HomeMy WebLinkAboutResolution 2021-08 (003)RESOLUTION NO. 2021-08 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF COCOA BEACH, FLORIDA, AMENDING RESOLUTION NO. 2020-26, THE MASTER RESOLUTION FOR PARKING RATES BY AMENDING THE HOURLY PARKING RATE, PROVIDING A PARKING PERMIT RATE FOR RETIRED MILITARY, AND PROVIDING A PARKING PERMIT RATE FOR RETIRED CITY EMPLOYEES; PROVIDING FOR INCORPORATION OF RECITALS; VIOLATION AND ENFORCEMENT; INTERPRETATION AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Cocoa Beach adopted Ordinance No. 1520 on September 16, 2010, amending City Code Section 26 - 23 authorizing the cost of parking or standing a vehicle in a marked parking space located in a parking zone to be established by resolution; and, WHEREAS, the parking fees were established by Resolution No. 2017-21, and last amended by Resolution No. 2018-24; and WHEREAS, Resolution No 2020-26 repealed Resolution No. 2018-24, and is a comprehensive Resolution that reflects parking zones, parking fees for all zones, and enforcement provisions; and WHEREAS, Resolution No. 2020-26 adopts the same parking zones, parking rates, and enforcement as was reflected in Resolution No. 2018-24, except for: pro -rating Parking Permit fees, if parking permits are obtained after July 31st; changing the number of parking spaces at the 22 N. Atlantic Parking Zone from 109 spaces to 86 spaces, removing parking zone map exhibits, and referencing the location of parking zone maps on the City's website (https://cocoabeach.maps.arcgis.com/apps/MapSeries, and WHEREAS, Resolution 2021-08 amends hourly parking rates from $2.50 to $3.00 per hour, provides for a retired military parking permit rate and provides for a parking permit rate for retired City employees; and NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Cocoa Beach, Florida, as follows: SECTION ONE: INCORPORATION OF RECITALS - The above recitals are true and correct and by reference are hereby incorporated and made an integral part hereof as though fully set forth herein. SECTION TWO: REFERENCE TO EXHIBITS This Resolution hereby refers to paid parking zones, metered parking areas, and parking permit fees as exhibits and in the following manner: RESOLUTION NO. 2021-08 Exhibit 1 Downtown Parking Garage, (Parking Lot located at 25 South Orlando Avenue, Cocoa Beach) Exhibit 2 City Hall Metered Parking Zone (Parking Lot located at 2 South Orlando Avenue, Cocoa Beach) Downtown Streets - 90 Minute Parking Located at any and all marked parking spaces, within the following identified street rights of way and/or alley rights of way and/or public easements: I.— Atlantic Avenue between 2nd Street South and 2"d Street North; Exhibit 3 2.-- Orlando Avenue between 2nd Street South and 2nd Street North; 3.-- Brevard Avenue between 2nd Street South and 151 Street North; 4.-- Minutemen Causeway between Woodland Avenue and Atlantic Avenue; 5.-- 15t Street North between Woodland Avenue and Atlantic Avenue; 6.-- 2nd Street North between Brevard Avenue and Atlantic Avenue. Exhibit 4 22 North Atlantic Avenue Parking Meter Zone Parking Lot located at 22 North Atlantic Avenue, Cocoa Beach Parking at Shepard & Fischer Parks - (Parking Lots) Exhibit 5 Located at Shepard Park - 200 E Cocoa Beach Causeway, Cocoa Beach Located at Fischer Park — 2200 North Atlantic Avenue, Cocoa Beach Exhibit 6 Parking Meter Zones on City Streets (Excludes areas identified in Exhibit 3) Exhibit 7 I Parking Permits SECTION THREE: ESTABLISHMENT OF PARKING AND PARKING PERMIT RATES - There are hereby established amended rates for the paid parking zones and parking permits as follows: Page 2 of 12 RESOLUTION NO. 2021-08 EXHIBIT 1 - DOWNTOWN PARKING GARAGE (Located at 25 South Orlando Avenue) Three levels of Parking — 241 Total Spaces Fees The followinq schedule of parkinq fees for the Downtown Parkinq Garaqe is herebv established: For all days three dollars ($3.00) per hour or fifteen dollars ($15.00) per day. For the purposes of Per I implementing a day begins at 12:00 AM and ends at 11:59 PM. Hour/Day Daily rate payments made on one day are valid only for the day on which that payment was made. Enforcement of fee schedule is from 7:00 A.M to 7:00 P.M. Fees for special events or for special purposes, including the waiving of any fee or rate, may be set Special by the City Manager after due notice to the City Commission. In no case shall the parking fees for Events special events or special purposes be for periods of more than ten (10) days for any one (1) event or purpose. In addition to parking fees identified above, there may be assessed additional service fees for pay Service by cell, debit/credit/smart cards or other parking service or payment fees, established and levied Fees directly by the payment service provider through contract and/or agreement with the City. These fees are the responsibility of the end user. Parking Permit Holders are not required to pay the parking fees established or authorized by this Permits I Resolution, if they properly display a valid parking permit. The City does not charge a fee for parking in municipal parking lot, if the vehicle displays any of the following, disabled parking permits or disabled license plates: ✓ Disabled parking permits or disabled license plates: ✓ Out of state or out of country disabled license plate or disabled parking permit as recognized under s. 316.1958, Florida Statutes (F.S).; ✓ Disabled parking permit issued under s. 320.0848, F.S.; ✓ Disabled Veteran license plate issued under s. 320.084, F.S.; ✓ Disabled Veteran license plate stamped with the international wheelchair symbol issued under s. 320.0842, F.S.; ✓ License plate stamped with the international wheelchair user symbol issued under s. 320.0843, F.S.; ✓ Paralyzed Veterans of America license plate issued under s. 320.0845, F.S. Handicap ✓ Specialized equipment lifts, such as ramps, hand controls for use by a person who has a Parking disability s.316.1964 F.S. ✓ Displays a Florida toll Exemption permit. s316.1964 F.S. This only applies when the vehicle is transporting the person who has the disability and to whom the disabled parking permit or license plate was issued. The driver of a vehicle, as provided above, that is parked on the public streets or highways or in any metered parking space may not be penalized except in clearly defined: ✓ bus loading zones; ✓ fire zones; ✓ access aisles adjacent to the parking spaces for persons who have disabilities; ✓ areas posted as "No Parking" zones or as emergency vehicle zones; or ✓ Parking time in excess of the posted time limit. Page 3 of 12 RESOLUTION NO. 2021-08 EXHIBIT 2 — CITY HALL METERED PARKING ZONE (Parking Lot behind City Hall) 32 Parking Spaces Fees: The followin a schedule of parking fees for the City Hall Metered Parkinq Zone is hereby established: For days Saturday, Sunday, and City Holidays: three dollars ($3.00) per hour or ten ($ 10.00) Per dollars per day. For the purposes of implementing a day begins at 12:00 AM and ends at 11:59 Hour/Day PM. Daily rate payments made on one day are valid only for the day on which that payment was made. Enforcement of fee schedule is from 7:00 A.M to 7:00 P.M. Fees for special events or for special purposes, including the waiving of any fee or rate, may be Special set by the City Manager after due notice to the City Commission. In no case shall the parking Events fees for special events or special purposes be for periods of more than ten (10) days for any one (1) event or purpose. In addition to parking fees identified above, there may be assessed additional service fees for pay Service by cell, debit/credit/smart cards or other parking service or payment fees, established and levied Fees directly by the payment service provider through contract and/or agreement with the City. Permit Handicap The City does not charge a fee for parking on the public streets or highways or in any metered Parking parking spaces if the vehicle displays any of the following disabled parking permits or disabled license plates: ✓ Disabled parking permits or disabled license plates: ✓ out of state or out of country disabled license plate or disabled parking permit as recognized under s. 316.1958, Florida Statutes (F.S.); ✓ disabled parking permit issued under s. 320.0848, F.S.; ✓ Disabled Veteran license plate issued under s. 320.084, F.S.; ✓ Disabled Veteran license plate stamped with the international wheelchair symbol issued under s. 320.0842, F.S.; ✓ license plate stamped with the international wheelchair user symbol issued under s. 320.0843, F.S.; or ✓ Paralyzed Veterans of America license plate issued under s. 320.0845, F.S. ✓ Specialized equipment, such as lifts ramps, hand controls for use by a person who has a disability s.316.1964 F.S. ✓ Displays a Florida toll Exemption permit. s 316.1964 F.S. This only applies when the vehicle is transporting the person who has the disability and to whom the disabled parking permit or license plate was issued. When an on -street parking meter restricts the duration of time that a vehicle may be parked, a vehicle properly displaying a disabled parking permit is allowed a maximum of four hours at no charge. The driver of a vehicle, as provided above, that is parked on the public streets or highways or in any metered parking space may not be penalized except in clearly defined: ✓ bus loading zones; ✓ fire zones; ✓ access aisles adjacent to the parking spaces for persons who have disabilities; ✓ areas posted as "No Parking" zones or as emergency vehicle zones; or s For parking in excess of the posted time limit. Page 7 of 12 RESOLUTION NO. 2021-08 EXHIBIT 5 — PARKING AT SHEPARD & FISCHER PARKS (Shepard Park Parking Lot - 323 Spaces) (Fischer Park Parking Lot — 109 Spaces) Fees The following schedule of parking fees for Shepard and Fischer Parks is hereby established: PARKING FEES. The following schedule of fees shall be adopted: • The parking fees for Shepard Park shall be fifteen dollars ($ 15.00) per day, or $3.00 per hour. The parking fees for Sidney Fischer Park shall be fifteen dollars ($ 15.00) per day or Per Day $3.00 per hour. The fees described above apply only for the day in which the fee is paid. A day is defined as any time interval in which the respective park is open. Enforcement of said fees are applicable during park hours. Vehicles remaining after the park is closed are subject to a Class I citation described in Chapter 30 of the City Code. Fees for special events or for special purposes, including the waiving of any fee or rate, may be Special set by the City Manager after due notice to the City Commission. In no case shall the parking fees Events for special events or special purposes be for periods of more than ten (10) days for any one (1) event or purpose. Beach ✓ Rate offered to all active duty military members, reserves, retirees Residents and veterans of the United States Armed Forces with valid military ID. Permit not valid at Shepard Park Permit does not extend parking limit in 90 -minute spaces Calendar Year Permit Fee - $ 75.00 — After July 31" $ 40.00 Non- ✓ Applies to an applicant who does not reside or own property within Cocoa Beach city Residents limits, e.g., millage code 261-10. Permit not valid at Shepard Park. Permit does not extend parking limit in 90 -minute spaces. Calendar Year Permit Fee - $ 30.00 — After July 31 s`, $ 15.00 Cocoa Eligibility: Beach ✓ Business must have a current business tax receipt (BTR) ✓ Limited to businesses without a BTR for paid parking spaces Business ✓ Business owner can purchase up to seven (7) additional Employee Permits Permits not valid at Shepard Park. Permit does not extend parkinq limit in 90 -minute spaces. $ 20.00 each for 30 days Temporary Parking ✓ Issued for construction or other short-term event for a specific purpose as approved by Permits the City Manager. Calendar Year Permit Fee - $ 20.00 — After July 31"' $10.00 City of Cocoa ✓ City of Cocoa Beach Employees (active & retired) may obtain permits at the Cocoa Beach Beach Resident rate. Employees Permit not valid at Shepard Park Permit does not extend parking limit in 90 -minute spaces REMAINDER OF PAGE INTENTIONALLY BLANK Page 10 of 12 RESOLUTION NO. 2021-08 EXHIBIT 7 — PARKING PERMITS (continued) Parking permits ✓ are assigned to a single vehicle, ✓ are not transferable except on vehicle sale ✓ require proper display by permanently affixing such permit to the driver -side rear bumper or driver -side lower corner of the outside rear window of the vehicle Parking ✓ are available for purchase at City Hall during business hours Permit ✓ can be purchased by any person irrespective of place of residence Ass''p�ment ✓ must be properly displayed, in the City's decal form and bisplav ✓ constitute authorization to park in certain marked and timed parking zone in compliance City Code, Chapter 26, Traffic, Article II Parking Meters/Parking Devices or Timed Parking System. ✓ Requests for exceptions may be considered for approval by the City Manager or designee Parking Permits ✓ shall not be used for parking vehicles for advertising or other commercial purpose; the Citv Manager or designee shall have the sole discretion to make this determination. Parking ✓ can be rescinded, if any parking permit is deemed to be improperly used. The City Manager, Permit and/or designee, at sole discretion, retains the authority. Usage ✓ are limited to vehicles not exceeding twenty-two (22) feet in length; vehicle length determined by vehicle owner. ✓ shall not be used for overnight parking without the prior approval of the City Manager or designee. SECTION FIVE: VIOLATION AND ENFORCEMENT, (a) Failure to comply with this Resolution, and/or terms and requirements of City Code Chapter 26 'Traffic", Article II "Parking Meters/Parking Devices or Timed Parking System" shall be considered a parking violation subject to a civil penalty fine, with fines are identified in Resolution 2015 - 13 or successor Resolution. (b) This Resolution, and/or terms and requirements of City Code Chapter 26 'Traffic", Article II "Parking Meters/Parking Devices or Timed Parking System" shall be enforced by authorized City personnel, and/or by City police officers. SECTION SIX: POSTING OF THE SCHEDULE OF FEES AND CHARGES, The fee schedule identified in Section Three above shall be posted on the City website. SECTION SEVEN: DIRECTING THE IMPLEMENTATION OF THE ESTABLISHED FEES. The City Manager is authorized and directed to implement this Resolution. SECTION EIGHT: EFFECTIVE DATE: This Resolution shall have an effective date of June 1, 2021.
