MINUTES
April 14, 2020
3:00 P.M.
CALL TO ORDER: The Chair called the Meeting to Order at 3:00 PM and read the COVID-19
Pandemic Emergency Statement located at the top of the Agenda. Council Member Kellum led
the Pledge of Allegiance.

STATEMENT OF CMT PROCEEDINGS: Mayor Hoog read guidelines for conducting the virtual
proceedings via communications media technology (CMT).
ITEMS FOR DISCUSSION:
1. Familiarization and utilization of the GoToWebinar platform: Mayor Hoog inquired if
Council desired to discuss the Item or ask questions. Discussion ensued and included thanks to
Staff and appreciation for being able to do public business again.
2. Resolution No. 2020-09: confirming and extending the COVID-19 Declaration of Civil
Emergency approved by the Mayor on March 16, 2020; affirming and ratifying the Mayor's
Supplemental Emergency Orders No. 1 (Temporarily tolling time periods for processing
development permit applications), No. 2 (Temporarily allowing use of feather flags and snipe signs
by businesses), and No. 3 (Temporary beach use restrictions and amending use of feather flags
and snipe signs to "essential service" businesses only); affirming and ratifying the City Manager's
Emergency Order No. 1 (Prohibiting the use of public beach -end parking spaces within City rights -
of -way for beach access): providing for the future termination of the Civil Emergency by the City
Council at a later date; providing for the repeal of prior inconsistent resolutions severability and
an effective date: City Attorney Garganese read the title into the record and explained the Item.
Discussion ensued and included support for feather flags and other options for business owners,
citizens abiding by distancing guidelines, favor for leaving beaches open, passing the Resolution
as written, holding weekly meetings, pros and cons of the parking violation fee under the City's
Emergency Declaration, why City Council was not involved in the City's Emergency Declaration,
amendment of the Resolution to waive or remove the need for the Mayor or City Manager to
make unilateral decisions related to City emergencies, allowing some businesses deemed
non -essential to put up signs, towing to mitigate parking issues, keeping residents and Staff safe,

natural disaster declarations versus the COVID-19 Pandemic Emergency Declaration, the need to
be positive, constructive, kind and to move forward. Mayor Hoog stated he signed the Emergency
Declaration by the authority vested in him as Mayor of the City and explained the reasons for not
having a meeting with Council were related to COVID-19 and Executive Orders issued by the
Governor for social distancing. Mayor Hoog inquired if there were any emails submitted or online
comments from the public. Staff confirmed no Public Comments were received via email. Staff
recognized two attendees, Ms. Natasha LaGrone and Mr. Michael Britt, however, no comments
were shared. The Chair closed public participation. A motion was made by Mayor Pro Tem
Brown, seconded by Council Member Raymond, to accept Resolution No. 2020-09 as
written. City Attorney Garganese explained why the Emergency Declaration was issued by Mayor
Hoog without calling a public meeting due to the timing of various factors such as scheduled
meetings, Governor DeSantis' Emergency Orders and social distancing guidelines; and provided
clarification regarding current beach parking restrictions issued as a supplemental emergency
measure to the Emergency Declaration. Discussion ensued regarding amending Resolution No.
2020-09, amending the original motion, emergency powers in the City Code, the ability to conduct
virtual CMT meetings and desire to amend policy and meet as often as needed. City Attorney
Garganese cautioned Council on limiting powers of the Mayor and City Manager in the event the
City Council cannot timely convene a meeting. City Attorney Garganese read proposed language
to amend the Resolution into the record, "Whenever any additional COVID-19 emergency
measure or order under Chapter 18 of the City Code and Chapter 252, Florida Statutes requires
approval by the City, the City Manager shall first attempt to convene a special or emergency
meeting of the City Council to consider the emergency measure or order. In the event that the
City Council cannot be timely convened to address the emergency measure or order, the Mayor
and/or City Manager may adopt the emergency measure or order subject to the City Council's
review pursuant to Chapter 18 of the City Code." Discussion ensued regarding City Code Chapter
18 Civil Emergencies and Chapter 252 F.S., amending language in Resolution No. 2020-09 now
and future changes to the Code. Mayor Hoog stated there would be no more discussion on the
Motion. City Attorney Garganese advised Council with procedural options to amend the Motion
to include the amended language to the Resolution and read the proposed language again.
Council reached Consensus to accept the proposed language, amending Resolution No.
2020-09 and the original Motion. Discussion ensued on public participation and procedure. City
Attorney Garganese advised Council, due to possible technical difficulties experienced with the
new virtual meeting platform, another opportunity for the public to speak may be provided.
Mayor Hoog requested a roll :call vote from Council to open up public comment on the
Resolution. The vote failed for public comment on the Resolution 3-2, with Mayor Hoog,
Mayor Pro Tem Brown and Council Member Raymond voting against. Discussion ensued
regarding the format and procedures of the meeting. Mayor Hoog requested a roll call vote on
Resolution No. 2020-09, as amended. The Motion passed 5-0.
Council thanked Staff for their efforts in coordinating the first virtual CMT Meeting for the City
and shared individual thoughts on the effects of the COVID-19 pandemic on the community.
