CODE ENFORCEMENT BOARD
REGULAR MEETING
JANUARY 22, 1998
7:30 P.M.
A Regular Meeting of the Code Enforcement Board of the City of Cape
Canaveral, Florida, was held on January 22, 1998, at the City Hall Annex, 111
Polk Avenue, Cape Canaveral, Florida.
Chairperson Russell called the meeting to order at 7:30 P.M. The Secretary called
the roll.

Code Enforcement Officer Greg Mullins was sworn in by Attorney Goldman.
It was noted that the next meeting would be held on February 19, 1998.
Motion by Mr. Godfrey, seconded by Mr. Biederman to approve the meeting
minutes of December 11, 1997. Vote on the motion carried unanimously.
PUBLIC HEARINGS:
1. Case No. 97-48, Treasure Island Club Condo. Association, (300 Columbia
Drive), Section 22, Township 24 South, Range 37 East, Columbia Plaza
Subdivision, Lots 6-13, Brevard County, Florida -Violation of National
Fire Protection Act 101, Life Safety Code, Chapter 5, Section 1.3.1, Exists,
Chapter 19, Section 3.1, Protection of Vertical Openings.

Code Enforcement Officer Mullins testified for Fire Marshal Watson that this
case was in compliance.
2. Case No. 98-01, Dana Makepeace (105 Columbia Drive), Section 23,
Township 24 South, Range 37 East, Columbia Plaza Subdivision, Lot 18.08,
Brevard County, Florida-Violation of Section 34-181, Storing, Parking or
Leaving on Private Property.
Code Enforcement Officer Mullins testified that this case was in compliance.
3. Case No. 98-02, Theisen Development Corp., (8150 Astronaut Blvd.),
Section 23, Township 24 South, Range 37 East, Parcel 254.1, Brevard
County, Florida -Violation of Section 94-7, Conformance, and Section 94-
64, Criteria and Standards for Measurement and Placement of the Cape
Canaveral Code of Ordinances.
Code Enforcement Officer Mullins testified that Theisen Development Corp. took
ownership of the property approximately (2) years ago. Mr. Theisen was
advised by Mr. Mullins at that time, that the sign did not comply with the City
code because it exceeded the maximum allowable square footage and was not
being properly maintained. Code Enforcement Officer Mullins submitted a
photograph of the existing sign (Exhibit A); Courtesy Request to bring the sign
into compliance, dated August 4, 1997 (Exhibit B); and a letter from Mr. Theisen
requesting the Board to allow him until February to bring the sign into
compliance (Exhibit C). The Board members reviewed the entered exhibits. Brief
discussion followed.
Motion by Ms. Boone, seconded by Mr. Biederman to find Case No. 98-02 in
violation of the Cape Canaveral Code of Ordinances as follows:
Findings of Fact: The existing ground sign does not conform to the
required City code criteria.
Conclusion of Law: Theisen Development Corporation is in violation of
Chapter 94, Signs; Section 94-7, Conformance, and 94-64, Criteria and
Standards for Measurement & Placement of the Cape Canaveral Code of
Ordinances.

Order: That Theisen Development Corporation comply with the
aforementioned Sections of the City Code of Ordinances on or before
March 12, 1998 by taking the following action: Alter the existing sign to
conform or remove the sign from the property.
Upon complying, Theisen Development Corporation shall notify Greg
Mullins, a City Official. He shall inspect the property and notify the
Board.
Should Theisen Development Corporation fail to comply on or before
March 12, 1998 with the above Order and the Code Enforcement Board
finds that they are still in violation, then a fine shall be levied in the
amount of $150.00 per day, for the first day of non-compliance and $25.00
per day thereafter, for each and every day the violation exists and
continues to exist, plus any fees for costs incurred by City staff.
Vote on the motion carried unanimously.
4. Case No. 98-03, Ocean Carpets, (8555 Astronaut Blvd.), Section 15,
Township 24 South, Range 37 East, Parcel 761, Brevard County, Florida -
Violation of Section 34-97, Duties and Responsibilities for Maintenance of
the Cape Canaveral Code of Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
5. Case No. 98-04, Villas Investment, Inc., (418 Taylor Avenue), Section 23,
Township 24 South, Range 37 East, Sea Shore Townhomes, Lots 7,8,9,11,14
& 15 (402, 404,406,407 &409 Taylor Avenue and 7454 Magnolia Avenue),
Brevard County, Florida- Violation of Section 70-71, Engaging in Business
Without Paying Tax or Making Reports and Section 70-89, Schedule of
Fees of the Cape Canaveral Code of Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.

6. Case No. 98-05, James Murphy, (214 Monroe Avenue), Section 23,
Township 24 South, Range 37 East, Avon by the Sea Subdivision, Lot 12,
Block 20, Brevard County, Florida -Violation of Section 34-181, Storing,
Parking or Leaving on Private Property of the Cape Canaveral Code of
Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
7. Case No. 98-06, Spaceport Amoco, (8000 Astronaut Blvd.), Section 23,
Township 24 South, Range 37 East, Parcel 287, Brevard County, Florida -
Violation of Section 82-371, Posting and Specifications of Numbers of the
Cape Canaveral Code of Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
8. Case No. 98-07, Mr. Johnson, (7603 Poinsetta Ave.), Section 23, Township
24 South, Range 37 East, Avon by the Sea Subdivision, Lot 16, Block 36,
Brevard County, Florida -Violation of Section 34-181, Storing, Parking or
Leaving on Private Property of the Cape Canaveral Code of Ordinances.
Code Enforcement Officer Mullins submitted photographs of the vehicles in
violation (Exhibits A & B). Mr. Mullins testified that Mr. Johnson advised that
the vehicles would be removed from the property before the next meeting. Mr.
Mullins requested that this case be tabled until the next meeting.
Motion by Mr. Godfrey, seconded by Mrs. Hartley to table Case No. 98-07 until
the next meeting. Vote on the motion carried unanimously.
9. Case No. 98-08, Avis J. Gero, (118 Tyler Ave.), Section 23, Township 24
South, Range 37 East, Avon by the Sea Subdivision, Lot 13, Block 36,
Brevard County, Florida -Violation of Section 34-181, Storing, Parking or
Leaving on Private Property of the Cape Canaveral Code of Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
