COMPLIANCE HEARINGS:
1. Case No. 96-01, Cocoa Beach Motel II, and James W. Peeples, III, Agent, Parcel 767,
Section 15, Township 24 South, Range 37 East, Brevard County, Florida (8701
Astronaut Boulevard) - Violation of Section 94-7, Conformance and 94-64 (f), Criteria
and Standards for Measurement and Placement of the Cape Canaveral Code of
Ordinances.
Mr. Mullins testified that the compliance date was April 11, 1996 and the sign remained in non-
compliance. He advised that a building permit had been acquired to bring the sign into
compliance. The Board members reviewed a survey that was provided by the City Engineer.
Discussion was held regarding the sign and the cost incurred for the survey. After discussion,
the Board agreed that the City should pay for the survey. Attorney Goldman suggested that Mr.
Peeples name be deleted where referenced since he was only the agent for the property owner.
Motion by Mr. Anderson, seconded by Mr. Godfrey to table the Compliance Hearing in Case
No. 96-01 until June 13, 1996 and to delete any reference to James Peeples. Motion carried,
as amended, by majority, as follows: Mr. Anderson, for; Ms. Boone, against; Mr. Godfrey,
for; Mr. Hernandez, for; Mrs. Russell, for; Mr. Stanker, for; and Mr. Roberts, for.
2. Case No. 96-13, James D. Thompson dba Citgo Service Station Enterprises - Violation
of Sections 70-69, License Required; Payment of Tax Prerequisite to Issuance, and 70-
71, Engaging in Business Without Paying Tax or Making Reports of the Cape Canaveral
Code of Ordinances (8100 Astronaut Boulevard).
Mr. Mullins testified that the Citgo Service Station had paid for their business license and this
case was in compliance.
Motion by Mr. Anderson, seconded by Mr. Roberts to find Case No. 96-13 in compliance and
to waive any fine imposed. Motion carried unanimously.
PUBLIC HEARINGS - POSTPONED FROM PREVIOUS MEETING:
1. Case No. 96-07, Magma Trading Corporation - Violation of Sections 34-97, Duties and
Responsibilities for Maintenance; 34-181, Storing, Parking or Leaving on Private
Property; and 110-551, Location of Recreational Vehicles, Camping Equipment, Boats
and Boat Trailers of the Cape Canaveral Code of Ordinances (Avon Arms
Condominiums, 307 Adams Avenue).
