Mike and I met with Carmen (owner) this morning regarding this issue.
The City is in no way liable/at fault in this situation. We explained to
Carmen that when she had the home renovated (2015 I think), the cost to
do so exceeded 50 percent of the value of the structure. This triggers a
requirement to meet current codes, including the requirement to elevate
the building slab. Her contractor then got a new appraisal to increase
the cost of the house and also lowered the cost of the renovation to not
trigger the 50 percent rule. This is all allowed by Code.
In short, they choose not to meet the 50 percent rule and bypass
elevating the slab. We explained this to her and she was appreciative of
this information. She told us that she was not aware of any of this.
I have asked John Pekar to visit with her to provide possible solutions
to her situation.

Can you give us a summary/timeline of permitting/building
modifications/drainage issues for the subject property.
Looks like her property is 3 to 4 feet below the crown of the road,
which is it obvious it had to be built that way, but she wants to sue
the city now for flooding issues.
