ORDINANCE NO. 11-88
AN ORDINANCE AMENDING CHAPTER 672, "UTILITIES
DEPOSIT" , OF THE CODE OF ORDINANCES OF THE
CITY OF CAPE CANAVERAL , BREVARD COUNTY ,
FLORIDA; BY INCREASING THE AMOUNT OF UTILITY
DEPOSIT FOR RESIDENTIAL CUSTOMERS; REPEALING
ALL PORTIONS OF THE CODE IN CONFLICT HERE-
WITH; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the City Council of the City of Cape
Canaveral, Brevard County, as follows:
SECTION 1 . The Utilities Deposit Fee Schedule , Section
672.03 of the Code of Ordinances, is hereby amended as follows:
Sec. 672. 03 Fee Schedule.
A. Residential Customers $65. 00
SECTION 2 . All portions of the Code in conflict herewith
are hereby repealed.
SECTION 3 . This Ordinance shall become effective immediate-
ly upon its adoption .
ADOPTED BY the City Council of the City of Cape Canaveral,
Florida, this 6th day of September , 1988.

UTILITIES DEPOSIT
Sec. 672 . 01 Utilities Deposit Required. The City of
Cape Canaveral shall require a deposit for sewer and garbage
and trash collection services for all residential, commercial
and industrial accounts . [Ord. No. 13-84, § 1 , 17 July 1984]
Sec. 672 . 03 Fee Schedule. The deposit shall be based
upon the following schedule:
A. Residential Customers $ 65. 00
B. Commercial Customers $200 . 00
C. Industrial Customers:
1 . For new industrial customers whose monthly
sewage charges are based upon water consumption
at existing service location:
A deposit fee equivalent to a three months '
service period for sewer and garbage, plus
three months ' penalty charges. Monthly
charges are to be computed upon the average
monthly charge for the previous six month
period.
2 . For a new industrial customer at new service
locations :
A deposit fee equivalent to the sewage rate
for the estimated water consumption based upon
the Department of Environmental Regulations
Technical Information Memorandum, Sec. 6 .2 . 1 . ,
and the estimated garbage service multiplied by
three, plus three months penalty charges .
3 . This deposit fee may be recalculated after six
(6) months based upon actual sewage and garbage
service charges .
4 . In lieu of the cash deposit required for
industrial customers , the customer may post a
surety bond to the City of Cape Canaveral in an

MEMORANDUM
TO: MAYOR AND CITY COUNCIL
FROM: CITY MANAGER
The Legislative, in this last session, passed HB-506 relating
to municipal utility charges, which prohibits a municipality
from taking legal action to recover utility charges from the
owner of a rental unit, and even prohibits us from requiring
a contract which would make the property owners responsible
for these utility charges as a requirement for providing
service.
Chapter 672 of our Code establishes the deposit amount for
providing these services. We should consider raising the
deposit amount or increasing our rates to cover this possible
loss of revenue.

Sec. 672 . 05 Payment of Deposit. The deposit shall be
paid to the City Treasurer by the new customer upon occupancy.

Sec. 672 . 07 Termination of Services. The deposit shall
be returned to the depositor upon satisfaction of all out-
standing balances , upon termination of the service. [Ord.

Sec. 672 . 09 Refund of Deposit. Any deposit pursuant to
this Chapter shall be refunded to the customer upon the
satisfactory completion of twenty-four (24) months service

AN ORDINANCE ESTABLISHING CHAPTER 672,
"UTILITIES DEPOSIT" , OF THE CITY CODE
OF THE CITY OF CAPE CANAVERAL, FLORIDA;
REQUIRING A UTILITY DEPOSIT; REPEALING
ALL PORTIONS OF THE CITY CODE IN CONFLICT
HEREWITH; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Legislature of the State of Florida has
enacted legislation limiting the authority of the City to
collect delinquent Utility Accounts from new tenants and
landlords,
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Cape Canaveral, Florida, as follows :
SECTION 1. Chapter 672, "Utilities Deposit" , of the
City Code of the City of Cape Canaveral, Florida, is hereby
established as follows :
