AN ORDINANCE AMENDING CODE CHAPTER 211,
"ELECTION PROCEDURES" , OF THE CODE OF
ORDINANCES OF THE CITY OF CAPE CANAVERAL,
FLORIDA, BY ESTABLISHING SECTION 211. 05,
QUALIFYING PERIOD OF WRITE-IN CANDIDATES;
ALLOWING THREE (3) DAYS FOR WRITE-IN
CANDIDATES TO QUALIFY; REPEALING ALL
PORTIONS OF THE CODE IN CONFLICT HEREWITH;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the State of Florida requires municipalities to
establish a qualifying period for write-in candidates following
the qualifying period for candidates for all elected officials;
NOW, THEREFORE , BE IT ORDAINED by the City Council of
the City of Cape Canaveral, Florida, as follows :
SECTION 1. Chapter 211, Election Procedures , is hereby
amended by adding the following:
Sec. 211. 05 Qualifying Period for Write-in Candidates .
The qualifying period for write-in candidates for the
Offices of the Mayor and City Council of the City of
Cape Canaveral, Florida, shall be at any time after noon
of the 49th day prior to the date of the general election
and no later than noon of the 46th day prior to the date

SECTION 2 . All portions of the Code in conflict herewith
are hereby repealed.
SECTION 3 . This Ordinance shall become effective
immediately upon its adoption.
ADOPTED by the City Council of the City of Cape Canaveral,
Florida, this 19th day of March , 1985 .

CHAPTER 211
ELECTION PROCEDURE
Sec. 211. 01 Election Code Adopted. The Florida Elec-
tion Code as set forth and designated in the Florida
Statutes and all amendments which have been or may be
adopted thereto is hereby adopted as the procedure for
conducting municipal elections within the City of Cape
Canaveral, Florida. The duties, authority and respon-
sibility of state and county officers, board and bodies
set forth in the Florida Election Code shall apply to the
corresponding municipal entities in the conduct of munici

Sec. 211. 02 Penalties for Violations. All penalties
for violations as provided in the Florida Election Code
which is hereby adopted, are hereby specifically adopted
as the penalties for violations of said code as pertains
to municipal elections conducted within the City of Cape
Canaveral , Florida. [Ord. No. 1-75 , § 2 , 4 Mar 1972]
Sec. 211. 03 Polling Placed Provided. All elections of
the City of Cape Canaveral, Florida, shall be held and
conducted within the Volunteer Fire Station located at the
intersection of Jackson Avenue and Poinsetta Street, Cape
Canaveral, Florida , or at such other place or site within
the City of Cape Canaveral, Florida, as may be so designated
by the City Council of the City of Cape Canaveral, Florida.

is hereby amended by the addition of Section 211 . 04 Qualifying
Period, for the qualification of a candidate for the offices of
Mayor and City Council , as follows :
Sec. 211 . 04 Qualifying Period. The Qualifying Period
for candidates for the offices of the Mayor and City
Council of the City of Cape Canaveral , Florida, shall
be at any time after noon of the 63rd day prior to the
General Election, and no later than noon of the 49th
day prior to the date of the General Election.
SECTION 2 . All portions of the Code in conflict here-
with are hereby repealed.
SECTION 3 . This Ordinance shall take effect immediately
upon its adoption.

its entirety.

upon its adoption.

OF THIS CHAPTER SHALL PREVAIL IN CASE OF CONFLICT WITH THE FLORIDA ELECTION
CODE. THE DUTIES, AUTHORITY, AND RESPONSIBILITIES OF STATE AND
COUNTY OFFICERS, BOARDS AND BODIES SET FORTH IN THE FLORIDA
ELECTION CODE SHALL APPLY TO THE CORRESPONDING MUNICIPAL ENTITIES
