HomeMy WebLinkAboutcocc_p&z_minutes_20201209PLANNING & ZONING BOARD MEETING MINUTES December 9, 2020 A Meeting of the Planning & Zoning Board was held on December 9, 2020, at City Hall Council Chambers, 100 Polk Avenue, Cape Canaveral, Florida. Lamar Russell, Chairperson, called the meeting to order at 6:00 pm. The Secretary called the roll. Board Matters 1. Approval of Meeting Minutes: October 28, 2020 Motion by Mr. Price and seconded by Dr. Miller to approve the Minutes as written. Vote on the motion carried unanimously. B. Comprehensive Plan Amendments (Legislative —Public Hearin s ; 1. Consideration and Recommendation of Ordinance Nos. 01-2021, 02-2021, 03- 2021, 04-2021, 05-2021, 06-2021, 07-2021, and 08-2021; adopting a city initiated rezoning of several government -owned properties owned respectively either by 1 Decenibe the City of Cape Canaveral, the Canaveral Port Authority, Brevard County or the Brevard County School District. There are more than 700 properties within the City improved with a residential structure, but zoned commercial. City code prohibits residential structures in commercial zoning districts. Mr. Garganese explained the meaning of each ordinance to the Board. To help organize and manage all of the needed re -zonings, the Ordinances represent "Phase 1" of the City's larger nonconforming administrative rezoning program. Where one ordinance is being proposed, the property only needs to be rezoned. Where two ordinances are being proposed, both a rezoning and future land use amendment is needed. Ordinance 01-2021 will include: Manatee Sanctuary Park, Banana River Park, and the Canaveral Port Authority property. Motion by Mr. Price and seconded by Ms. Gentilquore to recommend approval of Ordinance No. 01-2021 to the City Council. Vote on the motion carried unanimously. Ordinance 02-2021 will include: the Old City Hall, the Sheriff's office, the Nancy Hanson Recreation Complex, the Cape Canaveral Library, the Wastewater Reclamation Facility, the southern portion of Manatee Sanctuary Park. Cape View Elementary, Cherie Down Park, Canaveral City Park and Patriots Park. Motion by Ms. Denny and seconded by Mr. Stroud to recommend approval of Ordinance No. 02-2021 to the City Council. Vote on the motion carried unanimously. Ordinances 03-2021 and 04-2021 will include the southern part of Jetty Park. Motion by Dr. Miller and seconded by Mr. Price to recommend approval of Ordinance No. 03- 2021 to the City Council. Vote on the motion carried unanimously. Motion by Ms. Denny and seconded by Dr. Miller to recommend approval of Ordinance No. 04-2021 to the City Council. Vote on the motion carried unanimously. Ordinances 05-2021 and 06-2021 will include Long Point Estuary Park. Motion by Mr. Price and seconded by Ms. Gentilquore to recommend approval of Ordinance No. 05-2021 to the City Council. Vote on the motion carried unanimously. 2 Motion by Mr. Price and seconded by Dr. Miller to recommend approval of Ordinance No. 06- 2021 to the City Council. Vote on the motion carried unanimously. Ordinances 07-2021 and 08-2021 will include: the New City Hall, the Canaveral Fire Rescue station, Wagner Park (8820 N. Atlantic Ave.) and Bennix Linear Park (300 Washington Ave.). C. Quasi -Judicial Matters (Public Hearings,).; 1. Consideration and Recommendation Re: Site Plan Approval for a four (4) unit townhouse project located on Fillmore Avenue on Parcel #24-37-23-CG-53-10 per City Code of Ordinances, Sec 110-223 — Allen Engineering, Applicant. Mr. Dickey explained to the Board what a Site Plan is. The process starts with the application from the owner. The application is reviewed to make sure that it meets the City's standards. The Site Plan are plans from the Engineer and include maps, pictures, and surveys. It is reviewed by Staff ... our City Engineer, Public Works Director, and Fire Department, to ensure that it meets the criteria of City Code and Requirements. Our City Engineer, John Pekar, was present to explain the criteria of what they look at. It starts with the treatment of storm water and then the design. The City has a 10 year design storm for our city street system. That means in a 24 hour period of rain it is 7.9" and 9"in a 25 hour period of rain. The first flush is a treated swale and the overflow goes into the city street system. Joseph Downing was present at the meeting and resides at 301 Fillmore Avenue. Mr. Downing asked the Board to consider putting the Site Plan approval on hold. He is very concerned about flooding on Fillmore Avenue. Flooding has been a problem for many years and he actually met with Mr. Pekar in 2017 after the street flooded. Mr. Dickey stated that the Board should focus on Code criteria when considering this application. John Bensen called into the meeting and he resides at 303 Fillmore which is directly across the street from the townhouse project. He has lived there for 34 years and flooding has always been an issue. Mr. Bensen told the Board that when cars pass by his house there are waves breaking into his garage. He feels that the underground pipes need to be larger and also asked the Board to consider putting the Site Plan approval on hold. Mr. Pekar told the Board that the storm pipes had been enlarged on Orange Avenue. Ron Abales was present at the meeting, he is part owner of the townhouse project. Mr.. Abales explained to the Board and Mr. Downing that he was willing to work with the neighbors and would do whatever needed to be done to help with the flooding. 3 Motion by Ms. Denny and seconded by Mr. Stroud to approve the Fillmore Townhomes Site Plan located on Parcel #24-37-23-CG-53-10 (300 Block of Fillmore Avenue) to the CED Director. Vote on the motion carried unanimously. 2. Consideration and Recommendation to the City Council Re: Preliminary/Final Plat Approval for a four (4) unit townhouse project located on Fillmore Avenue or Parcel #24-37-23-CG-53-10 per City Code of Ordinances, Sec. 98-61 — Allen Engineering, Applicant. Motion by Mr. Stroud and seconded by Ms. Denny to recommend approval of the Preliminary and Final Plat for the Fillmore Townhouse project to the City Council. Vote on the motion carried unanimously. Mr. Bensen called in again realizing that the Board had approved the Site Plan and Preliminary/Final Plat. He has a video from September 28th at which time the new plumbing was completed on Orange Avenue. He asked that someone view the video because he doesn't feel the work that was completed will alleviate the problem. Motion by Mr. Russell and seconded by Mr. Price to adjourn the meeting at 7:42 pm.
