AN ORDINANCE AMENDING CHAPTER 621 ,
FIRE PREVENTION CODE, OF THE CODE OF
ORDINANCES OF THE CITY OF CAPE
CANAVERAL, BREVARD COUNTY, FLORIDA,
BY ADOPTING THE LATEST EDITION OF THE
STANDARD CODE ; REPEALING ALL PORTIONS
OF THE CODE IN CONFLICT HEREWITH;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the City Council of the City of Cape
Canaveral, Brevard County, Florida, as follows:
SECTION 1 . Chapter 621 , Fire Prevention Code is hereby
amended by repealing Section 621 . 01 in it ' s entirety and replac-
ing with the following:
Sec. 621 . 01 Fire Prevention Code Adopted. The
following Code is hereby adopted by reference as though
it was copied herein fully: Standard Fire Prevention
Code - 1988 Edition, with 1989 Revisions, excluding
Appendixes.
SECTION 2 . All portions of the Code in conflict here-
with are hereby repealed.
SECTION 3 . This Ordinance shall take effect immediately
upon its adoption.
ADOPTED BY the City Council of the City of Cape Canaveral ,
Florida, this 6th day of March , 1990 .

AN ORDINANCE AMENDING CHAPTER 613, "PLUMB-
ING CODE" ; CHAPTER 614 , "MECHANICAL CODE" ;
CHAPTER 615, "GAS CODE" ; CHAPTER 619 ,
"HOUSING CODE" ; CHAPTER 620, "STANDARD CODE
FOR THE ELIMINATION OR REPAIR OF UNSAFE
BUILDINGS" CHAPTER 621, "FIRE PREVENTION
CODE" ; CHAPTER 625, "STANDARD EXCAVATION
AND GRADING CODE" ; CHAPTER 627, "STANDARD
SWIMMING POOL CODE" ; AND CHAPTER 628,
"STANDARD AMUSEMENT DEVICE CODE" BY ADOPTING
THE LATEST EDITIONS OF THE CODES; REPEALING
ALL PORTIONS OF THE CODE IN CONFLICT
HEREWITH; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council desires to adopt the latest
edition of the standard codes relating to inspection activities
within the City of Cape Canaveral, Florida, and enforcement of
building provisions as provided in said codes; and
WHEREAS, the adoption of these Codes is done to facilitate
proper inspection activities by the City of Cape Canaveral,
Florida, relating to construction and maintenance of buildings
within the corporate limits of said City and relating to public
safety, health and general welfare.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Cape Canaveral, Florida, as follows:
SECTION 1 . Chapter 613 , "Plumbing Code" , is hereby amended
by deleting Sections 613 . 01 and 613 . 02 in their entirety and
replacing with the following:
Sec. 613. 01 Standard Plumbing Code Adopted. The
following code is hereby adopted by reference as though it
was copied herein fully: Standard Plumbing Code - 1985
Edition, including Appendixes.
Sec. 613 . 02 Plumbing Code Sections Deleted. Sections
A 101. 4 . 1, A 101. 4 . 2 and A 105. 4 . 1, of the Standard Plumbing
Code, as adopted, are deleted.
SECTION 2 . Chapter 614 "Mechanical Code" , is hereby
amended by deleting Sections 614 .01 and 614 . 02 in their entirety
and replacing with the following:
Sec. 614 .01 Standard Mechanical Code Adopted. The
following code is hereby adopted by reference as though it
was copied herein fully: Standard Plumbing Code - 1985
Edition, including Appendixes.
Sec. 614 . 02 Mechanical Code Sections Deleted. Sections
A 101.4. 1, A 101.4 . 2 and A 105. 4. 1, of the Standard
Mechanical Code, as adopted, are deleted.

SECTION 3 . Chapter 615 "Gas Code" , is hereby amended by
deleting Sections 615. 01 and 615. 02 in their entirety and
replacing with the following:
Sec. 615. 01 Standard Gas Code Adopted. The following
code is hereby adopted by reference as though it was copied
herein fully: Standard Gas Code - 1985 Edition, including
Appendixes.
Sec. 615. 02 Gas Code Sections Deleted. Sections
A 101. 4 . 1, A 101. 4 . 2 , A 105. 4 . 1, and C-5 of the Standard Gas
Code, as adopted, are deleted.
SECTION 4 . Chapter 619 "Housing Code" , is hereby amended
by deleting Sections 615.01 and 615. 02 in their entirety and
replacing with the following:
Sec. 619 . 01 Standard Housing Code Adopted. The
following code is hereby adopted by reference as though it
was copied herein fully: Standard Housing Code - 1985
Edition, excluding Appendixes.
Sec. 619 . 02 Housing Code Amended. Sec. 106. 1. 1 of the
Standard Housing Code, as adopted by the City of Cape
Canaveral, shall read as follows:
The Board of Adjustment, for the purpose of the Standard
Housing Code of the City of Cape Canaveral, Florida,
shall be appointed by a majority vote of the City
Council.
SECTION 5. Chapter 620, "Standard Code for the Elimination
or Repair of Unsafe Buildings" is hereby repealed in its entirety
and replaced with the following:

CHAPTER 620
Sec. 620. 01 Standard Unsafe Building Abatement Code.
The following code is hereby adopted by reference as though
it was copied herein fully: Standard Unsafe Building
Abatement Code - 1985 Edition.
Sec. 620. 02 Administrative Authority or Official.
Whenever the term Administrative Authority or Official is
used in the Standard Unsafe Building Abatement Code, it
shall be construed to mean the Building Official of the City
of Cape Canaveral, Florida, or his authorized
representative.
Sec. 620. 03 Penalty. Any and all persons who shall
violate any of the provisions of this Chapter or shall fail
to comply therein, or who shall violate or fail to comply
with any order or regulation made thereunder, or who shall
build in violation of any detailed statement or
specifications or plans submitted and approved thereunder or
any certificate or permit issued thereunder, shall severally
for each and every such violation and noncompliance,
respectively, be punished as provided in § 801. 01.

SECTION 6. Chapter 621, "Fire Prevention Code" , is hereby
amended by deleting Section 621.01 in its entirety and replacing
with the following:
Sec. 621. 01 Fire Prevention Code Adopted. The following
code is hereby adopted by reference as though it was copied
herein fully: Standard Fire Prevention Code - 1985 Edition,
excluding Appendixes.
SECTION 7. Chapter 625, "Standard Excavation and Grading
Code" , is hereby amended by deleting Section 625.01 in its
entirety and replacing with the following:
Sec. 625.01 Standard Excavation and Grading Code. The
following code is hereby adopted by reference as though it
was copied herein fully: Standard Excavation and Grading
Code - 1975 Edition.
SECTION 8. Chapter 627, "Standard Swimming Pool Code" , is
hereby amended by deleting Sections 627.01 in its entirety and
replacing with the following:
Sec. 625. 01 Standard Swimming Pool Code. The following
code is hereby adopted by reference as though it was copied
herein fully: Standard Swimming Pool Code - 1985 Edition.
SECTION 9 . Chapter 628, "Standard Amusement Device Code" ,
is hereby amended by deleting Sections 628 .01 in its entirety and
replacing with the following:
Sec. 628. 01 Standard Amusement Device Code. The
following code is hereby adopted by reference as though it
was copied herein fully: Standard Amusement Device Code -
1985 Edition.
SECTION 10. All portions of the Code in conflict herewith
are hereby repealed.
SECTION 11. This Ordinance shall become effective
immediately upon its adoption.

FIRE PREVENTION CODE
Sec . 621.01 Fire Prevention Code Adopted. The fol-
lowing Code is hereby adopted by reference as though it
was copied herein fully: Standard Fire Prevention Code -
1985 Edition. [Ord. No . 20-77, § 1, 3 Jan 1978; Ord. No .
13-82, § 6, 7 Sep 1982; Ord. No. 5-86, §6, 4 Mar 86]
Sec. 621 .02 Administrative Authority or Official .
Whenever the term Administrative Authority or Official
is used in the Fire Prevention Code it shall be construed
to mean the Building Official of the City of Cape Canaveral,

Sec. 621 . 07 Lock Boxes Required. Lock Boxes are re-
quired on structures that are required to have Fire Depart-
ment alarm systems and on multi-family residences having
enclosed common areas, which the Fire Department, in the
event of an emergency, may need to gain access to. The
public safety Keybox System shall contain keys for ele-
vator return and door opening, elevator rooms, fire alarm
box room, electrical rooms and any other keys necessary for
the Fire Department to gain access to common areas or
through common areas to individual units. The Keybox
System shall not require keys of individual units.
Keybox System may be surface mounted or flush mounted
in an easily accessible location and the Fire Department
shall maintain possession of the only key. In the event
locks are changed in any of the above mentioned rooms,
the Fire Department shall be notified immediately.
All Keybox Systems must be approved by the Fire Chief
of the Cape Canaveral Volunteer Fire Department. [Ord.

FLORIDA AND SUBSTITUTING THEREFORE CHAPTER
611 ENTITLED BUILDING CODE; ADOPTING VARIOUS
STANDARD CODES RELATING TO INSPECTION ACTIVI-
TIES OF THE CITY OF CAPE CANAVERAL, FLORIDA,
AND ENFORCEMENT OF BUILDING PROVISIONS, AS
PROVIDED IN SAID CODES ; REPEALING ALL PORTIONS
OF THE CODE IN CONFLICT HEREWITH; PROVIDING
AN EFFECTIVE DATE.
An Ordinance to adopt various standard codes relating
to inspection activities of the City of Cape Canaveral, Florida
and enforcement of building provisions as provided in said codes.
WHEREAS, it is the desire of the City Council of the
City of Cape Canaveral, Florida to adopt, in all respects, the
various Standard Codes relating to amusement devices, building,
fire prevention, gas, grading, housing, mechanical plumbing and
swimming pools; and
WHEREAS, the adoption of these Codes is done to facilitate
proper inspection activities by the City of Cape Canaveral, Florida
relating to construction and to maintenance of buildings within the
corporate limits of said City and relating to public safety, health
and general welfare.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Cape Canaveral, Florida as follows:
SECTION 1. Chapter 611, Building Code, of the City Code of
the City of Cape Canaveral, Florida is hereby deleted in its entirety
and replaced with the following:

amendments, are deleted.

of Cape Canaveral, Florida is hereby deleted in its entirety and re-
placed with the following:

in its entirety, and the following new section substituted therefor:
"Section 621. 01 Adoption of Fire Prevention Codes".
There are hereby adopted by the City of Cape Canaveral, Florida
for the purpose of prescribing regulations governing conditions hazardous
to life and property from fire or explosion, those certain codes known as
the Fire Prevention Codes recommended by the American Insurance
Association, being particularly the 1976 edition thereof and the whole
thereof and the Life Safety Code, National Fire Protection Association
No. 101 as amended in the 1976 edition thereof and the whole thereof, save
and except such portions as are hereinafter deleted, modified or amended
and to include future revisions or amendments by the American Insurance
Association and the National Fire Protection Association, are hereby
adopted and incorporated as full as if set out at length herein and from the
date on which this Ordinance shall take effect the provisions thereof shall
be controlling within the limits of the City of Cape Canaveral, Florida. 20-77 §1 3 June 78
(2) Section 621.02 entitled "Definitions" is hereby deleted in its
entirety and the following new section substituted therefor:

"Section 621. 02 Definitions. "
a. Wherever the word "Municipality" is used in the Codes,
it shall be held to mean the City of Cape Canaveral, Florida.
b. Wherever the term "Corporate Counsel" is used in the Codes,
it shall be held to mean the attorney for the City of Cape Canaveral, Florida.
(3) Section 621. 03 entitled "Establishment of Limits of Districts "
is deleted in its entirety and the following new section substituted therefor:
" Section 621. 03 Establishment of Limits of Districts. "
The limits referred to in these codes regarding permitting,
establishing, restricting or storage of explosives, blasting agents, flammable
liquids, in new bulk plants and liquified petroleum shall be set by the
Council, and in the event no limit has been established it shall be deemed

SECTION 2. All parts of the City Code in conflict herewith are
hereby repealed.
SECTION 3. This Ordinance shall become effective immediately

be controlling within the limits of the City of Cape Canaveral, Florida.
(2) Section 621. 02 entitled'Definitions" is hereby deleted in its
entirety and the following new section substituted therefor:

Sec. 621.01 FIRE PREVENTION CODE. ADOPTED
There is hereby adopted by the City of Cape Canaveral, Florida, for
the purpose of prescribing regulations governing conditions hazardous to life and
property from fire or explosion, that certain code known as the Fire Prevention Code
recommended by the American Insurance Association, being particularly the 1965
edition thereof and the whole thereof, and any future editions of same, a copy of which
is filed with the office of the Clerk of the City of Cape Canaveral, Florida, save and
except such portion thereof as are hereinafter deleted, modified or amended and the
same is hereby adopted and incorporated as fully as if set out at length herein, and
from 15 April 1969, the provisions thereof shall be
controlling within the limits of the City of Cape Canaveral, Florida. [Ord. No. 1-69, §1,
Sec. 621.08 TO NEXT PAGE ESTABLISHMENT AND DUTIES OF BUREAU OF FIRE
PREVENTION.
a. The Fire Prevention Code shall be enforced by the Bureau of Fire
Prevention in the Fire Department of the City of Cape Canaveral, Florida, which is hereb
established and which shall be operated under the supervision of the Fire Marshall.
b. The Fire Marshall in charge of the Bureau of Fire Prevention shall
be appointed by the Council of the City of Cape Canaveral, Florida, who shall serve at
the pleasure of the Council.
c. The Fire Marshall may detail such members of the fire department
as inspectors as shall from time to time be necessary.
d. A report of the Bureau of Fire Prevention shall be made annually and

ceedings under this code, with such statistics as the Fire Marshall may wish to include
therein; the Fire Marshall shall also recommend any amendments to the code which, in

Sec. 621.09 APPEALS.
Whenever the Fire Marshall shall disapprove an application or refuse to
grant a permit applied for, or when it is claimed that the provisions of the code do not
apply or that the true intent and meaning of the code have been misconstrued or wrongly
interpreted, the applicant may appeal from the decision of the Fire Marshall to the City
Council within 30 days from the date of the decision appealed. [Ord. No. 1-69, §5, 15 APR. 1969]
Sec. 621.10 PENALTIES.
a. Any person who shall violate any of the provisions of the code hereby
adopted or fail to comply therewith, or who shall violate or fail to comply with any order
made thereunder, or who shall build in violation of any detailed statement of specifications
or plans submitted and approved thereunder, or any certificate or permit issued there-
under, shall severally for each and every such violation and noncompliance respectively,
be punished as provided in §801.01. The
imposition of one penalty for any violation shall not excuse the violation or permit it to
continue; and all such persons shall be required to correct or remedy such violations
or defects within a reasonable time; and when not otherwise specified, each ten days
that prohibited conditions are maintained shall constitute a separate offense.
b. The application of the above penalty shall not be held to pr.",vent the
enforced removal of prohibited conditions.

SECTION 1. Sprinkler Systems
Sprinkler systems conforming to requirements
of National Fire Code, Volume 13, hereinafter referred to as NFPA 13 or
Life Safety Code, shall be provided in the following buildings:
A. Buildings exceeding three stories in height and classified
as light hazard occupancy having enclosed corridors shall have an
automatic sprinkler system which shall be continuous in all such
corridors and stairwells, commencing at the most remote area of
the uppermost level and running to the ground floor exits. One
sprinkler head shall be connected from the corridor system to the
opposite side of any door opening on the corridor or stairwell.
B. Buildings exceeding three stories in height with
occupancies classified as ordinary hazard shall be fully protected
throughout with an automatic sprinkler system.
C. All buildings with occupancies classified as extra hazard
shall be fully protected with an automatic sprinkler system regard-
less of height or type of construction of the building.
D. Nursing (convalescent) homes shall be equipped with
automatic sprinkler and alarm systems regardless of height or type
of construction of the building.
E. In the case of mixed occupancies, the most stringent re-
quirements shall be met throughout the building unless the occupancies
shall be separated by a fire proof wall of a time duration satisfactory
to the Fire Chief, that will prevent the spread of flame or smoke from
one occupancy to another.
F. Classifications of occupancy shall be defined as set forth
in the Southern Standard Building Code.

Sec. 621.05. Fire Alarm Systems
A. Each multi-family residential building of more than three
stories shall be provided with a supervised, open-circuit, non-coded
fire alarm system designed to provide a local evacuation alarm signal
audible to all occupants and to simultaneously notify the central fire
station of a fire condition. Manual stations and alarm devices shall
be located as required by the latest edition of NFPA 101 (Life Safety
Code).
B. Where sprinkler systems and/or automatic fire
detection devices are provided, these systems and devices shall
be connected to the fire alarm system so that activation of the
sprinkler system or any automatic detection device shall auto-
matically activate the fire alarm system. All such connections
shall be electrically supervised.
C. Fire alarm systems shall comply with the latest
edition of NFPA 72A.
D. Each building fire alarm system shall be properly
connected by telephone pair to the central fire reporting equipment
in the City's central fire station for annunciation of an alarm
condition at the building. The costs of the central fire reporting
equipment at the fire station together with all costs for the
connecting telephone pairs required for the building shall be borne
entirely by the owner of the building. [Ord. No. 12-73, 2, 1 MAY 1973]
Sec. 621.06. Test and Inspection Requirements.
A. All sprinkler and alarm systems shall be checked and
tested every twelve months. The Fire Chief or his designated
representative shall be notified in advance and shall be present to
observe all tests.
B. Tests may be performed by qualified insurance company
representatives without Fire Department observers, provided that
written reports satisfactory to the Fire Department are submitted
after each test.
C. Written reports of the result of all tests shall be main-
tained by the Fire Department for a period of five (5) years.

Sec. 621.07 Application of Sections 621.04-621.06.
(A) Existing buildings or occupancies may be given a waiver
of any or all provisions of §§621.04-621.06 when, in the opinion of the
Fire Chief, the installation of sprinkler and/or alarm systems would
not provide a safer evacuation of the structure. Such waivers shall
be in writing, shall state the specific reasons justifying the waiver
and shall have drawings attached if necessary to illustrate the reason
for the waiver. Waivers shall be retained by the Fire Department
and no change of occupancy hazard level or modification to the
structure shall be permitted without review of the waiver.
(B) Existing buildings that have not been given a waiver of
the requirements of this Section shall be required to conform within
the following period of time:
Light Hazard Occupancies: within four (4) years from
date of this Ordinance;
Ordinary Hazard Occupancies: within three (3) years
from date of this Ordinance;
Extra Hazard Occupancies: within two (2) years from
date of this Ordinance.
(C). §§621.04-621.06 SHALL APPLY TO ALL BUILDINGS COVERED
BY THE REQUIREMENTS OF THESE SECTIONS, FOR WHICH BUILDING PERMITS HAVE
BEEN ISSUED AND FOR WHICH CERTIFICATES OF OCCUPANCY HAVE NOT BEEN ISSUED.

that prohibited conditions are mantained shall constitute a separate offense.
b. The application of the above penalty shall not be held to prevent the
enforced removal of the prohibited conditions.
