A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida,was held on August 19, 1999, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Chairperson Russell called the meeting to order at 7:30 P.M. The Secretary called the roll. MEMBERS PRESENT Mary Russell Chairperson Donna Boone Jeffrey Ratliff Karen Hartley MEMBERS ABSENT Carol Warner Vice Chairperson Walter Godfrey Charles Biederman OTHERS PRESENT Mitch Goldman City Attorney Greg Mullins Code Enforcement Officer Sandra Sims City Clerk Greg Mullins, Code Enforcement Officer; Hans and Marianne Saurenmann, citizens; Mr. Weidman, Canaveral Bay Association; and Janet Balencourt, Canaveral Bay Association Secretary were sworn in by Attorney Goldman. It was noted that the next meeting would be held on September 23, 1999. Motion by Ms. Boone, seconded by Ms. Hartley to approve the meeting minutes of June 17, 1999 and July 22, 1999. Vote on the motion carried unanimously. Code Enforcement Board Meeting Minutes August 19, 1999 Page 2 COMPLIANCE HEARINGS: 1. Case No. 99-24, Robert and Dana Lance, (214 Madison Avenue, Apt. #2), Section 23, Township 24 South, Range 37 East, Avon-by-the-Sea, Block 14, Lots 12 and 13, Brevard County, Florida -Violation of Chapter 34, Environment, Section 34-181, Storing, Parking, or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. PUBLIC HEARINGS: 1. Case No. 99-13, Canaveral Bay Condominium Association, (200 International Drive, Unit #202), Section 22, Township 24 South, Range 37 East, Parcel 297-300.3, Brevard County, Florida -Violation of the 1997 Standard Housing Code, Southern Building Code Congress International, as adopted by the City, Chapter 3, Section 305-12, Exterior Door Frames of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was not in compliance. Mr. Mullins submitted photographs of the door and door frame along with an invoice from the Association showing some of the work was done (Exhibits A & B). Mr. Mullins advised that the exterior was now in compliance. Mr. Wiedman, representing the Association, advised that the problem was that access has never been provided to the inside of the unit and therefore, the Association was of the opinion that the necessary repairs were completed. Ms. Hartley clarified that the Association was accepting responsibility, but could not get access. Mr. Mullins submitted photographs of the interior door-way (Exhibit C). He advised that access was gained by the maintenance person being allowed into the unit by the tenant. Discussion followed. Following discussion, a time certain was established to estimate the cost of repairs between Mr. Saurenmann, Mr. Wiedman, a contractor and a city official. It was determined that Mr. Wiedman must contact the contractor; and Mr. Mullins to contact Mr. Saurenmann. Motion by Ms. Hartley and seconded by Mr. Ratliff to table this item until the September 23, 1999 meeting. Vote on the motion carried unanimously. Case No. 99-23, Scott Foster, (K & S Novelties)(516 Harrison Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 35, Lots 6-8, Brevard County, Florida -Violation of Chapter 70, Taxation, Section 70-60, License Required; Payment of Tax Prerequisite to Issuance of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 3. Case No. 99-26, Scott Clark, Cabinetry Making, (357 Imperial Boulevard, Bldg. D, Unit #1), Section 15, Township 24 South, Range 37 East, Parcel 812, Brevard County, Florida -Violation of Chapter 70, Taxation, Section 70-69,License Required; Payment of Tax Prerequisite to Issuance of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 4. Case No. 99-27, Wayne Buttencourt, (7521 Magnolia Avenue, Apt. #4), Section 23, Township 24 South, Range 37 East, Avon-by-the-Sea, Block 43, Lot 15, 15.01, Brevard County, Florida -Violation of Chapter 34, Environment, Section 34-181, Storing, Parking or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was not in compliance. Mr. Mullins submitted a photograph taken after 4pm today demonstrating that the vehicle was still on the property. The property owner responded to the notice on July 25, 1999 and stated that the apartment number was actually #7. Since he registered his appeal, there has been no correspondence with him. It was noted that Mr. Buttencourt nor a representative were present at the meeting. Motion by Ms. Boone and seconded by Ms. Hartley finding that there is a nuisance.
