HomeMy WebLinkAboutcocc_resolution_no_2020-10_20200519RESOLUTION NO. 2020-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA; REAPPOINTING A MEMBER TO THE COMMUNITY APPEARANCE BOARD OF THE CITY OF CAPE CANAVERAL; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT RESOLUTIONS, SEVERABILITY AND A RETROACTIVE EFFECTIVE DATE. WHEREAS, the City Council of the City of Cape Canaveral, Florida, has by City Code Section 22-36 established a Board known as the Community Appearance Board; and WHEREAS, it is now incumbent upon the City Council of the City of Cape Canaveral, at its discretion, to reappoint a Member to the Community Appearance Board. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF CAPE CANAVERAL, BREVARD COUNTY, FLORIDA, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are deemed true and correct and are hereby incorporated herein by this reference as a material part of this Resolution. Section 2. Reappointment of a Voting Member to the Community Appearance Board pursuant to Sections 2-171(e) and 22-28 of the Cape Canaveral City Code, the City Council of the City of Cape Canaveral hereby reappoints the following individual to serve as a regular voting member: Bob Nienstadt shall be reappointed to a new, three-year term, to serve until May 1, 2023. At the completion of this term on the Board, this appointee may be eligible for reappointment to the Board for an additional term, if no other qualified applicant(s) submit application(s) seeking appointment to the Board, consistent with the limitations set forth in Section 2-171(f), City Code. Section 3. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 4. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereto. Section 5. Effective Date. This Resolution shall become retroactively effective on May 1, 2020.
