CODE ENFORCEMENT BOARD
REGULAR MEETING
FEBRUARY 17, 2000
7:30 P.M.
A Regular Meeting of the Code Enforcement Board of the City of Cape
Canaveral, Florida, was held on February 17, 2000, at the City Hall Annex, 111
Polk Avenue, Cape Canaveral, Florida.
City Attorney Goldman entered at 7:40 P.M. Chairperson Russell called the
meeting to order at this time. The Secretary called the roll.

Greg Mullins, Code Enforcement Officer was sworn in by Attorney Goldman.
It was noted that the next regularly scheduled meeting would be held on March
23, 2000.
Motion by Mr. Biederman, seconded by Mrs. Hartley to approve the meeting
minutes of January 20, 2000. Vote on the motion carried unanimously.

COMPLIANCE HEARINGS:
1. Case No. 00-01, Moonhut Restaurant, (7802 N. Atlantic Avenue), Avon by
the Sea Subdivision, Block 19, Lots 9, 10 & 11, Brevard County, Florida-
Violation of Section 94-64 (f) Criteria and Standards for Measurement and
Placement of the Cape Canaveral Code of Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
PUBLIC HEARINGS:
1. Case No. 00-03, Ron Kister, (423 Lincoln Avenue), Avon by the Sea, Block
72, Lot 12, Brevard County, Florida - Violation of Section 110-106, Permits
Required of the Cape Canaveral Code of Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
2. Case No. 00-05, The Knot House, (6107 N. Atlantic Avenue), Section 26,
Township 24 South, Range 37 East, Banana River Estates, Parcel 22.01,
Brevard County, Florida -Violation of Section 70-75, Penalty for Failure to
Obtain or Renew Occupational License of the Cape Canaveral Code of
Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
3. Case No. 00-06, Action Lawn Service, (251 Canaveral Beach Boulevard),
Section 14, Township 24 South, Range 37 East, Canaveral Beach Gardens,
Block 4, Lot 4, Brevard County, Florida-Violation of Section 70-75,
Penalty for Failure to Obtain or Renew License of the Cape Canaveral
Code of Ordinances.

4. Case No. 00-07, Brevard Painting and Remodeling, (357 Imperial
Boulevard, Unit #15), Section 15, Township 24 South, Range 37 East,
Parcel 812, Brevard County, Florida -Violation of Section 70-75, Penalty
for Failure to Obtain or Renew License of the Cape Canaveral Code of
Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
5. Case No. 00-08, Gary Campbell, Tile Installation, (630 Adams Avenue, Apt
#6), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block
6, Lots 9 & 10, Brevard County, Florida -Violation of Section 70-75,
Penalty for Failure to Obtain or Renew License of the Cape Canaveral
Code of Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
6. Case No. 99-09, Resort Shops of Canaveral, (6870 N. Atlantic Avenue),
Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 73,
Lots 1-3, 9-12, Brevard County, Florida -Violation of Section 70-75,
Penalty for Failure to Obtain or Renew License of the Cape Canaveral
Code of Ordinances.
Code Enforcement Officer Mullins testified that this case was not in compliance.
He further testified that the renewal was approximately 150 days late. Brief
discussion followed.
Motion by Mrs. Hartley, seconded by Ms. Boone to find Case No. 00-09 in
violation as follows:
Findings of Fact: The Occupational License for the Business has not been
renewed.
Conclusion of Law: Resort Shops of Canaveral was in Violation of
Chapter 70, Taxation, Section 70-75, Penalty for Failure to Obtain or
Renew License of the Cape Canaveral Code of Ordinances.

Order: That Resort Shops of Canaveral shall comply with the
aforementioned Section of the City Code on or before March 15, 2000 by
taking the following action: Renew the license and pay all associated late
fees; or close the business and advised Greg Mullins, a City Official, that
he is no longer in business.
However, upon failure to comply by March 15, 2000, there shall be a fine
of $100.00 for the first day of non-compliance and $50.00 per day
thereafter, until the property is brought into compliance.
Vote on the motion carried unanimously.
7. Case No. 00-10, Chris Hunt Lawn Service, (255 Canaveral Beach Blvd.),
Section 14, Township 24 South, Range 37 East, Canaveral Beach Gardens,
Block 4, Lot 6.02, Brevard County, Florida -Violation of Section 70-75,
Failure to Obtain or Renew License of the Cape Canaveral Code of
Ordinances.
Code Enforcement Officer Mullins testified that he had no response from the
business owner and requested that the Board impose an Order finding this case
in violation. Brief discussion followed.
Motion by Ms. Boone, seconded by Mr. Biederman to find Case No. 00-10 in
violation as follows:
Findings of Fact: The Occupational License for the Business has not been
renewed.
Conclusion of Law: Chris Hunt Lawn Service was in Violation of Section
70-75, Penalty for Failure to Obtain or Renew License of the Cape
Canaveral Code of Ordinances.

Order: That Chris Hunt Lawn Service shall comply with the
aforementioned Section of the City Code on or before March 15, 2000 by
taking the following action: Renew the license and pay all associated late

There being no further business, the meeting was adjourned at 8:00 P.M.
