RESOLUTION NO. 2011 - 31
THE CITY COMMISSION OF THE CITY OF COCOA
REVISING PARKING PERMITS; AND PROVIDING AN
WHEREAS, there exists a funding partnership between Brevard County and the Florida
Department of Environmental Protection for the North Reach of the Brevard County Shoreline
Protection Project, which includes the beaches of Cocoa Beach; and
WHEREAS, Brevard County's continuing eligibility to receive a stated cost share proportion for
state funding eligibility is predicated on compliance with Florida statutes; and
WHEREAS, the Florida Administrative Code states that parking used for project eligibility and
state cost share determination shall be provided "on an equal basis'; and
WHEREAS, non-transferrable vehicle parking permits have been historically offered for
purchase to City of Cocoa Beach and Brevard County residents; and
WHEREAS, the proper display of such vehicle parking permits constitutes authorization to park
in a parking space designated as a timed parking space or lot without complying with section
26-22 (Payment required), section 26-23 (Cost; acceptable coins; hours of operation, charges
by timed parking spaces and timed parking zones), and section 26-24 (Violations) - subsections
(1) and (2); and
WHEREAS, the City of Cocoa Beach desires to continue to offer its residents vehicle parking
permits while at the same time complying with the terms wherein Brevard County's cost share
proportion is unaffected by the continuation of the parking permit program; and
WHEREAS, the City of Cocoa Beach adopts parking permit fees by resolution;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
COCOA BEACH; BREVARD COUNTY, FLORIDA, AS FOLLOWS:
Section 1.
The above recitals are true and correct and by this reference are hereby adopted by the City of
Cocoa Beach.
Section 2.
Resolution 2011 — 08 setting permit parking permit fees adopted on April 7, 2011 is repealed in
its entirety. The following schedule of parking permit fees shall be adopted:
The vehicle parking permit shall have an annual value of $60.00. The vehicle parking permit
shall be available for purchase at City Hall during business hours by any person irrespective of
place of residence. Proper display of the permit, in decal form, constitutes authorization to park
in certain marked timed parking zone without complying with section 26-22 (deposit of coin or
other form of payment required), section 26-23 (cost; acceptable coins or other form of
payment) and section 26-24 (1) and (2) herein.
Section 3.
Residents within the incorporated municipal boundaries of the City of Cocoa Beach shall be
able to purchase an annual parking permit decal for $10 per vehicle with the balance of the $60
parking permit value to occur through an inter -fund transfer of ad valorem tax receipts to the
Metered Parking Fund. On an annual basis, beach maintenance expenditures incurred in the
General Fund in a total corresponding amount shall be transferred to the Metered Parking Fund.
Section 4.
Parking permits are assigned to a single vehicle, are not transferable except on sale, and
require proper display by permanently affixing such permit to the driver -side rear bumper or
driver -side lower corner of the outside rear window of the vehicle.
Permits shall not be used for parking vehicles for the advertising or other commercial purpose;
the city manager or his/her designee shall have the sole discretion to make this determination.
The city manager, at his/her sole discretion, retains the authority to rescind any parking permit
deemed to be improperly used.
Permits are limited to vehicles not to exceed 22 feet in length. Permits shall not be used for
overnight parking without the prior approval of the city manager or his/her designee.
Section 5. Effective Date: This resolution and fees adopted shall become in full effect on
January 1, 2012,
Upon Motion by Commissioner Griffin and Seconded by Commissioner
Beeler , this Resolution was duly adopted at a Regular Meeting of the City
Commission of the City of Cocoa Beach, Florida, held on the 6th day of October
2011.
