A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida, was held on July 22, 1999, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Chairperson Russell called the meeting to order at 7:30 P.M. The Secretary called the roll. MEMBERS PRESENT Mary Russell Chairperson Carol Warner Vice Chairperson Donna Boone Charles Biederman Karen Hartley MEMBERS ABSENT Walter Godfrey Jeffrey Ratliff OTHERS PRESENT Kohn Bennett City Attorney Greg Mullins Code Enforcement Officer Susan Chapman Board Secretary Greg Mullins, Code Enforcement Officer; Hans and Marianne Saurenmann, citizens; were sworn in by Attorney Goldman. It was noted that the next meeting would be held on August 19, 1999. Motion by Ms. Boone, seconded by Mrs. Russell to postpone the approval of the meeting minutes of June 17, 1999 because some of the pages were missing from their packets. Case No. 99-14, Robert& Jacqueline Bevis, (607 Adams Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 12, Lot 1.01, Brevard County, Florida -Violation of Chapter 34, Environment, Section 34-96, Standards Established, Paragraph (C) of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 2. Case No. 99-16, David Norton, (7521 Magnolia Avenue, Apt. #4), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 43, Lot 15, Brevard County, Florida -Violation of Chapter 34, Environment, Section 34-181, Storing, Parking, or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. PUBLIC HEARINGS: 1. Case No. 99-12, Ocean Carpets, Inc., (8555 Astronaut Boulevard), Section 15, Township 24 South, Range 37 East, Parcel 761, Brevard County, Florida -Violation of Section 94-31, Permits Required of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 2. Case No. 99-13, Canaveral Bay Condo. Association, (200 International Drive, Unit #202), Section 22, Township 24 South, Range 37 East, Parcel 297-300.3, Brevard County, Florida -Violation of the 1997 Standard Housing Code, Southern Building Code Congress International, as adopted by the City, Chapter 3, Section 305.12, Exterior Door Frames of the Cape Canaveral Code of Ordinances. Code Enforcement Board Meeting Minutes July 22, 1999 Page 3 Code Enforcement Officer Mullins testified that the Association's attorney was not available for tonight's meeting and had requested a postponement until the next scheduled meeting. Mr. Mullins submitted a letter requesting postponement (Exhibit A). Brief discussion followed. Motion by Vice Chairperson Warner, seconded by Mr. Biederman to postpone the Public Hearing in Case No. 99-13 until the next scheduled meeting. Vote on the motion carried by majority with members voting as follows: Mr. Biederman, for; Ms. Boone, against; Mrs. Hartley, for; Mrs. Russell, for; Mrs. Warner, for. 3. Case No. 99-15, Sable Condo. Association, President Herb Ellis, (8150 Rosalind Avenue), Section 23, Township 24 South, Range 37 East, Block 11, Lots 1 & 2, Brevard County, Florida -Violation of Chapter 62, Solid Waste, Section 62-9, Paragraph (F), Residential Solid Waste Pick-up Conditions of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 4. Case No. 99-19, Craig Donceel, (625 Manatee Bay Drive), Section 15, Township 24 South, Range 37 East, Manatee Bay Subdivision, Lot 25, Brevard County, Florida -Violation of Chapter 110, Zoning, Section 110- 582, Swimming Pool Enclosures of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that the swimming pool enclosure surrounding the swimming pool for safety requirements had been removed. He further testified that the property owner had then installed temporary fence and was waiting for approval by the city's Community Appearance Board to construct a permanent block wall. Mr. Mullins advised that this case was in compliance. 5. Case No. 99-20, Frances Cassar, (6615 N. Atlantic Avenue, Bldg. A), Section 22, Township 24 South, Range 37 East, Parcel 511, Brevard County, Florida -Violation of Chapter 70, Taxation, Section 70-69, License Required; Payment of Tax Prerequisite to Issuance of the Cape Canaveral Code of Ordinances. Case No. 99-21, General Realty Enterprises, Leon Newman, (8147 Canaveral Boulevard), Section 14, Township 24 South, Range 37 East, Parcel 518, Brevard County, Florida -Violation of Chapter 70, Taxation, Section 70-69, License Required; Payment of Tax Prerequisite to Issuance of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 7. Case No. 99-22, Sandy Stewart, (Halfmoon Creations), (321 Washington Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 7, Lot 3, Brevard County, Florida -Violation of Chapter 70, Taxation, Section 70-69, License Required; Payment of Tax Prerequisite to Issuance of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 8. Case No. 99-23, Scott Foster, (K &S Novelties), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 35, Lots 6-8, Brevard County, Florida -Violation of Chapter 70, Taxation, Section 70-60, License Required; Payment of Tax Prerequisite to Issuance of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that the certified return receipt had not been returned from the post office and requested that this case be tabled. After brief discussion, the Board concurred with his request. 9. Case No. 99-24, Robert& Dana Lance, (214 Madison Avenue, Apt. 2), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 14, Lots 12 & 13, Brevard County, Florida -Violation of Chapter 34, Environment, Section 34-181, Storing, Parking or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that an inoperable vehicle was being parked upon the property. He submitted a photograph of the vehicle (Exhibit A). The Board members reviewed Section 34-181 of the City Code. Brief discussion followed. Code Enforcement Board Meeting Minutes July 22, 1999 Page 5 Motion by Ms. Boone, seconded by Mrs. Hartley to find the vehicle located at 214 Madison Avenue, Apt. #2 to be considered a public nuisance and shall be removed. Vote on the motion carried unanimously. 10. Case No. 99-25, Paul Plisend, (247 Canaveral Beach Boulevard), Section 14, Township 24 South, Range 37 East, Canaveral Beach Gardens, Block 4, Lot 6, Brevard County, Florida -Violation of Chapter 34, Environment, Section 34-181, Storing, Parking or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. There being no further business, the meeting was adjourned at 8:12 P.M. Approved on this 19th day of August , 1999.
