Ms.Defoe-Surprenant,
Good Afternoon.
You had called me earlier this morning and left a VM. I subsequently
returned your call.I'm sending this message post our telephone
conversation between 12.17 pm and 12.33 pm.Here's what we discussed:
1.You told that there is only an application to increase the number of
parking slots in the plaza and it' still in review. Given that the
application to increase the number of parking spots is still under
review the City cannot do anything about it.
2. I told you that saying the application is under review and therefore
city cannot do anything about the matter is not right. If the
application is still under review then how can the city allow someone to
draw new spots in the parking lot prior to the approval ? And more
importantly how can the city not take responsibility in matter by saying
we haven't approved anything therefore we cannot interfere? You didn't
have a response when I asked if the city will take the same line of
approach if people waiting on permits go ahead do whatever they do
before the permits are approved and inspections are passed without
penalizing them.And as a matter of fact these spots have been there for
more than a year and was surprised to know that they were put in place
without approvals.More surprising was the response of the city that it
cannot do anything as the application is still under review and not
approved.
3. The following was the course of action you recommended:
a) Call the fire department and file a complaint
b) If they too will not take action then you'll work with city code
enforcement to see what can be done.
Asked you if you're asking me to file a complaint with fire department
for the blocking of the back door or for all matters parking in the
plaza? You said all matters related to parking in the plaza. I expressed
my skepticism in the recommended course of action however said will
follow the same. In the event the recommended course of action takes me
nowhere will get back to you. You expressed your inability to help me
any further at this time and told that you are just passing the
information provided by your higher ups. Said I understood your
predicament however expect a communication in writing (response to my
email) restating whatever you told me over the phone starting with the
application in review and city cannot intervene as the application
hasn't been approved , the recommended course of action etc., copying
whoever provided you with the message you conveyed to me over the phone.
I've tremendous respect for local government employees and understand
that certain elected officials are trying to circumvent the processes
and procedures here . As requested in the call please send a written
response. Truly appreciate that you're trying to help within the
constricting parameters of constraints imposed by people higher in the
hierarchy for reasons only known to them.

Chris Robinson in the Code Enforcement states that parking in
private property is no longer in his realm as it is with the local PD
now. He asked me to get in touch with the local police this afternoon
when our back door was yet again blocked . Local police say they cannot
do anything as it is a private property. Left VM to Chris Robinson on
what the local PD stated and didn't hear back from him.
Therefore as stated yesterday my question is how did the city
approve the expansion of Southern Charm despite knowing very well the
parking issues in the plaza. It is no secret that Southern Charm and the
landlord were pulled up by the city for illegal parking in the adjacent
property racking up hefty fines.Despite that permits for 2 expansions
were approved by the city.Now with code enforcement and local PD saying
it's not their responsibility answer to our question from planning and
zoning dept. is much more pertinent and imperative.
Yesterday you asked if we had documentation? Please find a link
below with all the communication since 2nd August 2018 (including
photos) which we had with the Land Lord on this parking matter. We too
are paying same taxes and have the same rights as any other business in
the city therefore expect transparency and probity from local government
especially when their decision is affecting our business.

a.The photos start from the front of the property
b.Then proceeded to take photos of new spaces added from
the back of our store i.e. Edible Arrangements working my way to the
back of the Southern Charm
c.Finally the one new spot created by the drive through
window of Edible Arrangements
d.Note that vehicles are parked even before the doors in
the back , as the way the lots have been drawn it appears they too are
legit parking spaces.
Hope this helps you in figuring out variances if any
between what was approved and what is currently in place. And attached
to this email are photos(different from the one under the link) showing
how these newly created parking spots both in the front and in the back
have created a bottleneck with almost no maneuvering space for all of
our suppliers delivery vehicles including UPS etc to get to the back due
to .lack of clearance.As shown in the photos even our small delivery
vehicle is not able to get through.Didn't want to confuse you therefore
separated the photos of the new spots from the ones showing the issues
posed by them.

P.S. An email with formal complaint to Code Enforcement
will be sent tomorrow after compiling all the correspondence we've had
