COMMUNITY APPEARANCE BOARD MEETING
MAY 17, 1999
MINUTES
A meeting of the City of Cape Canaveral, Community Appearance Board,was held on
May 17, 1999, at 7:00 P.M. in the City Hall Annex, 111 Polk Avenue, Cape Canaveral,
Florida. The Secretary called the roll.

APPROVAL OF MINUTES:
Mr. Hayes made a motion and Mr. Bowman seconded the motion to approve the meeting
minutes of April 19, 1999. Motion carried unanimously.
Attorney Bennett swore in all persons giving testimony.
NEW BUSINESS:
1. Request No. 99-10, Sea Era Patio Homes, 7660 Ridgewood Avenue;Norman
Boucher, Applicant.
Mr. Boucher explained that this application completes the Sea Era Patio Homes with two
additional buildings. There are two existing buildings with four single-family homes and
this building will be located on the corner of Ridgewood, Tyler and Harrison Avenues.

Mr. Boucher solicited questions on the applications. Mr. Boucher affirmed Ms. Easler's
question that the existing buildings were three-story homes. Mr. Boucher clarified that
this building would be a two-story home and explained that although the buildings were
similar in appearance, he chose to add some aesthetics. Ms. Easler questioned about the
landscaping depicted for one lot only. Mr. Boucher stated he would duplicate the
landscaping on all the lots. Ms. Hayes queried the number of buildings. Mr. Boucher
answered that there are two buildings, two duplexes and four units total.
Ms. Hayes asked Mr. Bapp why the Board did not have a plan showing two buildings.
Attorney Bennett responded that the Board does not have site plans at this level. Ms.
Hayes stated that the Board needed a concept plan locating improvements which is
something depicting two buildings. Ms. Hayes read Section 22-44, of the Board's
ordinance on the criteria for a Level I application, subsection (b), "for new development
of unimproved property a concept plan locating improvements." Mr. Bapp agreed that he
omitted to show two buildings. Mr. Boucher explained that the plan before the Board
would be duplicated four times and noted that the lot sizes are 50-feet by 155-feet. Mr.
Bowman stated that the building is utilizing the limits of the setbacks and queried if the
Board needed to consider a percentage of the zoning law. Attorney Bennett stated that the
building meets its lot coverage. Ms. Hayes stated that most of the city is zoned multi-
family residential even though single-family residents exist on those properties. She
added that future development might affect this situation. Ms. Hayes emphasized the
need for a better visual representation for review and asked the Building Department staff
for continued help in this area.
Ms. Hayes asked if the colors were available. Mr. Boucher submitted color samples. Ms.
Hayes asked about the materials. Mr. Boucher responded concrete block, a two-story,
block construction. Mr. Boucher stated white for the trim color. Ms. Hayes noted the
color Weaver's Cloth for the building. Mr. Bowman questioned if the white trim was for
the bands. Mr. Boucher stated that the white trim is for the bands, fascia and soffits. He
noted that the windows would have awnings or shutters with a contrasting tone. Ms.
Nielsen asked if the window aesthetics were probable. Mr. Boucher affirmed. Ms. Easler
asked if the garage door color would be the same or contrasting. Mr. Boucher stated
white. Ms. Hayes queried about the multi-pane windows on the front and rear but not the
sides. Mr. Boucher explained that this was a matter of architectural preference. Ms.
Nielsen asked if the patio was an open slab. Mr. Boucher affirmed. Ms. Hayes questioned
the indentation on the front adjacent to the garage doors with a little window and that the
main door was on the side of the building. Mr. Boucher explained that this was due to the
lot size. Mr. Boucher affirmed Ms. Easler's question that there was no balcony in the rear.
Ms. Nielsen made a motion and Mr. Bowman seconded the motion to approve the
application for Request No. 99-10 as presented. Motion carried unanimously.

2. Request No. 99-11, Wes Kirby Duplex, Intersection of Magnolia & Monroe
Avenues; Wes Kirby, Applicant.
Mr. Kirby explained that the duplex was located on property adjacent to property he
currently owns. Mr. Kirby submitted paint colors and a roof sample. He stated the
exterior color as sand with a brown trim. He noted that the style as English Tudor.
Ms.Hayes asked if the bands were the brown color. Mr. Kirby affirmed and included that
the soffits and eaves would have the same color. Mr. Bowman stated that this was a
marked contrast. Ms. Easler asked if he intended to paint around the windows brown. Mr.
Kirby affirmed. Mr. Kirby also affirmed Ms. Easler's question if he would also paint the
door brown. Ms. Easler commented on the Brazilian peppers and asked if they were
existing. Mr. Kirby affirmed. Ms. Nielsen agreed with Mr. Bowman's point that that the
banding greatly contrasted the building. Ms. Hayes noted Mr. Kirby's Tudor style and
stated that the banding would break up the mass of expanse on Magnolia Avenue. Mr.
Bowman spoke in favor of the aesthetics for the windows, the paint and the door
selection, however he stated that the bands would overpower and detract from the
building. He noted that the horizontal bands were good due to the building's height. Ms.
Easler queried about the width of the band. Mr. Bapp stated 12-inches. Mr. Kirby
responded that the English Tudor style required the bands. Ms. Hayes stated that
according to the ordinance, excessively similar or dissimilar is the criteria. Mr. Bowman
responded that the vertical bands were dissimilar to the other buildings in the
neighborhood. Ms. Nielsen asked if the backyard were 8 feet up to the fence. Mr. Kirby
explained he would need to trim back the Pepper trees. Ms.Nielsen noted that the oaks
were retained.
Ms. Hayes made a motion and Mr. Bowman seconded the motion to approve the
application as presented for Request No. 99-11 with a recommendation to the
builder to reconsider the vertical bands. Motion carried unanimously.
DISCUSSION:
Ms. Easler requested that the Board hold an election for a new Chairperson and Vice-
Chairperson.
Ms. Hayes made a motion and Ms. Nielsen seconded the motion to nominate Ms.
Easler as Chairperson and Mr. Bowman as Vice-Chairperson. Motion carried
unanimously.
Mr. Bowman stated that the most noteworthy item in the Collier County presentation was
its pictorial nature. Mr. Bowman suggested the idea that the City sponsors a contest
depicting good and bad architecture ranging from school age children through adult
residents. The contest would effect what people want to see in their City. Attorney
Bennett stated that he would submit the idea in his report to City Council on the
subsequent evening. Ms. Easler suggested using a panel of judges. Ms. Hayes displayed a

picture of a house constructed in Collier County in Architectural Digest that had
circumvented regulations. The Board agreed that the building was a distinct construction.
There being no further business, Ms. Hayes made a motion and Ms. Nielsen seconded the
motion to adjourn the meeting at 7:35 P.M.
