HomeMy WebLinkAboutCode Master Project 1978: Chapter 549: Property Tax (No Change) § 549.01 PROPERTY TAX § 549.04 CHAPTER 549 PROPERTY TAX Sec. 549.01 Ad-Valorem Tax Established. There is hereby established and imposed annually an ad valorem tax not to exceed a rate of three (3) mills on the assessed value of all nonexempt real property located within the City of Cape Canaveral, Florida, as may be determined each year by the City Council. The determination of exempt property shall be made in accordance with Florida law, and as determined by the Brevard County Tax Assessor. [Ord. No. 25-72, § 1, Jan. 2, 1973] Sec. 549.02 Property Valuation Determined by County Tax Assessor. For the purpose of this Chapter, the valuation of said real property shall be the same as assessed by the Brevard County Tax Assessor. [Ord. No. 25-72, § 2, Jan. 2, 1973] Sec. 549.03 County Collector to Collect Tax. The Brevard County Tax Collector is hereby designated to collect the tax imposed by this Chapter on behalf of the City of Cape Canaveral, Florida. Said tax shall be imposed annually and shall be collected by the Tax Collector simul- taneously with collection of the Brevard County ad valorem tax. [Ord. WHEREAS , Ordinance No. 25-72 created Code Chapter 549 which established and imposed an ad valorem tax not to exceed 3 mills with the intent of funding garbage collection services in the City of Cape Canaveral, Florida, and WHEREAS, the City has been and plans to continue billing for garbage services direct to the customer, and WHEREAS, Ordinance No. 19-73 created Code Chapter 551 which established a fee known as the "Interim Proprietary Services Fee" for the purpose of non-reimbursed City services provided to im- proved property during the interval between the issuance of a Certificate of Occupancy and commencement of the following tax year, and WHEREAS, the City has been billing for garbage and trash collection services immediately upon the issuance of a Certificate of Occupancy, and WHEREAS, there is no further need for Interim Proprietary Services Fees, NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Cape Canaveral, Florida as follows: SECTION 1. Chapter 549 of the City Code of the City of Cape Canaveral, Florida is hereby repealed in its entirety. SECTION 2. Chapter 551 of the City Code of the City of Cape Canaveral, Florida is hereby repealed in its entirety. SECTION 3. All portions of the City Code in conflict here- with are hereby repealed. SECTION 4. This Ordinance shall become effective immediately upon its adoption.
