HomeMy WebLinkAboutCode Master Project 1978: Chapter 211: Election Procedure ORDINANCE NO. 18-85 AN ORDINANCE AMENDING CODE CHAPTER 211, "ELECTION PROCEDURES" , OF THE CODE OF ORDINANCES OF THE CITY OF CAPE CANAVERAL, FLORIDA, BY ESTABLISHING SECTION 211. 05, QUALIFYING PERIOD OF WRITE-IN CANDIDATES; ALLOWING THREE (3) DAYS FOR WRITE-IN CANDIDATES TO QUALIFY; REPEALING ALL PORTIONS OF THE CODE IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. WHEREAS, the State of Florida requires municipalities to establish a qualifying period for write-in candidates following the qualifying period for candidates for all elected officials; NOW, THEREFORE , BE IT ORDAINED by the City Council of the City of Cape Canaveral, Florida, as follows : SECTION 1. Chapter 211, Election Procedures , is hereby amended by adding the following: Sec. 211. 05 Qualifying Period for Write-in Candidates . The qualifying period for write-in candidates for the Offices of the Mayor and City Council of the City of Cape Canaveral, Florida, shall be at any time after noon of the 49th day prior to the date of the general election and no later than noon of the 46th day prior to the date of the General Election. The Florida Elec- tion Code as set forth and designated in the Florida Statutes and all amendments which have been or may be adopted thereto is hereby adopted as the procedure for conducting municipal elections within the City of Cape Canaveral, Florida. The duties, authority and respon- sibility of state and county officers, board and bodies set forth in the Florida Election Code shall apply to the corresponding municipal entities in the conduct of munici pal elections . All penalties for violations as provided in the Florida Election Code which is hereby adopted, are hereby specifically adopted as the penalties for violations of said code as pertains to municipal elections conducted within the City of Cape Canaveral , Florida. All elections of the City of Cape Canaveral, Florida, shall be held and conducted within the Volunteer Fire Station located at the intersection of Jackson Avenue and Poinsetta Street, Cape Canaveral, Florida , or at such other place or site within the City of Cape Canaveral, Florida, as may be so designated by the City Council of the City of Cape Canaveral, Florida.
