A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida,was held on March 23, 2000, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Chairperson Russell called the meeting to order at 7:30 P.M. The Secretary called the roll. MEMBERS PRESENT Mary Russell Chairperson Charles Biederman Donna Boone Walter Godfrey Karen Hartley Jeffrey Ratliff MEMBERS ABSENT Carol Warner Vice Chairperson OTHERS PRESENT Mitch Goldman Acting City Attorney Greg Mullins Code Enforcement Officer Susan Chapman Board Secretary Greg Mullins, Code Enforcement Officer was sworn in by Attorney Goldman. It was noted that the next regularly scheduled meeting would be held on April 20, 2000. Motion by Ms. Boone, seconded by Mr. Biederman to approve the meeting minutes of February 17, 2000. Vote on the motion carried unanimously. Code Enforcement Board Meeting Minutes March 23, 2000 Page 2 COMPLIANCE HEARINGS: 1. Case No. 99-09, Resort Shops of Canaveral, (6870 N. Atlantic Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 73, Lots 1-3, 9-12, Brevard County, Florida -Violation of Section 70-75, Penalty for Failure to Obtain or Renew License of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. Motion by Mr. Godfrey, seconded by Ms. Boone to find Case No. 00-09 in compliance based on Mr. Mullins testimony. Vote on the motion carried unanimously. 2. Case No. 00-10, Chris Hunt Lawn Service, (255 Canaveral Beach Gardens), Section 14, Township 24 South, Range 37 East, Canaveral Beach Gardens, Block 4, Lot 6.02, Brevard County, Florida -Violation of Section 70-75, Penalty for Failure to Obtain or Renew License of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. Motion by Mr. Godfrey, seconded by Ms. Boone to find Case No. 00-09 in compliance based on Mr. Mullins testimony. Vote on the motion carried unanimously. PUBLIC HEARINGS: 1. Case No. 00-11, Kangaroo International Corp., (515 Fillmore Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 60, Lot 5, Brevard County, Florida - Violation of Section 70-75, Penalty for Failure to Obtain or Renew Occupational License of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this Case was in compliance. Code Enforcement Board Meeting Minutes March 23, 2000 Page 3 2. Case No. 00-12, John Stevens, Consulting Service, (5805 N. Banana River Drive, Unit #1115), Section 22, Township 24 South, Range 37 East, Banana River Estates, Lot 18.05, Brevard County, Florida -Violation of Section 70- 75, Penalty for Failure to Obtain or Renew Occupational License of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this Case was in compliance. 3. Case No. 00-13, Jason Bickford, Sub-contractor, (8555 Astronaut Boulevard), Section 15, Township 24 South, Range 37 East, Parcel 761, Brevard County, Florida -Violation of Section 70-75, Penalty for Failure to Obtain or Renew Occupational License of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this Case was in compliance. 4. Case No. 00-14, Stephen Miller, general Contractor, (421 Jefferson Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 16, Lots 6 & 7, Brevard County, Florida -Violation of Section 70-75, Penalty for Failure to Obtain or Renew Occupational License of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this Case was in compliance. DISCUSSION: Chairperson Russell questioned if the city codes could be amended to impose automatic penalties for non-renewal of business licenses. Code Enforcement Officer Mullins responded that the license fee was a tax and the amount of the penalty was mandated by Florida Statutes. He agreed to research other cities ordinances pertaining to penalties for non-payment of license renewals and would report back to the Board at the next meeting. Code Enforcement Board Meeting Minutes March 23, 2000 Page 4 Chairperson Russell polled the Board members for consideration to change the meeting time to 7:00 p.m.. A majority of the Board members had no concerns with the consideration of the time change. The Secretary advised that she would contact the one Board member that was absent from this meeting and inquire same. She would report to the members at the next meeting.
