All,
We all met between 9.55 am and 11.05 am this morning.
1.The number of approved seating for Southern Charm Cafe changed yet
again. Now it's at 126. Expressed our displeasure in not getting the
number right even after 3 weeks.
2.Then the discussion started to revolve around how many parking spaces
were approved as part of Southern Charm Cafe expansion in late
2018-early 2019. Mr.Dickey initially stated it was 5 but was unable to
identify the "5th approved" spot on the map and the Ariel view.
Therefore it was agreed that only 4 spots would be deemed to be approved
moving forward.
3. Discussed about the total number of approved parking spots in the
plaza. There originally were 50 and with the approval of 4 in early 2019
it now stands at 54. With Edible,Vape shop and Mortgage Company taking
16 of those spots it leaves 38 for Southern Charm Cafe still falling
short of requirement for 126 seats.Mr.Dickey stated he has sent out
letters to the Land Lord and the owner of Southern Charm Cafe on the
need to reduce the seating in the diner. Asked him how can that be
enforced and was told that someone will go into the diner to count the
chairs and enforce the code.
3.Then the illegal parking spots created on the west side of the plaza
was discussed. Mr.Dickey kept referencing to them as "unpermitted"
spaces. Asked him to clarify what "unpermitted" meant only to realize
it's an euphemism for "illegal" as Mr.Dickey confirmed that the city did
not approve those spots and they should not be there. Then asked him why
he sent out the communication yesterday i.e. 2/3 that the city will not
enforce the code when they are illegal? And what was the point in
stating in the same communication that the land lord can submit plans to
have 5 spots approved if the contention of the city is that they don't
have any stand to enforce the code? Then what gives the city the right
to approve something when it has no purview in the matter vested in it?
The response from Mr.Dickey was unclear. At this time Mr.Morley started
asking few questions to Mr.Dickey about enforcing the code etc.And after
this it was concluded by them that city cannot enforce the code as there
is no code to support that action. The same was the conclusion for the
illegal parking in undesignated places all over the plaza posing public
safety issues that there is nothing in the code to enforce. Mr.Dickey
communicated that even the fire department cannot do anything as they
don't consider the west side aisle as "fire lane" and all they require
is access to the units from the front. In the event our blocked door is
blocked and cannot be opened fully then fire department can be engaged.
4.I told the following to Mr.Dickey and Mr.Morley based on what they
concluded:
a) No business needs to apply any permit to expand it's parking lot and
can go about doing it without going through the hassle of dealing with
city without any repercussions as there is no code to prevent the same
b) That if I were to park one of our big trucks anywhere in the parking
lot(on the wild wild west side) of plaza and blocking the traffic flow
then can expect no interference from the city as there is code to
prevent it.
Both Mr.Morley and Mr.Dickey acknowledged that the interpretation was
correct. Mr.Morley stated he understood I was talking in hypothetical
and doesn't think b) will be done.He recommended working with the land
lord and have him make changes to the plaza.
5.Towards the end of the meeting Mr.Morley expressed hope that the
issues do not make us leave the city as it'll make him sad. I told
Mr.Morley what our investment is and what our payroll amounts to. And
have no plans of going anywhere. Anna felt the statement was veiled and
expressed her opinion on the same. By then the Assistant of Mr.Morley
came to remind him about his next meeting and we ended the meeting.
