HomeMy WebLinkAboutbrev_mou_admin_covidvac_20210323 Memorandum of Understanding Administration of COVID-19 Vaccine Municipal Assistance The Brevard County Board of County Commissioners (hereinafter "County"), through its Public Safety Department, Office of Emergency Management, and the City of Cape Canaveral, enter into this Memorandum of Understanding (MOU) in order to assist the federal and state government in the administration of the COVID-19 vaccine. RECITALS: WHEREAS, this MOU set forth the understanding of the parties in how they can assist in the overall COVID-19 vaccination administration strategy of the Florida Department of Health in Brevard County by defining their role, identifying their capabilities, and outlining the terms for their participation. WHEREAS, the County does not receive or have any control over the number of vaccine doses or manufacturer of the doses to be administered under this MOU; WHEREAS, the vaccines which may be available for distribution under this MOU are those delivered to the Florida Department of Health in Brevard County (FDOHBC); WHEREAS, the County, at the direction of the FDOHBC, is assisting with the coordination of distributing vaccine doses to other entities capable of administering the vaccines when the FDOHBC receives doses for a given week which exceeds the FDOHBC's resource capability to administer such vaccines; WHEREAS, the County has agreements in place with other entities which have indicated a willingness to administer the vaccine without charge to individuals, governmental entities, insurance companies, etc... NOW THEREFORE, the parties agree that they have full power and authority to enter into this MOU and bind their respective entities as follows: SECTION 1. RECITALS. The above recitals are true and correct and by this reference are hereby incorporated into and made a part of this MOU. SECTION 2. SCOPE OF WORK - REQUIREMENTS. (A) County: The County agrees or asserts as follows: (1) To coordinate with the FDOHBC. Should the FDOHBC receive sufficient vaccine doses in a given week to support consideration of distributing vaccine doses to entities capable of administering the vaccine, FDOHBC will determine the doses to be distributed among one 1 or more entities which may include the City, but in any event no more than a given vaccine site can administer in a given week at the vaccine sites which the City has activated (see Section 2(B)(6) below). (2) To provide the City with as much notice as possible on vaccine doses allotted for FDOHBC each week prior to the beginning of each week based upon the notification the County receives from the FDOHBC. (3) The County shall issue a task order (Attachment "A" — task order form) once the vaccine doses are available to be distributed to the City and the County and City point-of-contacts confirm the City has the resources available for the administration of the vaccine on the dates in question. (4) Does not in any way guarantee or assure the CITY that the CITY will receive any given number of doses of vaccine at any given time. This decision is within the discretion of FDOHBC. (5) At the direction of the FDOHBC, may reduce the number of doses of vaccine provided to a City, should it be in the best interest of the public health, safety and welfare. (6) Shall designate one individual as a point-of-contact to communicate with the City regarding available vaccine doses for delivery to the City, to arrange delivery or pick up of the vaccine and to address any other issues that may arise under this MOU. The County shall communicate the name and contact information (email and telephone numbers) for this individual to the City's point-of-contact person under Section 3 within five business days of the full execution of this MOU if different from Section 3. (7) The County has no legal obligation to appropriate or set aside any funding for the City for the services the City may provide under this MOU and has not done so. (8) Should funding be provided to the County by the federal government or State of Florida, after execution of this MOU, to assist in the funding of the cost of providing this vaccine program, it will share such funding with the City subject to any requirements imposed by the federal or state funding source and/or based upon an equitable distribution of the funding for all entities which participate in a similar MOU/agreement to administer vaccines. (B) City: The City agrees or asserts as follows: (1) It has in place a fully executed paramedicine vaccination agreement between FDOHBC and the City's EMS Medical Director. 2 (2) To provide vaccines to eligible groups only, as stipulated in the Governor's Executive Orders and directed by the Department of Health in Brevard. (3) To provide all qualified staffing (to schedule vaccines for its sites, administer vaccines, security, etc.), supplies and facilities to administer vaccines as they are allotted from the FDOHBC except as otherwise provided in a task order issued by the County. (4) That allocations of vaccines will occur on a weekly basis, will fluctuate, are not guaranteed, and are provided at the discretion of the FDOHBC. Furthermore, it is understood that the County does not in any way guarantee or assure the City that the City will receive any number of doses of vaccine at any given time. (5) The number of doses of vaccine allocated for distribution to municipalities (participating in this vaccine administration MOU) by the FDOHBC will be divided equitably among all of the participating municipalities. (6) The site(s) at which the City will administer vaccines and the number of vaccines to be administered at each site are outlined below: Cape Canaveral Fire Station 8970 Columbia Road Cape Canaveral, FL 32920 Daily Max: 20 vaccines Weekly Max: 60 vaccines (7) It will utilize its best efforts to administer all doses of vaccine it receives for a given week during that week. The FDOHBC reserves the right to reduce the number of vaccines provided to the City should the City fail to administer all vaccines doses allotted to the City. (8) Agrees it will not charge or bill the County (or any other governmental entity), vaccine recipients, or any insurance companies for the cost associated with the administration or distribution of vaccine. (9) Agrees to provide the following reporting requirements: (a) At the end of each day for which the City receives vaccine doses, the City must report electronically by email to John Scott, Director, Brevard County Emergency Management, — John.Scottra).brevardfl.gov — the number of vaccine appointments scheduled for the day and the actual number of vaccines administered that day. 3 (b) Within 24 hours of the end of a day for which the City was given an allotment of vaccine doses, the City must provide the FDOHBC with a completed vaccination information spreadsheet for the day or input/upload all vaccine information to the database, Florida Shots, https://www.flshotsusers.com/ (10) Designate one individual as the City's point-of-contact to communicate with the County's point-of-contact regarding available vaccine doses, for finalizing/accepting task orders issued by the County, for arranging pick up of vaccine doses from FDOHBC by the City (in coordination with the City's Medical Director as set forth in the paramedicine vaccination agreement — see the requirement in Section 3(B)(1) above) and to address any other issues that may arise under this MOU. (11) Understands the County has no legal obligation to appropriate or set aside any funding for the City. This MOU does not create a contractual right to any expenditure on behalf of, or reimbursement to, the City. SECTION 3. POINT-OF-CONTACT; NOTICES. EFFECTIVE DATE. The effective date of this MOU shall be the date on which the last party to execute the MOU, executes the MOU. 4 SECTION 5. TERMINATION. Either party to this MOU can terminate this MOU, with or without cause, by furnishing thirty days prior written notice as provided for in Section 3. (2) FDOHBC has made available doses of vaccine to be administered on / /2021.
