WHEREAS, the World Health Organization (WHO) has declared a pandemic related to COVID-19; and
WHEREAS, the Center for Disease Control and Prevention has declared the potential public health threat
posed by COVID-19 as 'high', both in the United States and throughout the world; and
WHEREAS, on March 1, 2020, Governor Ron DeSantis issued Executive Order 20-51, declaring that
appropriate measures to control the spread of COVID-19 in the State of Florida are necessary, and
therefore directed that a Public Health Emergency be declared in the State of Florida; and
WHEREAS, on March 9, 2020, Governor Ron DeSantis issued Executive Order 20-52, declaring a State of
Emergency in the State of Florida regarding the COVID-19 pandemic; and
WHEREAS, on May 8, 2020, Governor Ron DeSantis issued Executive Order 20-114, which extends
Executive Order 20-52, declaring a State of Emergency in the State of Florida regarding the COVID-19
pandemic; and
WHEREAS, under current circumstances, certain people will have an increased risk of infection, for
example healthcare, first responders, and emergency medical services workers caring for patients with
COVID-19 and other close contacts of persons with COVID-19; and
WHEREAS, it is the duty of Brevard County to take protective measures — including development of
incident action response plans, procurement of personal protective equipment, pandemic preventative
training and exercise coordination, and similar activities to support the public health and safety of the
community; and
WHEREAS, The President of the United States has declared a State of Emergency for the Country to
address the public health threat to the United States of America as a result of COVID-19; and
WHEREAS, Brevard County is encountering an impending serious threat to the health of the residents
and visitors of Brevard County and;
WHEREAS, on March 14, 2020, a State of Local Emergency was declared by Brevard County (COVID-19
Document #1); and
WHEREAS, on March 16, 2020 the First Amendment to the State of Local Emergency Proclamation was
issued (COVID-19 Document #2); and
WHEREAS, on March 21, 2020 the first extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #4); and
WHEREAS, on March 27, 2020 the second extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #6); and
WHEREAS, on April 3, 2020 the third extension to the State of Local Emergency Proclamation was issued
(COVID-19 Document #9); and
WHEREAS, on April 10, 2020 the fourth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #11); and
WHEREAS, on April 17, 2020 the fifth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #13); and
WHEREAS, on April 24, 2020 the sixth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #13); and
WHEREAS, on May 1, 2020 the seventh extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #15); and
WHEREAS, on May 1, 2020 the order regarding Beachside Park and Parking Closures was rescinded
(COVID-19 Document #15); and
WHEREAS, on May 8, 2020 the eighth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #16); and
WHEREAS, on May 15, 2020 the ninth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #17); and
WHEREAS, on May 22, 2020 the tenth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #18); and
WHEREAS, on May 29, 2020 the eleventh extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #19); and
WHEREAS, on June 5, 2020 the twelfth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #20); and
WHEREAS, on June 12, 2020 the thirteenth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #21); and
WHEREAS, on June 19, 2020 the fourteenth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #22); and
WHEREAS, on June 26, 2020 the fifteenth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #23); and
WHEREAS, on July 2, 2020 the sixteenth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #25); and
WHEREAS, on July 10, 2020 the seventeenth extension to the State of Local Emergency Proclamation
was issued (COVID-19 Document #26); and
WHEREAS, on July 17, 2020 the eighteenth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #27); and
WHEREAS, on July 24, 2020 the nineteenth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #28); and
WHEREAS, on July 31, 2020 the twentieth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #29); and
WHEREAS, on August 7, 2020 the twenty-first extension to the State of Local Emergency Proclamation
was issued (COVID-19 Document #30); and
WHEREAS, on August 14, 2020 the twenty-second extension to the State of Local Emergency
Proclamation was issued (COVID-19 Document #31); and
WHEREAS, on August 21, 2020 the twenty-third extension to the State of Local Emergency Proclamation
was issued (COVID-19 Document #32); and
WHEREAS, on August 28, 2020 the twenty-fourth extension to the State of Local Emergency
Proclamation was issued (COVID-19 Document #33); and
WHEREAS, on September 4, 2020 the twenty-fifth extension to the State of Local Emergency
Proclamation was issued (COVID-19 Document #34); and
WHEREAS, on September 11, 2020 the twenty-sixth extension to the State of Local Emergency
Proclamation was issued (COVID-19 Document #35); and
WHEREAS, on September 18, 2020 the twenty-seventh extension to the State of Local Emergency
Proclamation was issued (COVID-19 Document #36); and
WHEREAS, on September 25, 2020 the twenty-eighth extension to the State of Local Emergency
Proclamation was issued (COVID-19 Document #37); and
WHEREAS, on October 2, 2020 the twenty-ninth extension to the State of Local Emergency Proclamation
was issued (COVID-19 Document #38); and
WHEREAS, on October 9, 2020 the thirtieth extension to the State of Local Emergency Proclamation was
issued (COVID-19 Document #39); and
WHEREAS, on October 16, 2020 the thirty-first extension to the State of Local Emergency Proclamation
was issued (COVID-19 Document #40); and
WHEREAS, on October 23, 2020 the thirty-second extension to the State of Local Emergency
Proclamation was issued (COVID-19 Document #41); and
WHEREAS, on October 30, 2020 the thirty-third extension to the State of Local Emergency Proclamation
was issued (COVID-19 Document #42); and
WHEREAS, the Governor issued Executive Order 20-244 on September 25, 2020 moving into Phase 3 and
lifting certain restrictions and penalties throughout the State of Florida; and
WHEREAS, the State of Local Emergency Proclamation declared on March 14, 2020 authorized the
County Manager to execute extensions of the Local State of Emergency as deemed necessary; and
WHEREAS, the serious public health threat from the COVID-19 pandemic is ongoing and continues to be
a serious threat to the health of residents and visitors of Brevard County and therefore the Local State of
Emergency declared on March 14, 2020 and amended on March 16, 2020 needs to stay in effect; and
WHEREAS, Chapter 252.38(5), Florida Statutes, provides authority for a political subdivision such as
Brevard County to extend a state of local emergency in 7 day increments to continue exercising certain
powers and authority to safeguard the lives and property of its citizens; and
WHEREAS, the thirty-third extension to the State of Local Emergency Proclamation declared on October
30, 2020, 2020 will expire on November 7, 2020 unless extended as allowed by law.
NOW, THEREFORE, IT IS RESOLVED this 6th day of November, 2020, that the COVID-19 pandemic
continues to pose a serious threat to the health and lives of residents and guests of Brevard County and
that the State of Local Emergency adopted on March 14, 2020 (amended on March 16, 2020) for all the
territory within the legal boundaries of Brevard County, including all the unincorporated and incorporated
areas, is hereby extended for seven (7) days effective on November 7, 2020 at 12:01 a.m and may be
further extended as necessary in seven (7) day increments. The County Manager or his designee, Assistant
County Manager James Liesenfelt is hereby authorized to execute further extensions of the State of Local
Emergency as deemed necessary.
BE IT FURTHER RESOLVED that the Board of County Commissioners of Brevard County hereby
incorporates, restates and amends the Local State of Emergency Proclamation signed on March 14, 2020
and amended on March 16, 2020 and the above WHEREAS clauses herein and hereby authorizes the
exercise of its authority and powers pursuant to Florida Statutes 252.38(3)(a) and 252.38(5) and, effective
on November 7, 2020 at 12:01 a.m., extends the State of Local Emergency for a period of 7 days.
Alterations or Rescission.
The declaration of a Local State of Emergency may be altered or rescinded either by the issuance of a
subsequent Executive Order or by an appropriate Resolution of the Board of County Commissioners.
