ITIONAL COURT ASSESSMENT; REPEALING

WHEREAS, Ordinance No . 4-69 , section 1, is not necessary
in light of § 23 . 103, Fla. Stat. , which confers broader powers
to assess upon the court,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAPE
CANAVERAL, FLORIDA, AS FOLLOWS:
SECTION 1. Pursuant to § 23.105, Fla. Stat. , the City
of Cape Canaveral assess/an additional $1.00 for law enforce--
ment education expenditures for their law enforcement officers.
SECTION 2. Ordinance No. 4-69 hereby stands REPEALED.
SECTION 3 . This ordinance shall become. effective
immediately upon adoption by the City Council.

AN ORDINANCE POVIDING FOR A $1.00 ASSESSMENT
TO BE ADDED TO EACH FINE AND FORFEITURE LEVIED
BY THE MUNICIPAL COURT TO BE USED FOR LAW EN-
FORCEMENT TRAINING SCHOOL; PROVIDING FOR AN
ADDITIONAL $1. 00 ASSESSMENT FOR LAW ENFORCEMENT
EDUCATIONAL EXPENDITURES; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the 1969 Florida Legislature enacted in Section 14 and
18 of House Bill No. 2273, a bill requiring municipalities to assess a sum
of $1. 00 to each fine or forfeiture levied by the Municipal Court for the
purpose of law enforcement, training school effective July 1, 1969, and
further permitting assessment of an additional $1. 00 as aforedescribed
for law enforcement educational expenditures, and
NOW, THEREFORE, BE IT ORDAINED by the City Council of the
City of Cape Canaveral, Florida, as follows:
SECTION 1: That pursuant to 1969 Florida Legislature House Bill
No. 2273, Section 14, the City of Cape Canaveral, Florida, does hereby
assess a sum of $1. 00 as a Court cost against every person convicted of
a violation of a municipal ordinance. In addition, $1. 00 from every bond
estreature or forfeited bail bond shall be forwarded to the State Treasurer,
except no such assessment shall be made against any person convicted of
any municipal ordinance relating to the parking of vehicles. All such costs
collected shall be deposited in the State Treasury to the credit of the general
revenue fund, as may be provided by rules promulgated by the governing
board of the Florida Bureau of Law Enforcement upon recommendation of
the Commissioner of such Bureau.
SECTION 2: The City of Cape Canaveral, Florida, pursuant to
Section 18 of House Bill No. 2273, 1969 Florida Legislature, does hereby
assess an additional $1. 00 as aforedescribed, for law enforcement education
expenditures for City law enforcement officers and administration expenses
incurred in this Ordinance.

SECTION 3: This Ordinance shall become effective immediately
upon adoption.
ADOPTED by the City Council of the City of Cape Canaveral, Florida,
this 5th day of August, 1969.

ORDINANCE NO. 11-82
AN ORDINANCE INCREASING THE AMOUNT REMITTED
FROM FINES; DIRECTING SUCH FUNDS TO BE USED
EXCLUSIVELY FOR LAW ENFORCEMENT TRAINING
EDUCATION; DIRECTING THE CITY CLERK TO PROVIDE
COPIES OF THE ORDINANCE TO STATE AND COUNTY
OFFICIALS; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED by the City Council of the City of
Cape Canaveral, Florida, as follows:
Sec. 543.01 Court Costs for Police Education and
Training. The City hereby assesses the sum of Two Dollars
($2. 00) as a court cost against every person convicted for
violation of a State, penal or criminal statute or convicted
for violation of a municipal or county ordinance in all cases
in which the said violation occurred within the City. In
addition, the sum of Two Dollars ($2. 00) shall be deducted
from every bond estreature or forfeited bail bond related
to such penal statutes or ordinances. In those cases where
such bond estreature or fortedited bail bond arises from acts
committed within the City or arrests made by the City Police
Department. However, no such assessment shall be made against
any person convicted for violation of any statute or municipal
or county ordinance relating to the parking of vehicles.
SECTION 2. All portions of the Code in conflict
herewith are hereby repealed.
SECTION 3. This Ordinance shall take effect im-
mediately upon its adoption.
ADOPTED by the City Council of the City of Cape
Canaveral, Florida this 6th day of July , 1982.
