency issued by Brevard County show-
ing said applicant to be a qualified contractor in good
standing regarding the class in which he is applying for
license.
License re-assignment:
No occupational license as general contractor, master
electrician, tourney man electrician, master plumber, or
journeyman plumber may be assigned or transferred from
one person to another.
CONTRACTORS DEFINED:
Any person, firm, or corporation accepting or offering to
accept orders or contracts for doing any work on or in any
building or structure requiring the use of paint, stone,
brick, mortar, cement, wood, wallpaper, structural iron
or steel, sheet iron, galvanized iron, metallic piping, tin,
lead, or other metal or any other building material; or
accepting or offering to accept orders or contracts to do
any paving or curbing on sidewalks or streets, public or
private property, requiring the use of asphalt, brick, stone,
cement, wood, or any composition; or acceptin or offering
to accept orders or contracts to excavate earth, rock or
material for foundations or any other purpose; or accepting
or offering to accept orders or contracts to construct any
sewer of stone, brick, concrete, terra cotta, or other
material; or accepting or offering to accept orders or
contracts for building, remodeling, repairing, wrecking,
razing, or demolishing any structure; or for moving any
building; or for the installation, maintenance, or repair of
neon signs, or air conditioning apparatus or equipment;
shall be deemed a contractor, whether such work is done or
offered to be done by day labor, general contract, or sub-
contract.
Any person, firm, or corporation engaging in the business
of accepting or offering to accept orders or contracts for
doing any work on or in any building or premises involving
erecting, installing, altering, repairing, servicing or
maintaining electric wiring, devices, or appliances
permanently connected to such wiring; or the correcting,
repairing or maintaining of lines, shall be deemed to be an
electrical contractor.

Any person, firm, or corporation engaged in the business
of plumber or steam fitter shall be deemed to be a
contractor.
Every person engaged in the business of erecting a building
or buildings for the purpose of selling or renting the same,
and making no contract with a duly licensed contractor for
the erection of said building or buildings,whether or not
such person contracts with one or more duly licensed
contractors for one or more portions, but does not contract
with any one person for all of the work of erecting any one
of said buildings, shall be deemed to be a contractor if he
shall build more than one single family residence in any one
year.

parcel checking lockers and toilet locks, used in rail-
road, bus, airport stations, or depots, and in hotels,
boarding houses, restaurants and rest rooms for the
convenience of, and in rendering services to the
public.

Sec. 721.12 EXEMPTIONS. (A) Any person entitled to
exemption under the laws of the State of Florida shall be exempt from the
payment of a license tax to the City of Cape Canaveral; however, in no
case shall a person be exempt from a payment of the occupational license
tax which is in excess of Fifty dollars ($50. 00). The laws of the State of
Florida shall govern such exemptions. Applicant for exemption shall
make affidavit that total exemption, for all municipal licenses, does not
exceed Fifty ($50. 00) dollars.
(B) Nothing in this ordinance shall be construed as inter-
fering with regulating or taxing any person in business against whom the
right of taxation has already been preempted by the State of Florida; nor
as giving to any person the right to obstruct the streets, sidewalks or
other public places in the City.
(C) Nothing in this ordinance shall be construed to require
any farmer to procure a license to sell vegetables or fruits within the
City, if such vegetables or fruits are the produce of his own farm located
(SEE SECTION 205 . 181, FLORIDA STATUTES)
within the State of Florida.
(D) The City Council may waive all or any part of the
occupational license required hereunder, if such license requirement
pertains to a charitable or civic organization, sponsored event or program,
but only upon writtenapplication two (2) weeks prior to any regular meeting
of the City Council.

Sec. 721.13. MONTHLY REPORT. The City Treasurer
shall report to the Florida Department of Revenue monthly on such forms
as prescribed and provided by the department the amount of tax received

Sec. 721.14. COUNTY TAX COLLECTOR MAY COLLECT
TAX. If the governing body of Brevard County, Florida, has levied an
occupational license tax or subsequently levies such a tax, the Tax

Collector of Brevard County, Florida, may issue the Cape Canaveral
licenses and collect the tax thereon for the City of Cape Canaveral,

Sec. 721.15. BUSINESSES NOT SPECIFICALLY
DESIGNATED. Every business, occupation, profession, or exhibition,
substantial, fixed, or temporarily engaged in by any person, firm or
corporation, whether in a building, or tent, or upon the street, vacant
lot, or anywhere within the City and not herein specifically designated,
shall pay a license fee of twenty-five ($25.00) dollars. [Ord. No. 11-72, §16, 5 Sept. 1972]
Sec. 721.16. ENFORCEMENT. The City Manager of
Cape Canaveral be and is hereby empowered to employ such clerical and
other help as shall be necessary to fully enforce the provisions of this
Chapter and to direct the Police Department to assist in the enforcement

Sec. 721.17. RECORD OF LICENSES ISSUED. The City
Treasurer shall keep a complete and perfect record of all licenses issued,
showing the nature of the license , its date, expiration and to whom issued.

Sec. 721.18. DISPLAY OF LICENSES. All licenses
granted by the City shall be carefully preserved and displayed in a conspic-
uous place in the places of business authorized to be conducted by said
licenses, except that persons not having a permanent place of business in
the City shall carry such license or copy thereof on their person while

Sec. 721.19 PENALTIES. (A) Each day of sale or disposal
of merchandise or engaging in business or occupation without complying
with this Chapter shall constitute a separate and distinct violation of
such ordinance.

BE IT ORDAINED by the City Council of the City of Cape Canaveral, Florida,

SECTION 1. Chapter 721 of the City code of the City of Cape Canaveral, Florida,
is hereby repealed in its entirety and replaced with the following Chapter:
CHAPTER 721
OCCUPATIONAL LICENSES
Sec. 721.01 Short Title. This chapter shall be known and may be cited as the
"City of Canaveral Occupational License Tax".
Sec. 721.02 Definitions. The definitions of the terms and phrases as set
forth in Section 205.22, Florida Statutes, Laws of Florida, 1979, are hereby in-
corporated into this chapter by reference and such terms and phrases when used
in this chapter shall have the meaning designated to them accordingly.
Sec. 721.03 Tax Levied. The City of Cape Canaveral, Florida, does hereby
levy and impose an occupational license tax for the privilege of engaging in or
managing any business, profession or occupation within its jurisdiction. Such
occupational license tax is levied on:
(A) Any person who maintains a permanent business location or branch office
within the City of Cape Canaveral for the privilege of engaging in or managing any
business within its jurisdiction; and
(B) Any person who maintains a permanent business location or branch office
within the City of Cape Canaveral for the privilege of engaging in or managing any
profession or occupation within its jurisdiction; and
(C) Any person who does not qualify under the provisions of (A) and (B) above
and who transacts within the City of Cape Canaveral any business or engages in any
occupation or profession in interstate commerce where such license tax is not pro-
hibited by Section 8 of Article I of the United State Constitution.
Such occupational license shall be issued to each person upon payment of the
occupational license tax provided in this ordinance and upon full compliance with
all requirements or conditions specified under the classification requested.
Sec. 721.04 Form, Signing. The City Treasurer shall prescribe the form of
all licenses and applications therefor, except as otherwise provided by ordinance,
all licenses shall be signed by the City Treasurer and shall be invalid for all
purposes unless so signed.
Sec. 721.05 Separate Licenses. A separate license shall be obtained for each
place of business and for every business conducted, operated, maintained or carried
on by every person engaged in any occupation, calling, trade, or enterprise, for
which a license is required by the ordinance.
Sec. 721.06 Transfer by Sale. All occupational licenses may be transferred
to a new owner when there is a bona fide sale of the business, upon payment of a
transfer fee of three ($3.00) dollars and presentation of evidence of the sale
and the original license.

profession or occupation, by sign, newspaper, magazine, or otherwise, shall be
conclusive evidence of the engaging in and carrying on in the City of Cape Canaveral,
Florida, of the business, profession, or occupation so advertised.
Sec. 721.09 Application. All applicants for licenses requiring approval by
the City Council shall submit application to the City Treasurer not less than two
weeks prior to workshop meeting of the Council, at which time the application is
to be considered. Reasonable time shall be allowed following filing of application
for proper investigation prior to issuance of license, but applicant shall not be
subjected to unnecessary hardship in obtaining license.
Sec. 721.10
(A) License Year. All occupational licenses shall be sold by the City
Treasurer beginning September 1 of each year and shall be due and payable on
October 1 of each year and shall expire on September 30 of the succeeding year.
Licenses issued to any new business, profession or occupation after March 1 of
each year shall be one-half of the license fee for one year, unless otherwise
hereinafter specifically provided.
(B) Delinquent Licenses. Those licenses not renewed by October 1 shall
be considered delinquent and subject to a delinquency penalty of ten per cent
(10%) for the month of October, plus an additional five per cent (5%) penalty
for each month of delinquency thereafter until paid; provided that the total,
delinquent penalty shall not exceed twenty-five per cent (25%) of the occupa-
tional license fee for the delinquent establishment.
(C) Penalties. Any person engaging in or managing any business, occupation
or profession without first obtaining a City of Cape Canaveral occupational lic-
ense, shall pay a penalty twenty-five per cent (25%) of the license determined
to be due, in addition to any other penalty provided by law or ordinance.
Sec721.11 Schedule. of Rates. The amount of occupational license tax levied
and imposed upon every person who shall engage in or manage any business, pro-
fession, privilege or occupation hereinafter mentioned, within the City of Cape
Canaveral, is hereby fixed, determined and imposed a.t the following rates or

City a certificate showing said applicant to be insured for general
tort liability in the amount of not less than $10,000 to any person,
$20,000 for any one accident, and $5,000 property damage. Any can-
cellations of insurance shall automatically act as a revocation of
said occupation license. No license shall be issued to any contrac-
tor, general or otherwise, unless the applicant therefore shall first
present a current Certificate of Competency issued by Brevard County
or the State of Florida, showing said applicant to be a qualified
contractor in good standing regarding the class in which he is apply-
ing for license.
' License reassignment:
No occupational license as general contractor, master electrician,
journeyman electrician, master plumber, or journeyman plumber may
be assigned or transferred from one person to another.
CONTRACTORS DEFINED:
Any person, firm, or corporation accepting or offering to accept
orders or contracts for/doing work on or in any building or
structure requiring the use of paint, stone, brick, mortar, cement,
wood, wallpaper, structural iron or steel, sheet iron, galvanized
iron, metallic piping, tin, lead, or other metal or any other build-
ing material; or accepting or offering to accept orders or contracts
to do any paving or curbing on sidewalks or streets, public or private

for building, remodeling, repairing, wrecking, razing, or demolish-
ing any structure; or for moving any building; or for the instal-
lation, maintenance, or repair of neon signs, or air conditioning
apparatus or equipment; shall be deemed a contractor, whether such
work is done or offered to be done by day labor, general contract,
or subcontract.
Any person, firm, or corporation engaging in the business or accept-
ing or offering to accept orders or contracts for doing any work on
or in any building or premises involving erecting, installing, alter-
ing, repairing, servicing or maintaining electric wiring, devices, or
appliances permanently connected to such wiring; or the correcting,
repairing or maintaining of lines, shall be deemed to be an electrical
contractor.
Any person, firm, or corporation engaged in the business of plumber or
steam fitter shall be deemed to be a contractor.
Every person engaged in the business of erecting a building or bui.I.dings
for the purpose of selling or renting the same, and making no contract
with a duly licensed contractor for the erection of said building or
buildings, whether or not such person contracts with one or more duly
licensed contractors for one or more portions, but does not contract
with any one person for all of the work of erecting any one of said

SELLING NOT SPECIFICALLY COVERED
Persons selling magazines, Bibles, encyclopedias,
cosmetics, kitchenwares, etc. , and other door-to-door
salesmen, shall pay tax of $31.25, except that those re-
presenting charitable organizations which are recognized
as such by the City shall not pay a license tax, but
shall register with the City Clerk.
Sec. 721.12 Exemptions.
(A) Any person entitled to exemption under the laws of the
State of Florida shall be exempt from the payment of a license tax
to the City of Cape Canaveral; however, in no case shall a person
be exempt from a payment of the occupational license tax which is
in excess of Fifty dollars ($50)(Ok per Joe Scott) . The laws of the State of Florida
shall govern such exemptions. Alpplicant for exemption shall make
affidavit that total exemption, /for all municipal licenses, does

(B) Nothing in this ordinance shall be construed as interfering
with regulating or taxing any person in business against whom the right
of taxation has already been pre-empted by the State of Florida; nor
as giving to any person the right to obstruct the streets, sidewalks or
other public places in the City.
(C) Nothing in this ordinance shall be construed to require any
farmer to procure a license to sell vegetables or fruits within the City,
if such vegetables or fruits are the produce of his own farm located
within the State of Florida.
(D) The City Council may waive all or any part of the occupational
license required hereunder, if such license requirement pertains to a
charitable or civic organization, sponsored event or program, but only
upon written application two (2) weeks prior to any regular meeting of
the City Council.
Sec. 721.13 Monthly Report. The City Treasurer shall report to
the Florida Department of Revenue monthly on such forms as prescribed
and provided by the Department the amount of tax received by class.
Sec. 721.14 County Tax Collector May Collect Tax. If the govern-
ing body of Brevard County, Florida, has levied an occupational tax or
subsequently levies such a tax, the Tax Collector of Brevard County,
Florida, may issue the Cape Canaveral licenses and collect the tax there-
on for the City of Cape Canaveral, Florida, if the City so desires and
shall indicate such desire by Resolution.
Sec. 721.15 Business not Specifically Designated. Every business,
occupation, profession, or exhibition, substantial, fixed, or temporarily
engaged in by any person, firm or corporation, whether in a building, or
tent, or upon the street, vacant lot, or anywhere within the City and not
herein specifically designated, shall pay a license fee of $31.25 ($31.25)
dollars.
Sec. 721.16 Non Renewal of License.
(A) In the event that the City Treasurer determines that an Occupational
License should not be renewed and that determination is based upon demonstrated
violations of the City Ordinances and the concerned business has received thirty
(30) days written notice by Certified Mail indicating the violation and the in-
tention to withold renewal of the Occupational License, then the City Treasurer
may withold renewing the license.
(B) If the Occupational License is not renewed, the concerned business
may request an administrative review of the non-renewal within fifteen (15)
days of the renewal date. The City Manager shall then establish a date for an
Administrative Hearing before the City Manager, acting as the Administrative
Officer. The hearing shall be held within fifteen (15) days of the request and
with all attempts made to set the hearing date on a date as convenient to the
Appellant as possible.
At the Administrative Hearing, the Hearing shall present a list of viola-
tions to the Appellant. This list of violations shall be the same as those
previously listed in the notice to the Appellant. The Appellant may be repre-
sented by counsel of his choosing. The Appellant may cross-examine any witness
relied on by the City and may bring forward any witness to dispute the City's
statement:. Rules of evidence will not be strictly enforced, but Rules of Order
will be followed. All proceedings shall be open and recorded.
The Administrative Hearing Officer shall render his decision within five
(5) days. The decision shall be in writing stating the reasons for his deci-
sion. If the Appellant does not agree with the Administrative Hearing Officer,
he shall have fifteen (15) days in which to appeal his decision to the Board
of Appeals.
The Board of Appeals shall establish a hearing date within twenty (20)
days of the notice. At that time, the Board 'shall review the Administrative
Hearing Officer's decision under the same rules governing the Administrative
Hearing. The Board of Appeals decision shall be final. The Board of Adjust-
ment shall act as the Board of Appeals under this Ordinance.
During the Appeals procedure, the Appellant can operate his business
under the old license, pending final determination.

Sec. 721.17 Enforcement. The City Manager of the City of Cape Canaveral
be and is hereby empowered to employ such clerical and other help as shall be
necessary to fully enforce the provisions of this chapter and to direct the
Police Department to assist in the enforcement thereof.
Sec.. 721.18 Record of Licenses Issued. The City Treasurer shall keep a
complete and perfect record of all licenses issued, showing the nature of the
license, its date, expiration and to whom issued.
Sec. 721.19 Display of Licenses. All licenses granted by the City shall
be carefully preserved and displayed in a conspicuous place in the places of
business authorized to be conducted by said licenses, except that persons not
having a permanent place of business in the City shall carry such license or
copy thereof on their person while doing business within the City.
Sec. 721.20 Penalty.
(A) Each day of sale or disposal of merchandise or engaging in business
or occupation without complying with this chapter shall constitute a separate
and distinct violation of such ordinance.
(B) Any person violating any of the provisions of this chapter shall be
punished as provided in 801.02.
SECTION 2. All portions of the code in conflict herewith are hereby repealed.
SECTION 3. This Ordinance will take effect October 1, 1981.
