ORDINANCE NO. 9-91
AN ORDINANCE OF THE CITY OF CAPE CANAVERAL, BREVARD
COUNTY, FLORIDA, AMENDING CHAPTER 685, PARKING
REGULATIONS; TO ADD A SECTION CONCERNING NO OVERNIGHT
PARKING BETWEEN THE HOURS OF 10 : 00 P.M. AND 5 : 00 A.M. ; TO
ADD A DEFINITIONAL SECTION; PROVIDING A SEVERABILITY
CLAUSE; AND, PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the City Council of the City of Cape
Canaveral, Brevard County, Florida, as follows:
SECTION 1. Chapter 685, Parking Regulations, is hereby
amended by renumbering Section 685.05, Penalties, to Chapter
685 . 06, Penalties.
SECTION 2 . Section 685 .05 of the City Code is hereby
repealed in its entirety and the following in substitution in lieu
thereof:
Section 685.05 No Overnight Parking. It shall be
unlawful for any vehicle to park on any of the beach end
streets east of Ridgewood Avenue between the hours of
10 : 00 p.m. and 5 :00 a.m. , and any such parking shall be
ticketed as a violation of this Chapter. For the
purposes of this Section, a beach end street shall be
defined as a street within the City of Cape Canaveral
that has as its east terminus the Atlantic Ocean and/or
the dune line which runs north and south parallel to the
Atlantic Ocean. [Ord. No. 9-91, §2, 2 Jul 91]
SECTION 3 . If any provision, paragraph, word, section, or
article of this ordinance is invalidated by any court of competent
jurisdiction, the remaining provisions, paragraphs, words, sections
and articles shall not be affected and shall continue in full force
and effect.
SECTION 4 . All ordinances and parts of ordinances
inconsistent or conflicting with any part of this ordinance are
hereby repealed to the extent of such inconsistency or conflict.
SECTION 5. This ordinance shall take effect immediately
upon its adoption.
ADOPTED by the City Council of the City of Cape Canaveral,
Florida this 2nd day of July , 1991.

PARKING REGULATIONS
Sec. 685.01 Parking Regulations. Section 316.1945
of the Florida Statutes, " 1981 " , is hereby adopted as
the Parking Regulations for the City of Cape Canaveral,
Florida. [Ord. No. 22-76 , § 1 , 18 Jan 77 ; Ord. No.

Sec. 685 .02 Establishing of No Parking Zones. The
chief law enforcement officer may establish No Parking
Zones and designate those places where motor vehicles
are prohibited from parking and have placed No Parking

Sec. 685 .03 Dune Parking Prohibited. It shall be
unlawful for any vehicle to park on any of the ocean
dunes and any such parking may be ticketed as a viola-

Sec. 685.04 Truck Parking. It shall be unlawful
for any truck weighing 5 , 000 pounds or more to park
anywhere within the City of Cape Canaveral, Florida,
for more than four ( 4 ) consecutive hours, where so

the Parking Regulations for the City of Cape Canaveral,

Dear Mr. Scott,
On June 19, 1984, Governor Graham signed into law a bill which allows local
governments to raise the maximum fine for illegal parking in spaces reserved
for the physically disabled from $15 to $100.
The Space Coast Association of the Physically Handicapped (SCAPH) has found
that thoughtless, able-bodied persons continue to use parking spaces designed
for disabled persons in the Brevard County area. This not only causes a great
deal of inconvenience to the disabled person, but precludes him/her from both
accessing public services and patronizing many commercial establishments in
our area.
The SCAPH strongly requests that the City of Cape Canaveral consider raising
the fine for illegal parking in spaces reserved for the handicapped to One
Hundred Dollars, a level which would provide a substantial deterrent to pros-
pective violators.
Thank you for your continuing interest and support of the physically limited
citizens of Brevard County.

316.194 Stopping, standing or parking out-
side of municipalities.-
(1) Upon any highway outside of a municipality,
no person shall stop, park, or leave standing any ve-
hicle, whether attended or unattended, upon the
paved or main-traveled part of the highway when it is
practicible to stop, park, or so leave the vehicle off
such part of the highway; but in every event an unob-
structed width of the highway opposite a standing ve-
hicle shall be left for the free passage of other vehi-
cles, and a clear view of the stopped vehicle shall be
available from a distance of 200 feet in each direction
upon the highway.
(2) This section shall not apply to the driver or
owner of any vehcile which is disabled while on the
paved or main-traveled portion of a highway in such
manner and to such extend that it is impossible to
avoid stopping and temporaily leaving the disabled
vehicle in such position, or to passenger-carrying bus-
es temporarily parked while loading or discharging
passengers, where highway conditions render such
parking off the paved portion of the highway hazard-
out or impractical.
(3)(a) Whenever any police office finds a vehicle
standing upon a highway in violation of any of the
foregoing probisions of this section, the officer is au-
thorized to move the vehicle, or require the driver or
other persons in charge of the vehicle to move the
same, to a position off the paved or main-traveled
part of the highway.
(B) Officers are hereby authorized to provide for
the removal of any abandoned vehicle to the nearest
garage of other place of safety, cost of such removal
to be a lien against motor vehicle, when said aban-
doned vehicle is found unattended upon a bridge or
causeway or in any tunnel, or on any public highway
in the following instances:
1. Where such vehicle constitutes an obstruction
of traffic;
2. Where such vehicle has been parked or stroed
on the public right-of-way for a period exceeding 48
hours, in other than designated parking areas, and is
within 30 feet of the pavement edge; and
3. Where an operative vehicle has been parked or
stored on the public right-of-way for a period exceed-
ing 10 days in other than designated parking areas,
and is more than 30 feet from the pavement edge.
However, the agency removing such vehicle shall be
required to report same to the Department of High-
way Safety and Motor Vehicles within 24 hours of
such removal.
(c) Any vehicle moved under the provisions of
this chapter which is a stolen vehicle shall not be sub-
ject to the provisions hereof unless the moving au-
thority has reported to the Florida Highway Patrol
the taking into possession of the vehicle within 24
hours of the moving of the vehicle.

316.1945 Stopping, standing, or parking pro-
hibited in specified places.-
(1) Except when necessary to avoid conflict with
other traffic, or in compliance with law or the direc-
tions of a police officer or other official traffic control de-
vice, no person shall:
(a) Stop, stand or park a vehicle:
1. On the roadway side of any vehicle stopped or
parked at the edge or curb of a street;
2. On a sidewalk;
3. Within an intersection;
4. On a crosswalk;
5. Bewteen a safety zone and the adjacent curb or
within 30 feet of points on the curb immediately op-
posite the ends of a safety zone, unless the 'Division
of Road Operations of the Deaprtment of Transpor-
tation indicates a different length by signs or mark-
ings;
6. Alongside or opposite any street excavation or
obstruction when stopping, standing, or parking
would obstruct traffic;
7. Upon any bridge or other elevated structure
upon a highway or within a highway tunnel;
8. On any railroad tracks;
9. At any place where official signs prohibit stop-
ping.
(b) Stand or park a vehicle, whether occupied or
not, except momentarily to pick up to discharge a
passenger or passengers:
1. In front of a public or private driveway;
2. Within 15 feet of a fire hydrant;
3. Within 20 feet of a crosswalk at an intersec-
tion;
4. Within 30 feet upon the approach to any flash-
ing signal, stop sign, or traffic control signal located
at the side of a roadway;
5. Within 20 feet of the driveway entrance to any
fire station and on the side of a street opposite the
entrance to any fire station within 75 feet of said en-
trance (when property signposted);
6. At any place where official signs prohibit
standing.
(c) Park a vehicle, whether occupied or not, ex-
cept temporarily for the purpose of, and while actual-
ly engaged in, loading or unloading merchandise or
passengers:
1. Within 50 feet of the nearest rail of a railroad
crossing unless the Department of Transporation es-
tablishes a difference distance due to unusual circum-
stances;
2. At any place where official signs prohibit park-
ing.
(2) No person shall move a vehicle not lawfully
under his control into any such prohibited area or
awat from a curb such a distance as is unlawful.
(3) A law enforcement officer or parking enforce-
ment specialist who discovers a vehicle parked in vio-
lation of this section or a municipal or county ordi-
nance may:
(a) Issue a ticket form as may be used by a politi-
cal subdivision or municipality to the driver; or
(b) If the vehicle is unattended, attach such tick-
et to the vehicle in a conspicuous place, except that
the uniform traffic citation prepared by the depart-
ment pursuant to s. 316.650 shall not be issues by be-
ing attached to an unattended vehicle.
The uniform traffic citation prepared by the depart-

ment pursuant to s. 316.650 shall not be issued for vi-
olation of a municipal or county parking ordinance.

316.195 Additional parking regulations.-
(1) Except as otherwise provided in this section,
every vehicle stopped or parkined upon a two-way
roadway shall be so stopped or parked with the
right-hand wheels parallel to and within 12 inches of
the right-hand curb or edge of the roadway.
(2) Except when otherwise provided by local or
dinance, every vehicle stopped or parked upon a
one-way roadway shall be so stopped or parked paral-
lel to the curb or edge of the roadway, in the direction
of authorized traffic movement, with its right-hand
wheels within 12 inches of the right-hand curb or
edge of the roadway, or its left wheels within 12 inch-
es of the left-hand curb or edge of the roadway.
(3) Local authorities may, by ordinance, permit
angle parking on any roadway, except that angle
parking shall not be permitted on any state road un-
less the Department of Transporation has deter-
mined by resolution or other entered in its minutes
that the roadway is of sufficient width to permit an-
gle parking without interfering with the free move-
ment of traffic.

316.1955 Parking spaces provided by gov-
ernmental agencies for certain disabled per-
sons.-
(1) Each state agency and political subdivision
having jurisdiction over street parking or publicly
owned and operated parking facilities shall provide a
minimum number of specially designed and marked
motor vehicle parking spaces for the exclusive use of
those severely physically disabled individuals with
permanent mobility problems which substantially
impair their ability to ambulate who have been is-
sued and exception entittlement parking permit pur-
suant to s. 320.0848.
(2) The following miminum number of such park-
ing spaces shall be provided:
(a) One space in the immediate vicinity of a
building which houses a governmental entity or a po-
litical subdivision, including, but not limited to, state
office buildings and courthouses, if no parking for the
public is provided on the premises of such building;
(b) One space for each 150 metered onstreet
parking spaces; and
(c) For publicly maintained and operated parking
facilities intended for public sue and not subject to
paragraph (a), 1 parking space for disabled persons
for the first 20 parking spaces or fraction thereof, 1
addutional parking space for disabled persons for the
next 80 parking spaces or fraction thereon, 1 addi-
tional parking space for disabled persons for each 100
parking spaces or fraction thereof after the first 100
parking spaces, up to a total of 1,000 parking spaces,
and 1 additional parking space for disabled persons
for each 500 parking spaces or fraction thereof after
the first 1,000 parking spaces. A minimum of four
parking spaces for disabled persons shall be provided
at physical restoration rehabilitation centers and
hospitals.
(3) Such parking spaces shall be designed and lo-
cated as follows:
(a) All spaces shall have accessible thereto a
curb-ramp or curb-cut, when necessary to allow ac-
cess to the building served, and shall be located so
that users will not be compelled to wheel behind
parked vehicles.
(b) Diagonal or perpendicular parking spaces
shall be a minimum of 12 feet wide.
(c) Parallel parking spaces shall be located either
at the beginning or end of a block or adjacent to alley
entrances. Curbs adjacent to such spaces shall be of a
height which will not interfere with the opening and
closing of motor vehicle doors.
(4) Each such parking space shall be prominently
outlined with paint and posted with a permanent
sign of a color and design approved by the Depart-
ment of Transporation, bearing the internationally
accepted wheelchair symbol and the caption "PARK-
ING BY DISABLED PERMIT ONLY."
(5) It is unlawful for any person to stop, stand, or
park a vehicle within any such specially designated
and marked parking space provided in accordance
with this section, unless such vehicle displays a park-
ing permit issues pursuant to s. 320.0848 and such
vehicle is transporting a person eligible for the park-
ing permit. Whenever a law enforcement officer or a
parking enforcement specialist finds a vehicle in vio-
lation of this subsection, that officer shall:
(a) Have the vehicle in violation removed to any
lawful parking space or facility to require the opera-
tor or other person in charge of the vehicle immedi-
ately to remove the unauthorized vehicle from the
parking space. Whenever any vehicle is removed by a
law enforcement officer, parking enforcement spe-
cialist, or agency to a storage lot, garage, or other safe,
parking space, the cost of such removal and parking
shall be a lien against the vehicle.
(b) Charge the operator or other person in charge
of the vehicle in violation with a noncriminal traffic
infraction, punishable as provided in s. 318.18(2).
However, any person who is chauffering a disabled
person shall be allowed, without need for an indentifi-
cation parking permit, momentary parking in any
such parking space, for the purpose of loading or un-
loading such disabled person. No penalty shall be im-
posed upon the driver for such momentary parking.

government entities for certain disabled per-
sons.-
(1) Any buisness, firm, or other person licensed to
do buisness with the public may provide specially de-
signed and marked motor vehicle parking spaces for
the exclusive use of physically disabled persons who
have been issued parking permits pursuant to s.
320.0848. The minimum number of such parking
spaces shall be as provied in s. 316.1955(2)(c).

AN ORDINANCE AMENDING CHAPTER 685 OF THE CITY CODE OF
THE CITY OF CAPE CANAVERAL, FLORIDA BY REPEALING CHAPTER
685 AND REPLACING IT WITH A NEW CHAPTER 685 "PARKING

BE IT ORDAINED by the City Council of the City of Cape

hereby amended by increasing the penalty for item #6 , Parking
in Handicapped Space, to-$109•. 9-0- *$50 . 00 ,
SECTION 2 . All portions of the Code in conflict herewith
are hereby repealed.
*SECTION 3 . All penalty fees shall be established by Resolution.
SECTION 4 . This Ordinance shall take effect immediately
upon its adoption.

AN ORDINANCE ESTABLISHING CHAPTER 685 OF THE CODE
OF THE CITY OF CAPE CANAVERAL, FLORIDA, BY ADOPT-
ING FLORIDA STATUTE 316. 160 AS THE PARKING REGULA-
TIONS FOR THE CITY OF CAPE CANAVERAL; BY AUTHOR-
IZING THE CHIEF OF POLICY TO DETERMINE WHERE
PARKING SHALL BE PROHIBITED AND TO CAUSE SIGNS TO
BE POSTED IN SUCH AREAS; BY PROHIBITING CERTAIN
TRUCKS FROM PARKING WITHIN THE CITY FOR MORE THAN
FOUR CONTINUOUS HOURS, WHERE POSTED; BY ESTABLISH-
ING PENALTIES FOR VIOLATION; BY REPEALING ALL
SECTIONS OF THE CODE IN CONFLICT HEREWITH; PROVID-

its adoption.
