What about the "illegally" drawn parking spots in the back of the building ? Your communication doesn't address it. Please be clear about the same. Are you now stating that they're ok to be there after maintaining the past few weeks that they were not "formally" approved by the city? Actually didn't know that there is something called "informal" approval till the meeting we had few weeks back!!!??? Who then is responsible when there is no clearance for the delivery trucks to come through the back and when our back door gets blocked? I'll be filing a formal written complaint in the morning on how the city engages in selective enforcement and how some expansions are being approved to favor certain vested interests without following the processes and procedures common to all citizens . Appalled that it took you 3+ weeks to come up with a contradictory message and this looks like a justification to someone's action/decision of approving the parking spaces in the back without relevant paperwork. Let me clearly state that some of the issues that are being experienced by tenant(s) at the property are outside the City’s purview. The City can and will assist with issues that are directly related to City Code. Other issues being reported must be addressed by the tenant(s) and/or landlord, including the designation of reserved parking (which is not prohibited by City Code), speeding in the parking lot, access to the dumpster, leaking roof, etc. The City Code establishes specific standards/requirements related to off-street parking for all businesses in the City. The following is a break-down of required parking for the current tenant mix: · Edible Arrangements – 2400 sq. ft. – 8 spaces (1 space/300 square feet) · Legend Smoke Shop – 1200 sq. ft. – 4 spaces (1 space/300 square feet) · The Mortgage Project – 1200 sq. ft. – 4 spaces (1 space/300 square feet) · Southern Charm – 117 seats – 39 spaces (1 space/3 seats) · TOTAL – 55 spaces There are currently 55 permitted, striped parking spaces on the property. As part of the most-recent expansion of Southern Charm, Staff discussed the parking situation with the tenant and landlord. Specifically, that the allowed seats would be limited by the available number of parking spaces. Therefore, seating at Southern Charm is limited to 117 seats. City Staff will monitor this on an-going basis until such time that additional parking is available. Note that the landlord is currently in the process of permitting the construction of 15 additional parking spaces along the western property line. In addition to the 55 permitted spaces, there are five (5) unpermitted, striped parking spaces along the west side of the building. Regarding these spaces, it was suggested that they represented violations to the City’s Fire Code requirements due to restricting emergency vehicular movements around the building. To determine what, if any, violations exist, Staff walked the property on January 28, 2020 with Chief Dave Sargeant of the Canaveral Fire Rescue (CFR) and Fire Inspector Jeff Roberts, also with the CFR. After an inspection of the property, Chief Sargeant determined there is no violation of Fire Lane regulations. Fire lane regulations only apply to the drive aisles in the front (east side) of the building. It was determined that Code Enforcement can enforce fire lane violations in this area. Therefore, if any parking occurs in non-designated spaces within the fire lane (east of the building), Code Enforcement should be contacted immediately. Until such time that the additional 15 parking spaces are completed, the property owner may request approval of the five (5) parking spaces along the west side of the building. This would be considered a minor commercial improvement and would not be required to meet requirements under Article VI – Site Plans of Chapter 110, City Code. However, the property owner would be required to submit a revised site layout plan showing the dimension and location of the requested spaces. Note that these spaces will be eliminated as part of the construction of the 15 spaces. Finally, the City’s Public Works Department was contacted to determine if there have been any reported issues with access to the refuse dumpster, located in the northwest part of the property. Waste Pro was contacted and reported there have been no problems with accessing the dumpster. Should you have any questions regarding this matter, please contact me. Thank you. I would like to know how long we should expect to continue waiting for the city attorney to provide you with whatever information you've sought from him and to know the reasons for seeking the same as it's having a impact on our situation. Definitive answers at the earliest would help us in chalking our course of action in protecting our business interests and to secure the safety of our personnel . Looking forward to your response. Now currently we have the same situation with our supplier's delivery truck not being able to come through the side nor exit through due to illegal parking.
