A Regular Meeting of the Code Enforcement Board of the City of Cape Canaveral, Florida,was held on September 17, 1998, at the City Hall Annex, 111 Polk Avenue, Cape Canaveral, Florida. Chairperson Russell called the meeting to order at 7:30 P.M. The Secretary called the roll. MEMBERS PRESENT Mary Russell Chairperson Walter Godfrey (late) Donna Boone Charles Biederman Jeffrey Ratliff Karen Hartley MEMBERS ABSENT Carol Warner Vice Chairperson OTHERS PRESENT Mitch Goldman Assistant City Attorney Greg Mullins Code Enforcement Officer Susan Chapman Board Secretary Greg Mullins, Code Enforcement Officer; Michael Remen and Rudy Hardick, citizens; were sworn in by Attorney Goldman. It was noted that the next meeting would be held on October 22, 1998. Chairperson Russell advised that she would not be able to attend the next meeting. Code Enforcement Board Meeting Minutes September 17, 1998 Page 2 Motion by Mr. Biederman, seconded by Mrs. Hartley to approve the meeting minutes of August 20, 1998 as corrected. Vote on the motion carried unanimously. COMPLIANCE HEARINGS: 1. Case No. 98-46, Cape Canaveral Office Center, (7980 N. Atlantic Avenue), Section 23, Township 24 South, Range 37 East, Block 19, Lots 1-3, Brevard County, Florida -Violation of Section 34-97, Duties and Responsibilities for Maintenance of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was in partial compliance with the Board's Order of June 18, 1998. He advised that Cape Canaveral Office Center had made the necessary repairs to the parking lot asphalt and the roof overhangs and soffit repairs were almost completed. Mr. Mullins requested that the compliance hearing in this case be tabled until the work is completed. Motion by Ms. Boone, seconded by Mrs. Hartley to table the compliance hearing until the work is completed. Vote on the motion carried unanimously. 2. Case No. 98-47, Magma Trading Corporation, (8200 Astronaut Blvd.), Section 23, Township 24 South, Range 37 East, Parcel 286, Brevard County, Florida -Violation of Section 34-97, Duties and Responsibilities for Maintenance of the Cape Canaveral Code of Ordinances. Code Enforcement Officer Mullins testified that this case was not in compliance with the Board's Order of June 18, 1998. Mr. Rudi Hardick, property owner, explained that the former tenant(Rich's) had subleased the building and property to another company that had gone out of business. He advised that his new tenant was cleaning up the property and repairing the interior of the building. Mr. Mullins assured the Board that no business license would be issued until the property is brought into compliance. No action was taken on this case. Code Enforcement Board Meeting Minutes September 17, 1998 Page 3 Mr. Godfrey entered the meeting at this time. PUBLIC HEARINGS: 1. Case No. 98-45, The Oaks Condominium Association, (201 International Drive, Apt. #124), Section 22/23, Township 24 South, Range 37 East, Parcel 7, Brevard County, Florida -Violation of Chapter 82, Land Development Code, as adopted by the Southern Building Code Congress International, Chapter 15, Roof and Roof Structures, Section 1503.4, Replacement/Recovering. Code Enforcement Officer Mullins testified that the Condominium Association had been cited for one specific condominium unit. He advised that the roof had been repaired and this case was in compliance. Mr. Michael Remen, Condominium Board Secretary, advised that the Association consisted of(7) buildings and (110) units. He provided a maintenance schedule for all the buildings for the coming years, which work included roof repairs/replacements for all the buildings. Motion by Mr. Godfrey, seconded by Ms. Boone to find Case No. 98-45 in compliance. Vote on the motion carried unanimously. 2. Case No. 98-56, Alfred Archarubault, (400 Johnson Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea Subdivision, Block 72, Lot 6, Brevard County, Florida -Violation of Section 34-181, Storing Parking or Leaving on Private Property of Cape Canaveral Code of Ordinances. Mr. Mullins entered a photograph of the vehicle (Exhibit A). He advised that the vehicle was inoperable. It was noted that Mr. Archarubault was duly notified of this meeting and was not present at the meeting. Brief discussion followed. Motion by Ms. Boone, seconded by Mr. Biederman to find Case No. 98-56 in violation of the Cape Canaveral Code of Ordinance in that the Board has determined the vehicle located at 400 Johnson Avenue to be a public nuisance pursuant to Section 34-181 of the City Code. Case No. 98-57, Lisa McMinn, (7956 Orange Avenue), Section 23, Township 24 South, Range 37 East, Avon by the Sea Subdivision, Block 21, Lot 1, Brevard County, Florida -Violation of Section 181, Storing, Parking, or Leaving on Private Property of the Cape Canaveral Code of Ordinances. Mr. Mullins testified that the vehicle tags were not current. He submitted a photograph of the vehicle (Exhibit A). It was noted that Ms. McMinn was duly notified of this meeting and was not present at the meeting. Brief discussion followed. Motion by Ms. Boone, seconded by Mr. Biederman to find Case No. 98-57 in violation of the Cape Canaveral Code of Ordinances in that the Board has determined the vehicle located at 7956 Orange Avenue to be a public nuisance pursuant to Section 34-181 of the City Code. Vote on the motion carried unanimously. There being no further business, the meeting was adjourned at 8:00 P.M. Approved on this 27th day of October , 1998. Carol Warner for Mary K.
