HomeMy WebLinkAboutbrevard_co_covid-19_proclamation_1_amd_2_20200318SECOND AMENDMENT TO STATE OF LOCAL EMERGENCY PROCLAMATION (COVID-19 DOCUMENT #3) WHEREAS, on March 14, 2020, a State of Local Emergency was declared by Brevard County (Covid-19 Document #1); and WHEREAS, on March 16, 2020 the First Amendment to the State of Local Emergency Proclamation was issued (COVID-19 Document #2); and WHEREAS, on March 18, 2020, during a Policy Group meeting, Sheriff Ivey conveyed he had a discussion with Governor DeSantis wherein the Governor requested that Brevard County issue an Order to close all beachside public parks and close all beach public parking access in an effort to reduce the spread of the COVID-19 virus during the ongoing pandemic; WHEREAS, the COVID-19 virus poses a health threat to Brevard County residents and visitors, particularly the elderly and others who are medically vulnerable; WHEREAS, minimization of contact is necessary to avoid risk of spreading the COVID-19 virus to the residents and visitors of Brevard County; WHEREAS, public parks and beaches are potential gathering places for the spread of the COVID- 19 virus; WHEREAS, representatives of the Municipalities of Brevard County and Patrick Air Force Base intend to comply with the direction of Brevard County with regard to the closure of beachside parks and beach public parking access; WHEREAS, the County seeks to amend the prior emergency proclamation to address the new recommendations and procedural directives; and WHEREAS, Chapter 252.38(3)(a), Florida Statutes, provides authority for a political subdivision such as Brevard County to declare a state of local emergency and to exercise certain powers and authority to safeguard the lives and property of its citizens and such declaration may be amended. NOW THEREFORE, IT IS RESOLVED this 18th day of March, 2020, that the COVID-19 pandemic continues to pose a serious threat to the health and lives of residents and guests of Brevard County and that the State of Local Emergency Proclamation adopted March 14, 2020 and first amended on March 16, 2020, shall be amended to include the closure of County beachside parks, Municipal beachside parks, Patrick Air Force Base beachside parks and beachside public parking access of the County, Municipalities and Patrick Air Force Base, for all the territory within the legal boundaries of Brevard County, including all of the unincorporated and incorporated areas; BE IT FURTHER RESOLVED that the Board of County Commissioners of Brevard County, through its designated Policy Group, hereby incorporates, restates and amends the Local State of Emergency Proclamation signed on March 14, 2020 and first amended on March 16, 2020 and the above WHEREAS clauses herein and hereby authorizes the exercise of its authority and powers pursuant to Florida Statutes 252.38(3)(a), which include the authority and powers to amend its State of Local Emergency Proclamation to add the following to be effective beginning on March 19, 2020 at 12:01 a.m.: [7] BEACHSIDE PARK AND PUBLIC PARKING ACCESS CLOSURES. In order to protect the residents and visitors of Brevard County from the ongoing public health threat posed by the COVID-19 pandemic, all County beachside parks, Municipal beachside parks, Patrick Air Force Base beachside parks and beachside public parking access of the County, Municipalities and Patrick Air Force Base will be closed beginning on March 19, 2020 at 12:01 a.m. Efforts by the County, Municipalities and Patrick Air Force Base and all other entities associated therewith (whether direct or by contract) to close the parks and parking lots will be completed no later than Friday, March 20, 2020 by 8:00 a.m. DONE, ORDERED AND ADOPTED this 18th day of March, 2020.
