A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida,was held on August 20, 1998, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Chairperson Russell called the meeting to order at 7:30 P.M. The Secretary called the roll. MEMBERS PRESENT Mary Russell Chairperson Carol Warner Vice Chairperson Donna Boone Charles Biederman Karen Hartley MEMBERS ABSENT Walter Godfrey Jeffrey Ratliff OTHERS PRESENT Mitch Goldman Assistant City Attorney Greg Mullins Code Enforcement Officer Susan Chapman Board Secretary Greg Mullins, Code Enforcement Officer;Jacqueline Biles and Thomas Bartol, citizens; were sworn in by Attorney Goldman. It was noted that the next meeting would be held on September 17, 1998. Motion by Mr. Biederman, seconded by Ms. Boone to approve the meeting minutes of June 18, 1998. Vote on the motion carried unanimously. Code Enforcement Board Meeting Minutes August 20, 1998 Page 2 COMPLIANCE HEARINGS: 1. Case No. 98-37, Kishor Pathare, (299 Chandler Street), Section 14, Township 24 South, Range 37 East, Key Shore replat of Block B, Canaveral Beach Gardens, Brevard County, Florida -Violation of Section 34-97, Duties and Responsibilities for Maintenance of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 2. Case No. 98-43, Cindi Griffin, (314 Lincoln Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 67, Lot 14, Brevard County, Florida -Violation of Section 34-181, Storing, Parking or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 3. Case No. 98-46, Cape Canaveral Office Center, (7980 N. Atlantic Avenue), Section 23, Township 24 South, Range 37 East, Block 19, Lots 1-3, Brevard County, Florida -Violation of Section 34-97, Duties and Responsibilities for Maintenance of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in partial compliance with Board Order of June 18, 1998. He advised that Cape Canaveral Office Center had made the necessary repairs to the parking lot asphalt, however, the roof overhangs and soffit needed to be replaced. Mr. Mullins advised that a contractor had obtained the required permit for the roof repair. He requested that the Board table the compliance hearing for this case until the next scheduled meeting. Mr. Mullins entered photographs of the property (Exhibits A & B). Brief discussion followed. Motion by Mrs. Warner, seconded by Mr. Biederman to table the Compliance Hearing for Case No. 98-46 until the next scheduled meeting. Vote on the motion carried unanimously. Case No. 98-47, Magma Trading Corporation, (8200 Astronaut Blvd.), Section 23, Township 24 South, Range 37 East, Parcel 286, Brevard County, Florida -Violation of Section 34-97, Duties and Responsibilities for Maintenance of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was not in compliance with the Board Order of June 18, 1998. Mr. Mullins submitted photographs of the property (Exhibits A-D) and letter from Jeff & Sandra Rich (Exhibit E) regarding informing Mr. Mullins that the property has been leased to a new business. Chairperson Russell read the letter for clarification. Mr. Mullins assured the Board that no business license would be issued until the property is brought into compliance. Mr. Mullins requested that the Board find this case in non-compliance. The Board members reviewed the entered exhibits. Brief discussion followed. Motion by Mrs. Warner, seconded by Mrs. Hartley to find Case No. 98-47 in non- compliance with the Code Enforcement Board Order dated June 18, 1998. Vote on the motion carried unanimously. 5. Case No. 98-49, Edmund Guido, (357 Imperial Blvd.), Section 15, Township 24 South, Range 37 East, Parcel 819, Brevard County, Florida - Violation of Section 34-181, Storing, Parking or leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 6. Case No. 98-50, Bill Barnes, (8570 Commerce Street), Section 15, Township 24 South, Range 37 East, parcel 750, Brevard County, Florida -Violation of Section 34-181, Storing, Parking or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. Code Enforcement Board Meeting Minutes August 20, 1998 Page 4 PUBLIC HEARINGS: 1. Case No. 98-45, The Oaks Condominium Association, (201 International Drive, Apt. #124), Section 22/23, Township 24 South, Range 37 East, Parcel 7, Brevard County, Florida-Violation of Chapter 82, Land Development Code, as adopted by the Southern Building Code Congress International, Chapter 15, Roof and Roof Structures, Section 1503.4, Replacement/Recovering. Code Enforcement Officer Mullins testified that the unit owners advised that the Condominium Association had repaired the roof and did not notice any further leakage. Mr. Mullins had requested that the Association President provide him with information regarding the roof being replaced. He requested that the Board table this public hearing until the next meeting. Motion by Mrs. Warner, seconded by Mrs. Hartley to Table Case No. 98-45 until the next meeting. Vote on the motion carried unanimously. 2. Case No. 98-51, Thomas G. Bartol, (218 Johnson Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 70, Lot 12, Brevard County, Florida -Violation of Section 34-181, Storing, Parking or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that the vehicle had no current tag or registration. He advised that the owner of the vehicle had requested a hearing before the Board. Mr. Mullins submitted a photograph of the vehicle (Exhibit A). Mr. Bartol testified that he had been under house arrest for (8) months while living on Grant Avenue. He then moved to 218 Johnson Avenue and brought the vehicle with him. Attorney Goldman explained the procedures for posting inoperable vehicles pursuant to Section 34-181 of the Cape Canaveral Code of Ordinances. He advised that Mr. Bartol could bring the vehicle into compliance by updating the registration and obtaining a current tag. Mr. Goldman clarified that the Board Code Enforcement Board Meeting Minutes August 20, 1998 Page 5 could only ascertain whether or not the vehicle was determined to be a public nuisance pursuant to the definition of the city code. Brief discussion followed. Motion by Ms. Boone, seconded by Mrs. Warner that the Board has determined the vehicle to be a public nuisance pursuant to Section 34-181 of the City Code. Vote on the motion carried unanimously. 3. Case No. 98-52, Joseph Malie, (121 Monroe Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 25, Lots 5 & 6, Brevard County, Florida -Violation of Section 34-181, Storing, Parking on Private Property of the Cape Canaveral Code of Ordinances. Mr. Code Enforcement Officer Mullins testified that this case was not in compliance. He advised that the owner of the vehicle was currently out-of-state. The Board members reviewed a letter from Mr. Malie and a photograph of the vehicle (Exhibit A). Brief discussion followed regarding the contents of Mr. Malie's letter which indicated that he would take care of the car properly following the 4th of July holiday. Motion by Ms. Boone, seconded by Mr. Biederman that the Board has determined the vehicle to be a public nuisance pursuant to Section 34-181 of the City Code. Vote on the motion carried unanimously. 4. Case No. 98-53, Keith Avery, (8817 N. Atlantic Avenue, Lot 100), Section 14, Township 24 South, Range 37 East, Parcel A-1, A-2, Brevard County, Florida -Violation of Section 34-181, Storing, Parking, or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. 5. Case No. 98-54, Jacqueline Biles, (8817 N. Atlantic Avenue, Lot 32), Section 14, Township 24 South, Range 37 East, Parcel A-1, A-2, Brevard County, Florida -Violation of Section 34-181, Storing, Parking or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was not in compliance. He advised that the vehicle was not registered and did not have a current tag. He submitted a photograph of the vehicle (Exhibit A). Code Enforcement Board Meeting Minutes August 20, 1998 Page 6 Ms. Biles testified that she had recently acquired the car however, the title was not in her name, she did not have insurance, current registration, or tag. She requested a (30) day grace period to bring the vehicle into compliance. Brief discussion followed. Motion by Ms. Boone, seconded by Mr. Biederman that the Board has determined the vehicle to be a public nuisance pursuant to Section 34-181 of the City Code. Vote on the motion carried unanimously. 6. Case No. 98-55, Dwight Olmsted, (121 Monroe Avenue, Apt. #6), Section 23, Township 24 South, Range 37 East, Avon by the Sea, Block 25, Lots 5 & 6, Brevard County, Florida -Violation of Section 34-181, Storing, Parking or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in compliance. There being no further business, the meeting was adjourned at 8:27 P.M. Approved on this 17th day of September , 1998.
