CODE ENFORCEMENT BOARD
REGULAR MEETING
MAY 21, 1998
7:30 P.M.
A Regular Meeting of the Code Enforcement Board of the City of Cape
Canaveral, Florida,was held on May 21, 1998, at the City Hall Annex, 111 Polk
Avenue, Cape Canaveral, Florida.
Chairperson Russell called the meeting to order at 7:30 P.M. The Secretary called
the roll.

Greg Mullins, Code Enforcement Officer was sworn in by Attorney Goldman.
It was noted that the next meeting would be held on June 18, 1998.
Motion by Mrs. Warner, seconded by Ms. Boone to approve the meeting minutes
of April 23, 1998. Vote on the motion carried unanimously.

INTERVIEW OF PROSPECTIVE BOARD MEMBER: Jeffery A. Ratliff
Mr. Ratliff explained that he had moved to Cape Canaveral one year ago and
would like to volunteer some of his free time to the City. He advised that he
works as an environmental consultant in Titusville. He noted that the
Beautification Board was his first choice he wished to serve and the Code
Enforcement Board was his second. Since there were no openings on the
Beautification Board at this time, City Council had suggested he be interviewed
by the Code Enforcement Board. Chairperson Russell introduced the Board
members and welcomed Mr. Ratliff to the Board.
COMPLIANCE HEARINGS:
1. Case No. 98-24, Jeffery Kellum, (8910 Coquina Lane), Section 14,
Township 24 South, Range 37 East, Brevard County, Florida-Violation of
Section 34-181, Storing, Parking or Leaving on Private Property of the
Cape Canaveral Code of Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
2. Case No. 98-31,Wade Miller, (8417 Rosalind Avenue), Section 14,
Township 24 South, Range 37 East, Cape Canaveral Beach Gardens, Block
B, Lot 13, Brevard County, Florida-Violation of Section 34-97, Duties and
Responsibilities for Maintenance of the Cape Canaveral Code of
Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
3. Case No. 98-34, Tony Greenwell, (8911 N. Atlantic Avenue, Lot#66),
Section 14, Township 24 South, Range 37 East, Parcel 251.2, Brevard
County, Florida -Violation of Section 110-469,Visibility at Intersections of
the Cape Canaveral Code of Ordinances.

4. Case No. 98-38, Brenda C. Hannafin(leasee), (350 Monroe Avenue),
Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 21,
Lots 14 & 15, Brevard County, Florida -Violation of Section 34-181,
Storing, Parking or Leaving on Private Property of the Cape Canaveral
Code of Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
PUBLIC HEARINGS:
1. Case No. 98-33, Brian Brown, (7666 Orange Avenue), Section 23,
Township 24 South, Range 37 East, Avon by the Sea, Block 38, Lot 1,
Brevard County, Florida-Violation of Sections 110-106, Permits Required
and 110-468, Accessory Structures of the Cape Canaveral Code of
Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
2. Case No. 98-39, Harold Roddan, (309 Harrison Avenue), Section 23,
Township 24 South, Range 37 East, Avon by the Sea, Block 38, Lot 6,
Brevard County, Florida-Reoccurring violation of Code Enforcement
Board Order, Case No. 96-09, dated April 18, 1996.
Code Enforcement Officer Mullins testified that this was a reoccurring violation
in that the fence had needed to be repaired and the grass and weeds had been
above the 6" in height requirement. He further testified that Mr. Roddan had
made the necessary repairs to the fence and cut the grass and weeded as of this
meeting date and therefore, this case was in compliance.
3. Case No. 98-40, Randy Mays, (245 Challenger Road), Section 15, Township
24 South, Range 37 East, Parcel 2, Brevard County, Florida-Violation of
Section 62-11, Unlawful Acts of the Cape Canaveral Code of Ordinances.
Code Enforcement Officer Mullins testified that a fire hazard existed upon the
property from an accumulation of debris being stored on the west end of the
property. He submitted a photograph of the debris (Exhibit A). Mr. Mullins
requested that the Board impose an Order to have the debris removed by a date
certain.

Motion by Ms. Boone, seconded by Mrs. Warner to find Case No. 98-40 in
violation of the Cape Canaveral Code of Ordinances as follows:
Findings of Fact: There exists an accumulation of debris being stored
upon the west end of the property.
Conclusion of Law: Randy Mays was in violation of Section 62-11,
Unlawful Acts of the Cape Canaveral Code of Ordinances.
Order: Randy Mays shall comply with the aforementioned Section of the
City Code of Ordinances on or before June 11, 1998 by taking the
following action: Remove the debris being stored.
Upon complying, Randy Mays shall notify Greg Mullins, a City Official.
He shall inspect the property and notify the Board. Should The Canaveral
Corporation fail to comply on or before June 11, 1998 with the above
Order and the Code Enforcement Board finds that they are still in
violation, then a fine shall be levied in the amount of $125.00 per day, for
the first day of non-compliance and $25.00 per day thereafter, for each and
every day the violation exists and continues to exist, plus any fees for
costs incurred by City staff.
Vote on the motion carried unanimously.
4. Case No. 98-41, Ida Bruss, (8201 Canaveral Blvd.), Section 14, Township 24
South, Range 37 East, Canaveral Beach Gardens, Block 4, Lot 1, Brevard
County, Florida -Violation of Sections 34-97, Duties and Responsibilities
for Maintenance, 110-468, Accessory Structures, and 82-371, Posting and
Specifications of Numbers of the Cape Canaveral Code of Ordinances.
Code Enforcement Officer Mullins testified that he had posted a violation notice
upon the property because all the certified notices had been returned unclaimed
and there was no mail receptacle. He advised that the grass and weeds were
overgrown, the fence needed repairing, the window on the second floor needed
to be repaired, the awning canvas's needed to be cleaned, the property address
was not clearly displayed, and an unpermitted accessory structure placed in the
front yard needed to be removed. Mr. Mullins entered a photograph of the
property (Exhibit A). He explained that no contact had been made from Ms.

Bruss and he could not determine if anyone was residing at the property. Mr.
Mullins advised that their was an accruing lien currently placed on the property
from a previous code enforcement action that still existed. He informed the
Board that the last contact he had with Ms. Bruss was over one-year ago and that
no contact had been made since that time. Mr. Mullins requested that the Board
table this Case until the next meeting to allow him time to contact the Bureau of
Vital Statistics to inquire if Ms. Bruss was still alive. Brief discussion followed.
Motion by Mr. Biederman, seconded by Mr. Godfrey to table Case No. 98-41
until the next scheduled meeting.
5. Case No. 98-42, Magma Trading Corporation (8200 Astronaut Boulevard),
Section 23, Township 24 South, Range 37 East, Parcel 286, Brevard County,
Florida -Violation of Sections 34-97, Duties and Responsibilities for
Maintenance, and 94-7, Conformance of the Cape Canaveral Code of
Ordinances.
Mr. Mullins withdrew this case because he needed to discuss additional
violations with the property owner.
6. Case No. 98-43, Cindi Griffin, (314 Lincoln Avenue), Section 23,Township
24 South, Range 37 East, Avon by the Sea Subdivision, Block 67, Lot 14,
Brevard County, Florida-Violation of Section 34-181, Storing, Parking or
Leaving on Private Property of the Cape Canaveral Code of Ordinances.
Mr. Mullins advised that Ms. Griffin requested an Appeal Hearing before the
Board regarding in inoperable vehicle. He further advised that Ms. Griffin was
mailed a meeting agenda and was aware of the meeting. It was noted the she
was not in attendance. Mr. Mullins submitted a letter requesting an Appeal
(Exhibit A) and a photograph of the inoperable vehicle which was determined to
be a public nuisance (Exhibit B). The Board members reviewed the exhibits.

Motion by Mrs.Warner, seconded by Mr. Godfrey that based on the evidence
presented by Mr. Mullins, a Code Enforcement Official, the Board had
established that the inoperable and untagged motor vehicle that existed upon the
property was determined to be a public nuisance and shall be removed and the
request for an Appeal be denied. Vote on the motion carried unanimously, as
amended.
7. Case No. 98-44, Ray Beford, (6855 Poinsetta Avenue, Unit#15), Section 23,
Township 24 South, Range 37 East, Avon by the Sea Subdivision, Block 73,
Lots 7 &8, Brevard County, Florida -Violation of Section 34-181, Storing,
Parking or Leaving on Private Property of the Cape Canaveral Code of
Ordinances.
Code Enforcement Officer Mullins testified that this case was in compliance.
There being no further business, the meeting was adjourned at 8:15 P.M.
