COMMUNITY APPEARANCE BOARD MEETING
JULY 6, 1998
MINUTES
A meeting of the City of Cape Canaveral, Community Appearance Board, was held on
July 6, 1998, at 7:00 P.M. in the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida.
The Secretary called the roll.

APPROVAL OF MINUTES
Motion by Ms. Hayes and seconded by Ms. Nielsen to approve the meeting minutes of
June 15, 1998. Motion carried unanimously.
At this time Attorney Bennett swore in all persons giving testimony.
NEW BUSINESS
1. Request No. 98-16 - Residence, 809 W. Central Blvd; Donald Haynes, Applicant.
Mr. Haynes described the project as a single-family residence on a riverfront lot. The project is a
one-story, Florida contemporary style home, with a two-car garage, 10-ft. walls and tile roof. Mr.
Bapp distributed photos for the Board's review. Mr. Haynes displayed a sample of the roof tile in
the color, Tequila and he added that the home is concrete-block-stucco. Ms. Easler questioned
about the landscape plan. Mr. Haynes responded that the architect showed some landscaping on

the plans, but he will leave any further landscaping to the owner's discretion. Ms. Easler queried
Mr. Haynes about the two columns near the front doors. Mr. Haynes responded that there would
also be two columns on each side of the garage. Ms. Easier asked what kind of garage doors
would be installed. Mr. Haynes answered a metal, paneled door that meets the current wind load
requirements. Ms. Easler also asked if the entryway had an overhang. Mr. Haynes affirmed and
said that the overhang is 12-feet high and approximately 6-8-feet in depth. Ms. Hayes questioned
about the location of the garage. Mr. Haynes pointed out the location from a floor plan. Ms.
Nielsen asked if the rear of the residence is on the riverfront to which Mr. Haynes affirmed. Ms.
Hayes questioned why double-paned windows were not being used throughout. Mr. Haynes
responded that this could be done at the owner's discretion.
Motion by Mr. Bowman and seconded by Ms. Nielsen to approve the application for
Request No. 98-16 as submitted. Motion carried unanimously.
2. Request No. 98-17 - Discovery Bay Privacy Wall; William Young, Applicant.
Mr. Young described that this project is a privacy wall on the north side of Discovery Bay. He
stated that the wall would be a white, stucco, on a concrete-block wall. He explained that there
would be columns approximately every 30-feet, with a dome light attached to each column. Ms.
Easler asked the total footage. Mr. Young answered 1,400 linear feet. Ms. Hayes asked for a
staff report. Mr. Bapp made a verbal staff report that the project is an authorized concrete barrier
wall, which is in compliance with City code within R-3 zoning. He stated that the wall would be
installed on the northern boundary of Manatee Bay Drive. The applicant provided color
photographs and paid all applicable fees before Board review. Ms. Easler queried about the
accent tiles. Mr. Young explained that the tiles would be done in a dark teal. He noted that this
project would connect to the existing columns at the entry. Mr. Young stated that the project
would begin as soon as the City removes an existing fence that encroaches on 15-feet of the
property. Ms. Hayes questioned about the power poles on the blueprint. Mr. Young answered
that the power poles exist and as the project nears the power poles the block fence will terminate
and a white aluminum railing would be installed to make a transition to the utility pole. Mr.
Bowman queried about the steel pipes. Mr. Young explained that the steel pipes are for an island
that would house the operating equipment for the gates.
Motion by Ms. Hayes and seconded by Mr. Bowman to approve the application for
Request No. 98-17 with the color as shown on the photos submitted. Motion carried
unanimously.
2. Request No. 98-18 - 137& 139 Ocean Garden Lane; Mark Derman, Applicant.
Mr. Bapp distributed photos of the north, west and east sections of the project. Mr. Derman also
submitted color samples. Mr. Derman explained that the units are two, single-story townhouses.
Ms. Easler asked if he planned to retain the trees. Mr. Derman stated that he would keep as many
as possible, however many of the palms were extinguished or planted in inappropriate places.
Ms. Hayes questioned about the color of the homes. Mr. Derman responded that white is the

building color with a 13-inch "Tin Smith" colored band. Ms. Hayes asked about the roof color.
Mr. Derman answered a medium-gray as shown on the color samples. Mr. Bowman noted that
the roof is lighter than the residence across the street. Mr. Derman explained that the color on the
house across the street is "Estate Gray" which is much darker with Green-Verde banding to
match the light fixtures on that house. Ms. Easler asked about the planters. Mr. Derman affirmed
that he would use them and stated that Ocean Gardens has lush landscaping. Ms. Nielsen queried
the one-story design of the house in regard to the two-story construction of the other homes. Mr.
Derman explained that that the rooflines extending front to back on the existing units are more in
harmony with two-story construction. He explained further that the project is a lateral gable look
to provide compatibility with the existing units. He stated that the overall exterior dimensions are
the same as the other units and the roofline is exactly the same with some changes to the interior.
Motion by Mr. Bowman and seconded by Ms. Hayes to approve the application for
Request No. 98-18 as submitted. Motion carried unanimously.
DISCUSSION
Mr. Bowman presented a suggestion to change the ordinance to provide a photograph of the
actual site. Attorney Bennett took note of the suggestion for an amendment to the ordinance. Ms.
Hayes questioned about Request No. 98-18 and the fact that the construction would be in a deed
restricted community. She asked why the applicant had to come before the Board a second time
for a similar project. Attorney Bennett stated that each project solicits different questions.
Attorney Bennett also stated that once the Board arrives at acceptable colors and adopted plans
then the Board's process could be shortened. Ms. Easler asked if this were something that the
Board could present to City Council to which Attorney Bennett affirmed.
Ms. Hayes queried about the office building at 160 Polk Avenue constructed by Mr. Bowman.
She asked him if his architectural style should compliment the existing building on Polk Avenue.
Mr. Bowman responded that the building is on a narrow lot and the ability to provide parking did
not allow for much architectural style. Ms. Easler stated that many applications previously
submitted did not optimally show existing construction.
Ms. Hayes questioned about the Mallaluca trees on State Road A1A between the Radisson and
Zachary's restaurant. She noted that the trees created a walled greenery effect, however these
trees were removed and she questioned if the City allowed this. Mr. Bapp stated that the trees are
a nuisance species and residents are encouraged to remove them. Mr. Bowman asked if there
were a landscaping ordinance that provided for tree replacement. Mr. Bapp stated the
replacement criteria as; "any landscaping that is placed as a buffer has to be maintained,"
meaning indefinitely. He said if there is a residential or commercial buffer that it has to remain in
place as long as the City is incorporated, unless the ordinance is changed. Ms. Easler questioned
about the privacy wall at Discover Bay. Attorney Bennett stated that the City's provides for a
buffer between commercial and residential property and a choice is given on what type of buffer
to use, unless the site plan specifically states the type of buffer being used. Mr. Bowman noted
that this might be something for the Board to consider when reviewing applications.

Mr. Bowman commented on the information he received in his agenda packet. Mr. Bapp
explained that this is the "Appearance Code for Small Communities" that the Building Official
distributed to prior members and would become standard distribution material for new members.
Ms. Easler asked the Board if there were any suggestions for changes to the ordinance. Mr.
Bowman emphasized the lack of a three-dimensional rendition to assist in application review.
Ms. Easler asked Mr. Bowman if he had an example. Mr. Bowman stated that a design is still in
progress. Ms. Hayes stated that the front elevation and the site plan on the Angel Isles project
were confusing, and she stated that a floor plan would have enabled her to better visualize the
front elevation. Mr. Bowman replied that floor plan would be in existence by the time a site plan
is completed. Attorney Bennett explained that City Council was concerned with contractors
expending funds before coming before Board review. Mr. Bowman noted that a floor plan is
done before a site plan. However, Attorney Bennett stated that the Board's focus is a concept
plan, not a site plan. Mr. Bowman addressed the issue that all the colors in question need to be
reviewed. Ms. Easler asked Ms. McNeely if she had suggestions. Ms. McNeely stated that a
three-dimensional rendition should not be difficult to obtain for the Board's review. Attorney
Bennett will provide a draft ordinance at the next scheduled meeting.
There being not further business a motion was made by Ms. Nielsen and seconded by Mr.
Bowman to adjourn the meeting at 7:50 P.M.
