A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida, was held on February 18, 1999, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Chairperson Russell called the meeting to order at 7:30 P.M. The Secretary called the roll. MEMBERS PRESENT Mary Russell Chairperson Donna Boone Charles Biederman Jeffrey Ratliff Karen Hartley MEMBERS ABSENT Walter Godfrey Carol Warner Vice Chairperson OTHERS PRESENT Mitch Goldman Assistant City Attorney Greg Mullins Code Enforcement Officer Susan Chapman Board Secretary Greg Mullins, Code Enforcement Officer; Mary McCoy and Paul Ward, citizens; were sworn in by Attorney Goldman. It was noted that the next meeting would be held on March 18, 1999. Mrs. Russell asked the Board members to contact the Board Secretary if they were not going to be able to attend the next scheduled meeting. Mr. Godfrey advised that he would not be able to attend the next meeting. Code Enforcement Board Meeting Minutes February 18, 1999 Page 2 Motion by Mrs. Hartley, seconded by Ms. Boone to approve the meeting minutes of January 21, 1999 as submitted. Vote on the motion carried unanimously. COMPLIANCE HEARINGS: 1. Case No. 99-02, Kathy McCann, (211 Circle Drive), Section 14, Township 24 South, Range 37 East, Avon by the Sea Subdivision, Block 5, Lot 2, Brevard County, Florida -Violation of Section 24-181, Storing, Parking, or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that the vehicle had been removed and this Case was in compliance. 2. Case No. 99-03, James Smith, (374 Jefferson Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea Subdivision, Block 9, Lots 13, 14 & 15, Brevard County, Florida -Violation of Section 34-181, Storing, Parking or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that the vehicle had been removed and this Case was in compliance. 3. Case No. 99-05, Ronald &Gloria Purcell, (224 Adams Avenue), Unit #8, Section 23, Township 24 South, Range 37 East, Avon by the Sea Subdivision, Block 2, Lots 15 & 16, Brevard County, Florida -Violation of the 1994 Standard Fire Prevention Code, as adopted by the City, Chapter 35, Garages, Section 3502.4, Garaged or Stored Vehicles of the Cape Canaveral Code of Ordinances. Mr. Mullins testified that the vehicle was being stored in a proper location and this Case was in compliance. Code Enforcement Board Meeting Minutes February 18, 1999 Page 3 REQUEST FOR REDUCTION OF IMPOSED FINE AMOUNT: 1. Case No. 98-47, Magma Trading Corporation, (8200 Astronaut Blvd.), Section 23, Township 24 South, Range 37 East, Parcel 286, Brevard County, Florida -Violation of Section 24-97, Duties and Responsibilities for Maintenance, and Section 94-7, Conformance, of the Cape Canaveral Code of Ordinances. Mr. Mullins submitted a letter, dated February 13, 1999, from Magma Trading Corporation asking that his request to reduce the imposed fine be postponed (Exhibit A). The Board members reviewed the letter (Exhibit A). Brief discussion followed. Motion by Mrs. Hartley, seconded by Ms. Boone to table this Request indefinately. Vote on the motion carried unanimously. PUBLIC HEARINGS: 1. Case No. 99-06, Pearman Bednarick, (226 Circle Drive), Section 14, Township 24 South, Range 37 East, Canaveral Beach Gardens Subdivision, Block 6, Lot 5, Brevard County, Florida -Violation of Section 34-181, Storing, Parking, or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Mr. Mullins testified that the vehicle was moved to an acceptable location and this Case was in compliance. 2. Case No. 99-07, Anthony C. Giovannangeli, (307 Adams Avenue, Apt. #12), Section 23, Township 24 South, Range 37 East, Avon by the Sea Subdivision, Block 9, Lots 3, 4 & 5, Brevard County, Florida -Violation of Section 34-181, Storing, Parking or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Mr. Mullins testified that the vehicle was impounded by the City and this Case was in compliance. Code Enforcement Board Meeting Minutes February 18, 1999 Page 4 3. Case No. 99-08, M & P of Brevard, Inc., (8580 N. Atlantic Avenue), Section 14, Township 24 South, Range 37 East, Canaveral Beach Gardens Subdivision, Block 3, Loa 13.01, Brevard County, Florida. Mr. Mullins testified that the property owner had requested that this Case be postponed until the next meeting to allow him time to paint the exterior of the building. The Board members reviewed the letter requesting postponement, dated February 16, 1999 (Exhibit A). Brief discussion followed. Motion by Mr. Biederman, seconded by Mr. Ratliff to table Case No. 99-08 until the next scheduled meeting. Vote on the motion carried unanimously. 4. Case No. 99-09, Amin & Patel Investments, Inc., (8050 N. Atlantic Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea Subdivision, Block 13, Lots 1-3 and 1/2 of Lot 4, Brevard County, Florida - Violation of Section 34-97, Duties and Responsibilities for Maintenance of the Cape Canaveral Code of Ordinances. Mr. Mullins testified that this property had been sold and the new property owner would need to be cited for this violation. Mr. Mullins then withdrew the Case. 5. Case No. 99-10, Kimberly Spencer, (203 Tyler Avenue), Section 23, Township 24 South, Range 37 East, Block 42, Lot 1.02, Brevard County, Florida -Violation of Section 34-98, Building Appearance and Maintenance of the Cape Canaveral Code of Ordinances. Mr. Mullins testified that this Case was in compliance. 6. Case No. 99-11, Charles &Jennifer Hall, (327 Pierce Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea Subdivision, Block 58, Lot 6, Brevard County, Florida -Violation of Section 34-97, Duties and Responsibilities for Maintenance of the Cape Canaveral Code of Ordinances.
