A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida, was held on November 30, 2000, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Chairperson Russell called the meeting to order at 7:00 P.M. The Secretary called the roll. MEMBERS PRESENT Mary Russell Chairperson Charles Biederman Karen Hartley Jeffrey Ratliff Craig Stewart MEMBERS ABSENT Walter Godfrey OTHERS PRESENT Mark McQuagge Assistant City Attorney Morris Reid Code Enforcement Official Susan Chapman Board Secretary Attorney McQuagge swore in all persons giving testimony. It was noted that the next regularly scheduled meeting would be held on January 18, 2001. Motion by Mr. Biederman, seconded by Mrs. Hartley to approve the meeting minutes of September 21, 2000 and October 26, 2000. Vote on the motion carried unanimously. Code Enforcement Board Meeting Minutes November 30, 2000 Page 2 COMPLIANCE HEARINGS: 1. Case No. 00-21, Harold & Denise Toy, (8590 Canaveral Boulevard), Section 14, Township 24 South, Range 37 East, Canaveral Beach Gardens Subdivision, Block 6, Lot 1, Brevard County, Florida. Code Enforcement Official Reid testified that this case was in compliance. 2. Case No. 00-26, Dan Petro, (8720 Seashell Lane), Section 14, Township 24 South, Range 37 East, Harbor Heights 1st Addition Subdivision, Parcel 524, Brevard County, Florida-Violation of Sections 34-97, Storing, Parking or Leaving on Private Property; and 82-371, Posting & Specifications of Numbers of the Cape Canaveral Code of Ordinances. Code Enforcement Official Reid testified that the Mr. Petro did not finish painting his house and the RV still did not have a current tag. The Board held discussion regarding Mr. Petro's testimony from the previous meeting. He had advised the Board that he applied for an out-of-state lost tag. The Board members agreed the Mr. Petro had more than sufficient time to comply. Motion by Mr. Stewart, seconded by Mr. Ratliff to find Case No. 00-26 in non- compliance of the previous Board Order and enter the following Order as follows: Order: That Dan Petro is found in non-compliance with the Board's Order of June 20, 2000 and the Dan Petro shall comply with Sections 34-181 and 82-371 of the City Code of Ordinances on or before December 1, 2000 by taking the following action: Finish painting the house and obtain a current tag and registration for the RV. The Order shall further provide that upon compliance, Dan Petro shall notify Morris Reid, a City Official. He shall inspect the property and notify the Board of compliance. However, upon failure to comply by December 1, 2000, there shall be a fine imposed of $50.00 $50.00 for the first day of non-compliance and $25.00 per day thereafter, until the property is brought into compliance. Daniels, Vehicle Owner, (230 Columbia Drive, Apt. 216) - Violation of Section 34-181, Storing, Parking, or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 4. Case No. 00-42, Aletha Mackowiz, (207 Pierce Avenue) -Violation of Section 34-181, Storing, Parking or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 5. Case No. 00-44, Rick Kopitas, Property Owner, Floyd Falkenberry, Vehicle Owner, (&&25 Poinsetta Ave., Apt 1) -Violation of Section 34-181, Storing, Parking or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 6. Case No. 00-46, Norma Melgaard, Property Owner, Chad Miles,Vehicle Owner, (418 Adams Avenue, Unit 1) -Violation of Section 34-181, Storing, Parking or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 7. Case No. 00-48, Norma Melgaard, Property Owner, Janet Hanson,Vehicle Owner, (418 Adams Avenue, Unit 7) -Violation of Section 34-181, Storing, Parking or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 8. Case No. 00-52, Susanne Sarbye, (333 Tyler Avenue) -Violation of Section 34-181, Storing, Parking or Leaving on Private Property. Case No. 00-49, Tomas Hernandez, (258 Canaveral Beach Blvd.) - Violation of Section 82-371, Posting and Specifications of Numbers of the Cape Canaveral Code of Ordinances. Code Enforcement Official Reid testified that this case was in compliance. 2. Case No. 00-57, Bill Reid, Property Owner, and Jennie Clarkson,Vehicle Owner, (339 Tyler Avenue) -Violation of Section 34-181, Storing, Parking or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 3. Case No. 00-58, Mark Meinhardt, (7450 Magnolia Avenue) -Violation of Section 34-181, Storing, Parking or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 4. Case No. 00-59, KDE Corporation, Property Owner, Kevin Weyant, Vehicle Owner, (220 Lincoln Avenue, Apt. 11B) -Violation of Section 34- 181, Storing, Parking or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 5. Case No. 00-60, S. Armanno, Property Owner, Nicole Smith,Vehicle Owner, (8034 Orange Avenue) -Violation of Section 34-181, Storing, Parking, or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 6. Case No. 00-61, Virginia Eberwein and Elizabeth Johnson, Property Owners, James E. Bloyd, III,Vehicle Owner, (8012 Magnolia Avenue) - Violation of Section 34-181, Storing, Parking, or Leaving on Private Property. Mr. Bloyd testified that the vehicle was not registered or tagged because he had received it from a family member who was sending the title from Connecticut. He advised that when the title is received, he would register and tag the vehicle. Chairperson Russell advised that the Board could only find the vehicle in compliance or in violation. Motion carried unanimously. 7. Case No. 00-62, Jerry Schmitz, Property/Vehicle owner, (305 Surf Drive) - Violation of Section 34-181, Storing, Parking, or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 8. Case No. 00-63, Pearman Bednarcik, Property/Vehicle owner, (226 Circle Drive) -Violation of Section 34-181, Storing, Parking, or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 9. Case No. 00-64, VFW Post 10131, Property/Vehicle owner, (106 Long Point Road) -Violation of Section 34-181, Storing, Parking, or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 10. Case No. 00-65, Renee' Gilroy, Property/Vehicle owner, (270 Canaveral Beach Blvd.) -Violation of Section 34-181, Storing, Parking, or Leaving on Private Property. Code Enforcement Official Reid testified that this case was in compliance. 11. Case No. 00-66, James Murphy, Property Owner, Timothy Vickey,Vehicle Owner, (630 Adams Avenue, Apt. 9) -Violation of Section 34-181, Storing, Parking or Leaving on Private Property.
