PUBLIC PARTICIPATION:
The Planning & Zoning Board will allow public comment on any item on the agenda at the
time each agenda item is considered by the Board, with the exception of ministerial items
(e.g., approval of agenda, minutes, informational items, or ceremonial proclamations),
emergency items and other items for which there is no opportunity to be heard as
provided in section 286.0114(3), Florida Statutes. Quasi-judicial items shall require a public
hearing, and public comments will be accepted at the time the hearing is opened. The
Planning & Zoning Board ordinarily will not take any official action under the “Reports and
Open Discussion” section of the agenda and, accordingly, public comment on these items
will not ordinarily be accepted. Should any official action be deemed necessary on an item
under “Reports and Open Discussion” or an item added to the agenda during the meeting,
public comment will either be accepted prior to official action being taken or will be
accepted when the item is placed on a future agenda for further consideration. The Board
may limit citizen comments to three (3) minutes if large numbers of citizens are present to
comment, except when additional time is required to afford due process for quasi-judicial
items.

A Meeting of the Planning & Zoning Board was held on December 4, 2019,at City Hall Council
Chambers, 100 Polk Avenue, Cape Canaveral, Florida.Vice Chairperson John Pricecalled the
meeting to order at 6:00p.m.The Secretary called the roll.

NEW BUSINESS:
1.Approval of Meeting Minutes: May 9, 2019 & August 21, 2019.
Motionby Mr. Russelland seconded by Mrs. Bassto approve the Meeting Minutes of
May 9, 2019 and August 21, 2019.Vote on the motioncarried unanimously.
2.Election of a new Chair and Vice-Chair:
Mr. Dickey asked to interject to explainthat City Council reinstated John Price and Lamar
Russell.
Mr. Pearson requested tabling the item until the next Board meeting. All Board Members were in
agreement.
3.Interview Board Applicant –Nancy Gentilquore.

Mrs.Gentilquore explained her background, qualifications and reason for applying. The Board
members thanked her for applying.
Motion by Mr. Russell, seconded by Mrs. Bass to recommend approval to City Council. Vote
on the motion carried unanimously.
Mr. Price suggested moving Item #10 as the next item for discussion since there was a large
turnoutfor public participation.
10.Quasi-Judicial and/or Public Hearing: Consideration and Recommendation to the City
Council Re: Future Use of the Ridgewood Avenue Extension right-of-way.
Staff presented report/photos to include location, ownership, beach crossover, public access,
citizen concern if path were closed off and leaving property as it stands.
Residents from Ocean Oaks, Ocean Woods and Harbor Heights provided input.City Attorney
Garganese clarified some issues concerning ownership,public access of the common area and
easements. Mr. Pekar addressed issues concerning stormwater and drainage. Mr. Morley
clarified some key points to include, maintenanceof existing dirt path, creating a new path and
not changing anything.
Discussion ensued to include the creation of a new path, lighting, signage, leaving things as is,
purpose of a new pathway, beach access,students using the pathand concerns if access to path
weretaken away. Public Participation was closed at 6:58 p.m.
Mr. Morley stated that the Community would like for there to always be public access. The City
will address if it becomes an issue at some time in the future butfor now, will not sell the
Ridgewood Avenue Extensionright of way.
Motion by Mr. Price andseconded by Mr. Russell to not take any action. Voteon the motion
carried unanimously.
Mr. Price asked for a 5 minute recess at 7:08 p.m.

4.Quasi-Judicial and/or Public Hearing: Consideration and Recommendation Re: Site
Plan Approval for a proposed Commercial Parking Facility located at 8945 Columbia
Road (PIN 24-37-15-00-30) -Section 110-223–BRB Enterprises, LLC, Applicant.
Staff presented report/photos to include location and access points. Mr. Dickey explained that
the configuration of the property limitedthe typesof development.
Motion by Mr. Pearson and seconded by Mr. Russell to recommend approval. Vote on the
motioncarried unanimously.

5.Quasi-Judicial and/or Public Hearing: Consideration and Recommendation Re: Site
Plan Approval for Country Inn & Suites located at 9901 Astronaut Boulevard, Section
110-223–Allen Engineering, Applicant.
Staff presented report/photos. Mr. Dickey explained the request was to authorize an at-grade
parkingdeck constructed over a new dry pond that included a system of perforated piping and
would result in a net increase of 112 parking spaces.
Motion by Mr. Price and seconded by Mr. Russell to recommend approval. Vote on the motion
carried unanimously.
6.Quasi-Judicial and/or Public Hearing: Consideration and Recommendation Re: Lot
Split for the Wave Village Mixed-Use Project located at 8501 Astronaut Boulevard,
Section 98-66, Wave Village, LLC, Applicant.
Staff presented report/photos. Mr. Dickey explained the proposed lot split would create two
parcels: Parcel “A” consisting of 3.106 acres and Parcel “B” consisting of 1.894 acres
.
Motion by Mr. Russell and seconded by Mr. Price to recommend approval. Vote on the motion
carried unanimously.
7.Quasi-Judicial and/or Public Hearing: Consideration and Recommendation to City
Council Re: Ordinance No. XX-2020 amending the City’s Site Plan Review
requirements, Chapter 110, City of Cape Canaveral, Applicant.
Staff presented report/photos.Mr. Dickey explained this will be a change to streamlinethe site
plan approval process and to avoid unnecessary delays for development projects.
City AttorneyGarganeseoutlined the site plan review process based on requirements, criteria
andnew language to help guidethe process. Discussion ensued to clarify the recommendation
regarding minor site plan changes, basis for 20% designationand assurances that all applicable
agencies would review the changes.
Motion by Mr. Pearson andseconded by Mr. Price to recommend approval to City Council.
Vote on the motion carried unanimously.
8.Quasi-Judicial and/or Public Hearing: Consideration and Recommendation Re: Site
Plan Approval for Radisson Master Plan located at 8701 Astronaut Boulevard, Section
110-223–MAI Design Build, Applicant.
Staff presented report/photos. Mr. Dickey discussed revisions to include the dumpster
relocation, addition of a generator, stormwater changes, an entrance shifted to the west by 10
feet and the addition of a right inonly entrance off of Astronaut Blvd.

9.Quasi-Judicial and/or Public Hearing: Consideration and Recommendation Re:
Ordinance No. XX-2020, Chapter 110, Tattoo Shops –City of Cape Canaveral,
Applicant.
Staff presented report/photos.Mr. Dickey explained that there was discussionat the October
14, 2019 City Council meeting regarding the zoning limitation placed on tattoo shops. The
speakers at the meeting felt this was a violation to the First Amendment.
Discussion ensued to clarify distance/separation standards (100 feet), rezoning along A1A (C-
1) and visibility to attract business.
Motion by Mr. Russellandseconded by Mr. Price to recommend approval to City Council.
Vote on the motion carried unanimously.
11.Discussion Item –Off-Street Parking
Staff opened the discussion by indicating theissue was discussed at the November 19, 2019 City
Council Meeting. Staff prepared the agenda item and discussed possible revisions to the City Code
to reflect Council direction and begin to implement the City’s resiliency goals. Board Members
offeredthe following: pervious concreteoptions and investigating the cost, optimism regarding
steps towards resiliency, agreement with Staff’s report and working with City Attorney to prepare
and ordinance for review at an upcoming meeting.

Subject:Future need and use of the undeveloped portion of the Ridgewood Avenue Extension
property.
Applicant/Owner:City of Cape Canaveral
Summary: On October 15, 2019, the City Councilat a regularly scheduled meeting, requested
that the Planning & Zoning Board (“Board”) conduct a public hearing to evaluate the City’s
future need and use of the undeveloped portion of real property generally known as the
Ridgewood Avenue Extension (Property). Specifically the Council motioned:
“to send the item to the Planning and Zoning Board for a recommendation, to
maintain and not abandon the Ridgewood Avenue Extension property and to respect
the two abutting property owners to the best of the City’s abilities, including the
possibility of public improvements to walkability.”
On September 20, 2019, in anticipation of the afore-mentioned Council meeting, the City issued
a Fact Sheet (Attachment 2) which included the following information:
A natural path is located on Ocean Woods private property and provides Ocean Woods
residents access (foot traffic & bicycles) to the Ocean Wood’s private beach access. The
City is unaware of any Public Access Easements giving the public the right to travel
across the natural path located on Ocean Woods private property.
Representatives from Ocean Woods Homeowners Association (HOA) and Ocean Oaks
HOA requested to meet with City Staff regarding the Subject Parcel. The representatives
asked if the City would consider conveying (transferring ownership) a portion or all of
the property, which is located south and east of the Ocean Woods’ natural path.
Staff subsequently attended a site visit with the two HOA representatives to gather
additional information regarding the request. The request is still being evaluated by the
City.
No action has been taken by the City to convey any portion of the Subject Parcel and
the City is under no obligation to convey the property. Any decision to convey the
property would have to be made by the City Council by ordinance at a public hearing.
As directed by Council, the Board conducted a public hearing on December 4, 2019, at which
time no action on the item was taken; however, Staff was given direction to prepare a policy
statement that the Board could consider. To that end, a “Findings and Policy Recommendation
Regarding the Future use of Ridgewood Avenue Extension Property” has been prepared
(Attachment 3), which includes a recommendation that the Board find:
1.The City should maintain fee simple ownership of the Ridgewood Avenue Extension
property.

2.The City should continue to maintain the Ridgewood Avenue Extension as green
space.
3.In the event that Ocean Woods constructs improvements on its privateproperty which
have the effect of closing the existing private dirt path to the general public in the future,
the City should consider designing and constructing a public pedestrian path through
the Ridgewood Avenue Extension property for purposes of maintaining the connectivity
currently enjoyed by the public between Harbor Heights and the paved portion of
Ridgewood Avenue.

A public beach accessmaintained by the City is located adjacent toHarbor Dr. and
currently serves the public, including residents of Harbor Heights.
The City has not discovered anyrecorded private beach access easements running in
favor of residents of Harbor Heights.
To the south of the City’s public beach access adjacent to Harbor Dr., a private beach
access easement benefiting Ocean Woods lies across a potion of the City’s Ridgewood
Avenue Extension property and continues further to the east across a northern portion of
the Ocean Oaks property. This easement was conveyed to Ocean Woods many years ago.
The City is not responsible for the Ocean Woods private beach access easement.
A natural path is located on Ocean Woods private property and provides Ocean Woods
residentsaccess to the Ocean Wood’s private beach accessdescribed above. The City is
unaware of any Public Access Easementsgiving the public the right to travel across the
natural path located on Ocean Woods private property.
Ocean Woods hasthe right to restrict accessto the natural path located on the Ocean
Woods private propertyto Ocean Woods residents, but historically has permitted the
public to use the natural path.
Representatives from Ocean Woods and Ocean Oaks requested to meetwith City Staff
regarding the unpaved portion of the Ridgewood Avenue Extension property, which was
conveyed by deed to the City many years ago. At that meeting therepresentativesasked
if the City would consider conveying a portion of the unpaved part of the Ridgewood
Avenue Extension property which is located south and east of the natural path. Staff
agreed to meet.
Staff subsequently attended a site visitwith the two partiesto gather additional
information regarding the request. The request is stillbeing evaluated by the City.
No action has been taken by the City to convey any portion of the Ridgewood Avenue
Extension property and the City is under no obligation to conveythe property.Any
decision to convey the property would have to be made by the City Council by ordinance
at a public hearing.

THE FUTURE USE OF RIDGEWOOD AVENUE EXTENSION PROPERTY

consensus on the following findings and recommendation to the City Council:

4. During the past few years, Ocean Oaks and Ocean Woods have expressed interest in
acquiring a portion or all of the Ridgewood Avenue Extension from the City, and the City has
been in discussions wi
maintain ownership of the property or to convey all or a portion of the property to either
Association or both.
5. In furtherance of these discussions, the City had the boundaries of the Ridgewood
Avenue Extension staked by a surveyor. Upon being staked, the Ocean Oaks Condo
Association apparently realized that it was inadvertently maintaining a portion of the Extension
property currently covered with grass because of the mistaken belief that the property was
area and the City has commenced maintenance responsibilities.

7. Because of the historical pedestrian use of the dirt path, there appears to be an
impression by some members of the public that the existing Ocean Woods beach access path
is a public pedestrian way. However, in reality, the path is entirely on private property except
for the portion of the path that traverses the City-owned Ridgewood Avenue Extension.
8. Notwithstanding, Ocean Woods currently has not constructed improvements which
epresentatives
of the Ocean Woods Homeowners Association indicated that the Association does not
currently intend to construct such improvements, but recognizes that the Association may
have the right to construct such improvements on the portion of the path located on Ocean
9. Likewise, it is unknown whether Ocean Oaks has or will construct similar private
improvements on the portion of the path across its common area property in the future.
10. It is evident from the two public hearings that some members of the general public
(including elementary students residing in Harbor Heights) utilize the dirt private beach access
path as a pedestrian connection to and from Harbor Heights and the paved portion of
Ridgewood Avenue. This pedestrian connection apparently affords the public a convenient
two-way pedestrian connection between Harbor Heights (including Peacock Beach) and
multiple destination points of interest including Ocean Woods, Ocean Oaks, Cape View
Elementary School, Cherie Down Park and the Ridgewood Avenue bicycle and pedestrian lane.

11. If Ocean Woods closed the private dirt path on its common property in the future, the
general public, including Cape View elementary students residing in Harbor Heights, will be
required to use an alternative public pedestrian route connecting Harbor Heights and the
paved portion of Ridgewood Avenue unless the City constructed a new public pedestrian path
within the Ridgewood Avenue Extension property.
12. Some members of the public expressed concern about losing pedestrian access across
of the Ridgewood Avenue Extension in the event the City needed the property to construct a
property.
13. Existing alternative public pedestrian routes connecting Harbor Heights and the paved
portion of Ridgewood Avenue are longer and more circuitous. For example, a pedestrian
would be required to use N. Atlantic Avenue and one of the feeder streets such as E. Central
Blvd or Washington Avenue, or utilize the beach between the public beach access points at
Peacock Beach and Cheri Down Park.

pedestrian ways in the planning of transportation facilities.
T-1.8 The City shall support forms of transportation which are alternatives to

facilities and residential areas. The City will consider providing strategically
placed bicycle racks.
16. Maintaining public pedestrian connectivity between Harbor Heights and the
paved portion of Ridgewood Avenue, by private or public means, is consistent with the
and Comprehensive Plan policies which strongly endorse and support
creating and maintaining bikeable and walkable pedestrian transportation facilities.
RECOMMENDATION
1. The City should maintain fee simple ownership of the Ridgewood Avenue Extension
property.
2. The City should continue to maintain the Ridgewood Avenue Extension as green
space.
3. In the event that Ocean Woods constructs improvements on its private property
which have the effect of closing the existing private dirt path to the general public in
the future, the City should consider designing and constructing a public pedestrian
path through the Ridgewood Avenue Extension property for purposes of maintaining
the connectivity currently enjoyed by the public between Harbor Heights and the
paved portion of Ridgewood Avenue.
