UNLAWFUL CONSUMPTION
OF ALCOHOLIC BEVERAGE
Sec. 604.01 Prohibiting Consumption
or Possession of Alcoholic Beverage. It
shall be unlawful for any person to
drink, consume, or possess an open con-
tainer of alcoholic beverage, including,
but not limited to, beer and wine, on
or upon any street, alley, sidewalk or
parking area open to the public in the
ordinary course of business within the
City of Cape Canaveral, Florida, pro-
vided, however, that this prohibition
shall not apply to the ocean beach.

Sec. 604.02 Prohibiting Consumption or
Possession of Alcoholic Beverage. It shall
be unlawful for any person to drink, con-
sume, or possess an open container of
alcoholic beverage, as defined in Chap-
ter 561, Florida Statutes, within the
confines of any public park, public
recreational area, public recreational
facility, or public ball park within
the City of Cape Canaveral, Florida,
excluding the ocean beach. (Ord. No.
13-75 §1, 13 May 1975) .
The City Manager may waive the pro-
hibitions of this Section for any special
event, including but not limited to
community picnics , charitable ball games
and other events, provided that nothing
contained herein shall be deemed to waive

any provisions of the Florida law regu-
lating alcoholic beverages. (Ord. No.

Sec. 604.03 Penalty. Any person con-
victed of a violation of this Ordinance
by a court of competent jurisdiction
shall be punished by a fine not to exceed
One Hundred dollars ($100. 00) , or by
both such fine and imprisonment. (Ord.

BE IT ORDAINED by the City Council of the City of Cape Canaveral,
Florida, as follows:

AN ORDINANCE AMENDING ORDINANCE NO. 13-75 PROHIBITING
ALCOHOLIC BEVERAGES IN PUBLIC PARKS, PUBLIC RECREATION
AREAS OR FACILITIES AND PUBLIC BALL PARKS WITIHIN THE
CITY OF CAPE CANAVERAL; BY AUTHORIZING CITY MANAGER
TO WAIVE SAID PROHIBITIONS FOR SPECIAL EVENTS; REPEAL-
ING ALL CONFLICTING ORDINANCES OR CHARTER PROVISIONS;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the City Council of the City of Cape Canaveral,
Florida, as follows:
SECTION 1. Section 1 of Ordinance No. 13-75, which ordinance makes
it unlawful for any person to drink, consume or possess an open container of
alcoholic beverage within the confines of any public park, public recreational
area, public recreat ional facility or public ball park within the City of Cape
Canaveral, Florida, is hereby amended by the addition of the following
provision:
add this "The City Manager may waive the prohibitions of this Section
for any special event, including but not limited to community
picnics, charitable ball games and other events, provided that
nothing contained herein shall be deemed to waive any provisions
of the Florida law regulating alcoholic beverages."
SECTION 2. All conflicting ordinances or Charter provisions are
hereby repealed.
SECTION 3. This ordinance shall become effective immediately upon
its adoption.
Adopted by the City Council of the City of Cape Canaveral, Florida,
