Violation of Section 34-97 Duties and Responsibilities for Maintenance, and Section 34-181 Storing, Parking or Leaving on Private Property, in that the property is not being maintained to the property maintenance standards and an inoperable motor vehicle is being stored on the property. PUBLIC HEARINGS: 1. Case No. 98-27, McDonalds Corporation, (8780 Astronaut Blvd), Section 15, Township 24 South, Range 37 East, Parcel 750, Brevard County, Florida. Violation of Section 34-97 Duties and Responsibilities for Maintenance, in that an additional dumpster was added to the business and is not screened as required. 2. Case No. 98-28, The Canaveral Corporation, (8952 N. Atlantic Ave) & (newly assigned address 8901 N. Atlantic Ave), Section 14, Township 24 South, Range 37 East, Parcel 250, Parcel 269, Brevard County, Florida. —Violation of Section 34-97 Duties and Responsibilities for Maintenance, in that the facility at 8952 N. Atlantic Avenue has pot holes throughout the parking facility, and the building at 8901 N. Atlantic Avenue (newly assigned address) is in need of painting and general maintenance upon the structure. 3. Case No. 98-29, Joan Marie Brown, (201 Harbor Drive), Section 14, Township 24 South, Range 37 East, Harbor Heights Pt Addition, Parcel 256, Brevard County, Florida. —Violation of Section 82-371 Posting and Specification of Numbers, in that the address of the building is not displayed upon the property as required. 4. Case No. 98-30, Greenfield Auto Repair, (8700 Commerce Street), Section 15, Township 24 South, Range 37 East, Parcel 751, Brevard County, Florida. Violation of Section 110-352 Principle Uses and Structures, in that vehicles for sale are being advertised on an adjacent property in the M-1 Zoning District. Case No. 98-31, Wade Miller, (8417 Rosalind Ave), Section 14, Township 24 South, Range 37 East, Cape Canaveral Beach Gardens, Block B, Lot 13, Brevard County, Florida. —Violation of Section 34-97 Duties and Responsibilities for Maintenance, in that the wooden fence along the west end of the property is in need of repairs, plywood pieces nailed on the exterior of the fence, causing a blighting effect to the neighboring property. 6. Case No. 98-32, Circle K, (8797 N. Atlantic Ave), Section 14, Township 24 South, Range 37 East, Parcel A-8, Brevard County, Florida. — Violation of Section 34-97 Duties and Responsibilities for Maintenance, in that additional dumpster has been added to the property that is not screened as required. 7. Case No. 98-33, Brian Brown, (7666 Orange Avenue), Section 23, Township 24 South, Range 37 East, Avon-By-The-Sea, Block 38, Lot 1, Brevard County, Florida. — Violation of Section 110-106 Permits Required, and Section 110-468 Accessory Structures, in that a storage/utility shed has been constructed upon the property without a building permit, construction plans, and a legal survey of the property to show proper placement of the structure. 8. Case No. 98-34, Tony Greenwell, (8911 N. Atlantic Ave, Lot # 66), Section 14, Township 24 South, Range 37 East, Parcel 251.2, Brevard County, Florida. Violation of Section 110-469 Visibility at Intersections, in that a boat is being stored within the visibility triangle at the intersection access upon the property. 9. Case No. 98-35, Southland Corporation (7-11), (8400 N. Atlantic Ave), Section 14, Township 24 South, Range 37 East, Canaveral Beach Gardens, Block 3, Lot 1, Brevard County, Florida. — Violation of Section 34-97 Duties and Responsibilities for Maintenance, in that a dumpster has been added to the property and is not screened as required by code. 10. Case No. 98-36, Lawrence & Lucinda Goodwin, (108 Oak Lane), Section 14, Township 24 South, Range 37 East, Parcel A-9, Brevard County, Florida. Violation of Section 82-371 Posting and Specifications of Numbers, in that the address of the property is not displayed as required by code. Case No. 98-37, Kishor Pathere, (299 Chandler Street), Section 14, Township 24 South, Range 37 East, Key Shore replat of Block B, Canaveral Beach Gardens, Brevard County, Florida. —Violation of Section 34-97 Duties and Responsibilities for Maintenance, in that the building is in need of painting and the roof tiles throughout the building are missing and need to be replaced. Pursuant to Section 286.1015, F.S., the City hereby advises the public that: If a person decides to appeal any decision made by the Code Enforcement Board with respect to any matter considered at this meeting, that person will need a record of the proceedings, and for such purpose that person may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based. This notice does not constitute consent by the City for the introduction or admission into evidence of otherwise inadmissible or irrelevant evidence, nor does it authorize challenges or appeals not otherwise allowed by law. The attendance of one or more members of the Cape Canaveral City Council, Board of Adjustment, Code Enforcement and/ or Community Appearance Board who may or may not participate in Board discussions held at this public meeting. Persons with disabilities needing special assistance to participate in any of these proceedings should contact the City Clerk's office at 868-1221, 48 hours in advance of the meeting.
